CITY OF CALDWELL
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R-3 (HIGH DENSITY
RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR
TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF
IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission and
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code,
approved Case No. ZON23-000001 (Faith Landing) at a public hearing held this 20`h day of June, 2023.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following
described property should be rezoned to R-3 (High Density Residential) zone:
A parcel of land being a portion of Faith Landing Subdivision (Book 39 of Plats, Page 31), situated in the S % of Section
6, T3N, QW, BM, City of Caldwell, Canyon County, Idaho and being more particularly described as follows:
Commencing at the S 1/4 corner of said Section 6, which bears N89"37'09"W, 2622.80 feet from the SE corner of
said Section 6; thence S89"37'09"E, 89.97 feet along the southerly line of the SW % SE % of said Section 6; thence
N00°22'51"E,180.89 feet to the southerly corner of Parcel 9 as described in Warranty Deed per Instrument No. 2021-
088511 and being the POINT OF BEGINNING; thence N38-22'04"W, 147.19 feet along the southwesterly boundary
of said Warranty Deed to the easterly right-of-way line of Isaiah Way; thence along said easterly right-of-way line as
follows: 31.89 feet along the arc of a curve to the left, having a radius of 525.50 feet, a delta angle of 03°28'37", and
a chord bearing N53°22'14"E for 31.89 feet; thence N51°37'56"E, 11.76 feet to the intersection of said easterly right-
of-way line and the easterly extension of the centerline of Enoch Drive; thence leaving said easterly right-of-way line
and along said centerline of Enoch Drive and the easterly extension thereof as follow: N46°06'11"W, 434.65 feet;
thence 103.15 feet along the arc of a curve to the right, having a radius of 1000.00 feet, a delta angle of 05°54'36",
and a chord bearing N43°08'53"W for 103.10 feet; thence N40'11'35"W, 189.23 feet; thence 105.69 feet along the
arc of a curve to the left, having a radius of 1000.00 feet, a delta angle of 06°03'20", and a chord bearing of
N43°13'15"W for 105.64 feet; thence N46°14'55"W, 236.24 feet to the boundary of said Faith Landing Subdivision;
thence leaving said centerline and following said subdivision boundary as follow: N43"48'37"E, 269.87 feet; thence
N26"53'38"W, 119.10 feet; thence N43'44'15"E, 419.00 feet; thence 546"15'56"E, 1429.86 feet; thence
S51"26'27"W, 831.74 feet to the POINT OF BEGINNING. Contains 23.092 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby
instructed to so designate the same above described property on the official zoning map and other area reaps of the
City of Caldwell, Idaho as R-3 (High Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded
and annulled.
Section S. This ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.

OF CERTAIN PROPERTY
Ordinance No. 3493 was passed by the Council and approved by the Mayor on the 201 day of June 2023.

The Mayor and City Council approved the foregoing summary on the 20th day of June 2023, for publication
on the 256 day of June, 2023, pursuant to Idaho Code § 50-901A.
