HomeMy WebLinkAboutORD 3508ORDINANCE NO.3508 BILL NO. 24 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL REPEALING AND REPLACING CHAPTER 02, ARTICLE 32 OF THE CALDWELL CITY CODE, PERTAINING TO THE PATHWAYS AND BIKE ROUTES COMMITTEE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 2, Article 32 of the Caldwell City Code, is hereby repealed and replaced as follows: ARTICLE 32: PARKS AND RECREATION COMMISSION: 02-32-01: COMMISSION CREATED: There is hereby created and established a commission to be known as the City of Caldwell's Parks and Recreation Commission. 02-32-02: MEMBERSHIP: The Caldwell Parks and Recreation Commission shall consist of not less than three (3) nor more than seven (7) voting members including one (1) member of the city council. An appointed member of the commission must reside in the city and must remain a resident of the city during service on the commission. All members shall be appointed by the mayor and confirmed by majority vote of the city council. Appointment of one (1) youth advisory member is welcome and encouraged, with the term of office expiring on August 3151 of each year. 02-32-03: TERMS OF OFFICE: The term of office for members shall not be more or less than three (3) years, provided however, that at the expiration of said term of office, the member shall be eligible for two (2) additional consecutive reappointments, each for one full term in addition to the original term already served. No person shall serve more than two (2) full consecutive terms without specific concurrence by two-thirds (z/3) of the council adopted by motion and recorded in the minutes. In no case shall any person serve more than three (3) full consecutive terms. Vacancies occurring otherwise than through the expiration of terms shall be filled in the same manner as the original appointment. Members may be removed pursuant to Caldwell City Code Chapter 2, Article 6. 02-32-04: ORGANIZATION: The commission shall meet monthly, with an exception being made should a meeting for that month be unnecessary. Additional meetings may be called for by the Parks and Recreation Director, as necessary. The commission shall elect a chairperson and create and fill any other office Ord. 3508 — Page 1 it may deem necessary. The chairperson shall preside at meetings of the commission. The vice chairperson shall, in the absence of the chairperson, perform the duties of the chairperson. All meetings of the commission shall be open to the public and follow the requirements of Idaho's open meeting laws. Executive sessions may be closed by the presiding officer pursuant to Idaho Code, Section 74-206. A member of Caldwell's Parks and Recreation staff shall keep minutes and other appropriate written records on behalf of the commission. A simple majority of commission members present at any given meeting constitutes a quorum. 02-32-05: POWERS; DUTIES: It shall be the duty of the Commission to recommend and make suggestions to the Council regarding: 1) The formation of new parks and acquisition of land. 2) The development of new pathways. 3) The renovation and expansion of current City parks. 4) The implementation or updating of park policies and recreation programming. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 6th day of June, 2023. Section 1: Amends Caldwell City Code Chapter 2, Article 32 by repealing the prior code concerning the pathways and bikes commissions and creating a new Parks and Recreation Commission responsible for making recommendations to the City Council concerning parks, land acquisitions, pathways, and recreation programing. Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3508 provides an effective date, which shall be on the 13th day of June, 2023. Ordinance No. 3508 was passed by the Council and approved by the Mayor on the 6" day of June, 2023.
