ORDINANCE NO. 3501
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE R-3 (High Density) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN
THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE
CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON23-000003 (The Gables Senior Living) at a public hearing held this 61^ day
of June, 2023.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to R-3(High Density) zone:
A parcel located in the SE % SW % of Section 34, T4N, R3W, BM, Canyon County, Idaho, being more
particularly described as follows:
COMMENCING at the SW corner of Section 34, said point lies S89020'30"W, 2649.73 feet from the S %
corner of Section 34; thence N89°20'30"E, 1324.87 feet to the SW corner of said SE % SW %; thence
N89020'30"E, 391.98 feet (of record to be 395 feet more or less) to the centerline of a drain ditch; thence
N01"31'00"E (of record to be N01°41'45"E), 40.03 feet on said centerline to the POINT OF BEGINNING;
thence N01°31'00"E (of record to be N01°41'45"E), 350.25 feet on said centerline; thence S89020'30"W,
340.00 feet along a line 390.00 feet North of and parallel with the South boundary of Section 34; thence
S01 °31'00"W, 350.25 feet; thence N89020'30"E, 340.00 feet along the North right-of-way boundaryof Ustick
Road to the POINT OF BEGINNING. Contains 2.73 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-3 (High Density).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 61" day of June, 2023.

ORDINANCE NO. 3501
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3501 was passed by the Council and approved by the Mayor on the 6th day of June
2023. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell,
Idaho 83605. The Mayor and City Council approved the foregoing summary on the 6th day of
June 2023, 2023, for publication on the 13th day of June 2023, pursuant to Idaho Code § 50-901 A.
A parcel located in the SE'/4 SW %4 of Section 34, T4N, R3W, BM, Canyon County, Idaho, being
more particularly described as follows:
COMMENCING at the SW corner of Section 34, said point lies S89120'30"W, 2649.73 feet from
the S '/4 corner of Section 34; thence N89°20'30"E, 1324.87 feet to the SW corner of said SE V4
SW '/4; thence N89°20'30"E, 391.98 feet (of record to be 395 feet more or less} to the centerline
