Dear Members of the Council:
In the matters above Canyon Highway District No. 4 (CHD4) has reviewed the application for annexation and
rezone of two parcels at 4905 and 4919 Hwy 20/26. CHD4 provides the following comments on the proposed
change in use:
I. C1ID4 requests the City annex the Borchers Lane right-of-way adjacent to the parcels in accordance with
Idaho Code 50-222 (2). The city has already annexed the parcel west of Borcher Lane at 4815 Hwy
20/26.
2. CHD4 recommends that future commercial access to the public highway system from the parcels be
restricted as follows:
a. Primary site access to be via Borchers Lane, located as far north from the Borchers Lane/Hwy 20-
26 intersection as reasonably possible.
b. Any access to Hwy 20-26 (subject to approval by Idaho Transportation Dept) should be right -in -
right -out only, and located far enough east of the Borchers Lane/Hwy 20-26 intersection to avoid
conflicts with turning movements into and out of the site.
3. The existing 56-foot right-of-way for Borchers Lane meets current highway district standards for a local
road. The planning functional classification maps adopted for use by CHD4 show Borchers Lane as a
local road. Additional right-of-way at the Borchers Lane/Hwy 20-26 intersection may be necessary to
provide sufficient intersection radii.

Attached please find a land use application that you are invited to review. This
case is scheduled to be presented before the Hearing Examiner on Tuesday,
November 8, 2016 at 7:00 pm.
Case Number ANN-16-06: A request by John Wardhaugh to annex two parcels
totaling 0.82 acres, more or less, with C-3 (Service Commercial) zoning
designation. The subject properties are located at 4905 Hwy. 20/26 and 4919
Hwy. 20/26 in Caldwell, Idaho.
Please review the attached application and information and provide us with your
written input. We request that you e-mail any comments as soon as possible but
no later than Friday, October 28, 2016.

The Idaho Transportation Department (ITD) has reviewed the referenced annexation application for
John Wardhaugh at 4905 and 4919 Highway 20;26, at milepost 26.05 LT. ITD has the following
comments:
ITD has no objection to the annexation of the parcels in this location.
2. No additional access to the State Highway system is requested with this application and
none is approved. Connection to or modification of an existing access to the State
Highway system will require a permit from ITD. A permit must be approved before
any work within the State right-of-way may begin. The applicant can contact Tyson
McCoy at 334-8335 for more information.
Idaho Code 40-1910 does not allow advertising within the right-of-way of any State
highway system.
4. IDAPA 39.03.60 rules govern advertising along the State highway system. Applicant
can contact Dion Burch at 334-8355 for more information.
ITD reminds the City that as properties develop the City is required to update
developments to current IDAPA 39.03.42 rules to reduce conflict points along the State
highway system thereby improving safety, mobility, and economic opportunity.
