1. Case Number ANN-19-12 & SUP-19-21: A request by Scott Kraemer to annex 5.3 acres,
more or less, with an M-1 (Light Industrial) zoning designation with an Annexation
Agreement. Also being requested is a special -use permit to operate an Amusement Center within
the proposed M-1 (Light Industrial) zoning district. The subject property is located at 11809 Ustick
Road (Parcel R3093400000), in Caldwell, Idaho.
Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report.
Mr. Wagoner stated the applicant is requesting to annex 53 acres with an M-1 zoning designation
so as to operate an amusement center on the property specializing in paintball. Staff is requesting
a deferral agreement on curb, gutter, road upgrades as Ustick Road is currently under construction.
One additional condition is a 6-month deferral for restrooms.
Scott Kraemer, 225 S Buttercup Court, Nampa, Idaho (applicant) stated this business has been
operating for 7 years in Nampa and they have been looking for a location in Caldwell. They
currently employ youth (16 and over) to learn a good work ethic and enjoy the sport. They also
have an (unofficial) youth program. The one issue is the airport and he has met with the airport
manager and he had no concerns whatsoever. They have netting that will go up and a 70 ft buffer
zone along the interstate. Safety is their number one concern. They have never had an injury or any
property damage in 7 years. It has been an exceeding pleasure dealing with all staff at the City.
Commissioner Nelson asked how aviation will realign after construction.

Mr. Wagoner stated he didn't trelieve aviation will change. The driveway will change to the East, but
he would have to confirm that with the City Engineer.
Commissioner Doty asked about the restrooms.
Mr. Kraemer stated that staff would allow them a 6-month deferral. They just want to get through
the winter and then they will construct them.
Commissioner Doty asked if that would go to a septic.
Mr. Wagoner stated yes, if there aren't city services available then they can put in a septic system.
Mr. Kraemer said he has been in contact with SWDH and there are 2 septic systems on the property,
they are waiting to hear back from SWDH.
Commissioner Hunsicker asked if there was a concern or code regarding with having the lights on
until 9pm.
Mr. Wagoner stated there is not any code and staff does not have any concerns.
Mr. Kramer stated that in his letter he stated that all lighting will be facing downward.
Mr. Camden Harwood, 1210 Virginia Circle, Nampa, Idaho (in favor) stated he has worked with
Scott for the past 2 Y2 years and he has learned a lot in that time. He has learned leadership skills, he
has learned to step up when needed, he understands customers and how to help them, and he has
learned a great work ethic. He has also learned how to save money and budget for college. He has
also found the right balance with work, school, hobbies, family and friends. The environment is like
a family.
Mr. Gavin Peterson, 3564 S Bo Daniel Place, Nampa, Idaho (in favor) stated that he thinks this
business is important because it provides an opportunity to work hard. As a referee his goal is
safety and for everyone to have a good time. It is a very positive and lovely influence. It's a great
place to have parties. Many different groups come; military, youth and church groups. It has
become an amazing experience and something to look forward to. He has learned how to work
hard and put forward his best self. He feels like he has gained a lot of responsibility.

2. Case Number Case Number OA-19-05: A request by the Caldwell Planning and Zoning
Department to amend the City of Caldwell Comprehensive Plan Map.
Testimony,
Jerome Mapp, 621 Cleveland Blvd., Caldwell, ID 83605, Director, presented the staff report. He
stated this case was brought to the commission in August of this year, the Comp Plan and Comp
Plan map. Since that time he has found out that map he was referring to was not the official city
comp plan map. In 2016 the City of Caldwell and the City of Nampa conducted a land swap (see
Map 1).
Mr. Mapp reviewed the following:
Map 1 - Parcels 1, 2 and 5 were removed from the City of Caldwell and transferred to the City of
Nampa. Parcels 3 and 4 were removed from the City of Nampa and given to the City of Caldwell.
Map 2 - Identifies the new boundaries of the Area of City Impact based upon the land swap.
Map 3 - During the August hearing, the director didn't identify for the record that these were new
land use designations. Since August, some of those land uses were modified due to the proposed
urban renewal district.
Map 4 - Describes the land use designation of Map 3.
Map 5 - Describes the new land use designations for the proposed urban renewal district.

Map 6 - Describes the parcel, which has been requested by the owner, foe Weitz, to add to the comp
plan map with a new land use of low density residential.
There is one more clarification; on the narrative he didn't see that he mentioned to the commission
the residential land use changes. The medium density residential states 12 units per acre For a PUD,
in the existing comp plan it is 10 units. He just wanted to point out that that did increase by 2. In
the high density it went up to 40 from 35.

RECOMMENDATION FOR OA-19-05 (Ordinance Amendment) MOTION: Commissioner
Hunsicker that Case Number OA-19-05 be approved with the new maps 4 & 6.A (PZ-1001 and PZ-
1002) and the clarification of the new medium density of 12 units per acre and high density of 40
units per acre. SECOND: Commissioner Nelson. Passed: Unanimous roll call vote.
3. Case Number OA-19-06: Review and make recommendations as to the conformity of a
proposed urban renewal plan with the general plan for the development of the City of Caldwell.
Testimony:
Doug Waterman, City Attorney, 1303 12th Avenue Road, Nampa, Idaho reviewed the Proposed
North Urban Renewal Area (CNURA) Plan. Mr. Waterman gave a general overview of the proposed
Urban Renewal Plan and the attachments and reviewed each goal with the Commission. This a new
plan, the current plan will sunset here in the next couple years. This is a new plan that will run for a
new 20 years.
I. Introduction/Course of Proceedings
The Caldwell City Council will conduct a hearing to take public comment, and make a final
decision, regarding the implementation of the proposed Caldwell North Urban Renewal Area Plan.
A copy of the plan is attached hereto as Exhibit A. Prior to that hearing, this Planning and Zoning
Commission is required to conduct a review of said Plan for its conformity with the
Comprehensive Plan of the City of Caldwell, and present written recommendations about said Plan
to the Caldwell City Council. The proposed method of working through the Review, and creating
Recommendations, concerning the proposed Plan are as follows:
(a) Staff (Douglas Waterman, City Attorney) will give an overview of the Plan.
(b) Staff (Douglas Waterman, City Attorney) will work through the Goals of the
Comprehensive Plan, Goal -by -Goal, providing initial information, and answering any
questions, related to the ways in which the Plan may conform to said Comprehensive Plan.
(c) When a Goal has been reviewed, the Planning and Zoning Commission will provide any
recommendations for the Plan, either by approving that the Plan meets the purposes of the
Goal, or by recommending modifications to ensure the same.
(d) When each Goal has been reviewed, and recommendations have been taken for each, the
Planning and Zoning commission will vote on the resolution, attached hereto as Exhibit B
and as modified during the course of the meeting to reflect any and all specific
recommendations of the Planning and Zoning Commission, which resolution will contain
the official statement of review for the Proposed Plan, as well as all recommendations of
the Planning and Zoning Commission. The Resolution shall also authorize the transmission
of the Review and Recommendation to the Caldwell City Council.

II. General Facts
(a) APPLICANT: Caldwell City Council/Caldwell Urban Renewal Area
(b) REQUEST: Review and Recommendations concerning the conformity of the proposed
Caldwell North Urban Renewal Area Plan to the comprehensive plan of the City of
Caldwell, Idaho.

The proposed Caldwell North Urban Renewal Plan is consistent with the following components
of the Comprehensive Plan:
1. Property Rights
Comment: Planning and zoning actions may be subject to a regulatory takings
analysis provided in section 67-8003 of the Idaho Code. Staff will follow the Attorney
General's Checklist Criteria outlined in the Idaho Regulatory Taking Act Guidelines prior
to initiating any proposed regulatory or administrative action on specific property and to
request legal counsel's review if any one of the criteria is answered in the affirmative. The
Plan does not involve any extraordinary activities which might cause regulatory takings
beyond the normal scope of the activities of the City of Caldwell.
2. Population
Comment: The Plan has no impact on census taking procedures or administration.
3. School Facilities and Transportation
Comment: The Plan has no impact on the Comprehensive Plan's Goals and Policies
related to school facilities and transportation, with the exception that road improvements
will help meet increased transportation needs, regardless of the specific transportation use.
4. Economic Development
GOAL 1: Promote economic development initiatives relating to housing, business, jobs,
schools, recreational opportunities, infrastructure systems, public utilities and facilities, and
public services.
Policy 1-1: Promote a positive working relationship between the City, businesses, and
economic development organizations.
Policy 1-2: Promote job market expansion that encourages opportunities for mid and upper -
range wage scales and benefits.
Policy 1-3: Encourage development that generates new job opportunity.
GOAL 2: Encourage business expansion and labor retention in areas suitable for commercial
development.
Policy 2-1: Provide commercial uses that meet all of the consumer needs for residents
within the community and thereby reduce vehicle miles traveled.
Policy 2-2: Improve and provide additional educational training of local residents in order
to keep and attract employers.
GOAL 3: Create neighborhoods where citizens can live, work and play.

Policy 3-1: Promote unique economic development projects that are designed to include
integrated uses such as housing, recreation, office complexes, restaurants, and shopping
areas.
Policy 3-2: Generate employment opportunities that support local economies and reduce
vehicle miles traveled between home and work.
Policy 3-3: Promote economic development growth that is sustainable, environmentally
manageable, that will assist in maintaining the City's fiscal stability, and that will reduce
the need for residents to commute out of the City.
Policy 3-4: Designate commercial centers, industrial parks and light industrial uses in areas
that can be supported by all modes of transportation.
Policy 3-5: Encourage mixed -use developments.
GOAL 4: Protect the City's property values, attractiveness and livability with measures that
protect Caldwell's waterways.
Policy 4-1: Stimulate revitalization of the downtown through initiation of physical and
aesthetic improvements along waterways.
GOAL 5: Recognize and promote the College of Idaho, West Valley Medical Center and the
Caldwell Airport's economic assets.
Policy 5-1: Coordinate efforts with local institutions, schools, and colleges in recruiting
businesses and industries that provide quality jobs for a capable and well -prepared work
force.
Policy 5-2: Enhance institutional district standards to become sustainable with the latest
land use trends.
GOAL 6: Recognize and promote the importance of retaining and attracting basic industries
to Caldwell.
Policy 6-1: Work with the Economic Development Council to develop incentives to retain
existing businesses or allow an existing business to expand.
Policy 6-2: Ensure that an adequate inventory of commercial and industrial property is
available for new industries.
Comment:
- The Plan contemplates, by remedying the deteriorated and deteriorating state of the
CNURA, that new development and redevelopment opportunities will become
available within the CNURA, which will increase the property values within the
CNURA.
- The Plan contemplates the utilization of increment reimbursement agreements and
development agreements, as well as the participation in local improvement districts
and business improvement districts.
- The Plan does not specifically promote any planned unit developments, but rather
designates the uses within the CNURA as being generally commercial and industrial,
which uses will be promoted and marketed by the Caldwell Urban Renewal Agency
and the Caldwell Economic Development team.
- The Plan contemplates the utilization of business improvement grants to promote mid
to high -paying job creation.
- The Plan includes multiple projects for the creation or expansion of City Parks,
including along the Boise River.
- The Plan includes methods of providing economic development incentives to bring
commercial and industrial business to the City of Caldwell.

5. Land Use
GOAL 1: Establish land -use management policies that protect property rights and the
environment, maintain a high quality of life, provide adequate land for all types of
development, and adequately buffer non -compatible uses.
Policy 1-1: Guide the growth and development of land uses in such a way that the health,
safety, and general welfare of residents will be protected.
Policy 1-2: Encourage commercial and industrial uses in areas that are readily accessible
to regional and principal arterials and/or public transit.
Policy 1-3: Utilize the planned unit development (PUD) process in situations that qualify
under code.
Policy 1-4: Encourage planned unit developments (PUD) in areas that qualify for inf ll
development.
Policy 1-5: Carefully integrate manufactured home developments with other surrounding
residential neighborhoods, except in Historic Districts where the placement of
manufactured homes should be discouraged.
Policy 1-6: Encourage non-residential special uses in residential areas where they can be
appropriately integrated with the surrounding area and where the health, safety, and general
welfare of the neighborhood would not be adversely impacted.
Policy 1-7: Encourage the location of neighborhood commercial uses in residential areas
that are considerable distance from commercial districts and/or corridors, as a means of
reducing vehicle trip generation.
Policy 1-8: Create neighborhood identity through the development of community centers
incorporating a public facility such as a school, fire station, park, or branch library.
GOAL 2: Create a strong sense of community and place through the development of mixed
use neighborhoods.
Policy 2-1: Create a compact mixed -use development pattern with multiple street
connections.
Policy 2-2: Encourage the restoration and redevelopment of underutilized and neglected
properties through infill development.
Policy 2-3: Assemble land uses in a mixed -use fashion with homes and businesses ocated
in a condensed area.
Policy 2-4: Allow for higher density development as a means to support public
transportation.
GOAL 3: Create communities that are more livable, affordable, connectable and sustainable.
Policy
3-1: Create walkable neighborhoods with neighborhood commercial centers and good
connectivity between neighborhoods.
Policy 3-2: Maximize the use of land by encouraging high -density residential development
in areas that have adequate services that can act as a buffer between less dense residential
and commercial uses, and support public transit.
Policy 3-3: Encourage the placement of stub streets to adjacent property at or near the 118
mile section line when deemed necessary.
Policy 3-4: Encourage the placement of pedestrian bridges over a canal or drain at the 1/4
mile section line when deemed necessary.
Policy 3-5: Encourage detached sidewalks and tree -lined streets in residential estate
districts.
GOAL 4: Create communities that generate cost effective public services and infrastructure.

Policy 4-1: Encourage development as a natural outward progression of the City's corporate
boundaries and within areas that can be immediately annexed and provided with public
services.
Policy 4-2: Periodically review patterns of growth as a part of long-range planning and
renegotiate new Area of City Impact boundaries with Canyon County when growth
patterns and capital facilities plans support the need for that action.
Policy 4-3: Require developers to meet design principles, development standards, and
street and utility improvement requirements as set forth in the City's subdivision ordinance
and infrastructure policy.
Policy 4-4: Do not extend the City's public water and sewer systems to new development
located outside the municipal boundaries unless annexation can occur, the City Council
determines that a health or safety issue exists, or such extension would be in the City's best
interest.
Policy 4-5: Allow for shared parking, to include the use of street parking where appropriate
as a means to accommodate parking needs in commercial areas and high density residential
areas.
GOAL 5: Ensure the viability of agricultural operations through appropriate land use action.
Policy 5-1: Mitigate incompatibility that might arise between agricultural uses and new
development through buffering and screening strategies.
Policy 5-2: Establish land use patterns that screen or buffer agricultural use from new
development.
Comment:
The Plan relies on the land use plan and development standards of the City of
Caldwell.
The Plan contemplates development agreements and increment reimbursement
agreements that will extend the municipal boundaries of Caldwell, while also ensuring
the infrastructure necessary for the growth is paid for by that same growth.
To the extent the growth in the CNURA will abut farmland, the uses will be
commercial or industrial and not incompatible with said agricultural uses.
6. Natural Resources
GOAL 1: Preserve, protect, and enhance the City's water resources.
Policy 1-1: Implement streamside riparian buffers and setbacks to protect the natural
stream and river systems.
Policy 1-2: Meet or exceed water quality run-off standards.
Policy 1-3: Implement the City storm water management policy.
Policy 1-4: Prevent the collection and conveyance of untreated stormwater, created by new
development, into surface bodies of water by requiring developers to comply with local,
state, and federal stormwater policies. Stormwater designs must be consistent with the
National Pollution Discharge Elimination System (NPDES) permit requirements.
GOAL 2: Use watershed features as a community amenity and design elements.
Policy 2-1: Preserve, protect and restore the aesthetic, visual, recreational, and natural
values of the Boise River and Indian Creek.
Policy 2-2: Implement a system of greenways and pathways along creeks and rivers.
GOAL 3: Safeguard Caldwell's environmental features and natural resources as distinguishing
features of the community.

Policy 3-1: Coordinate land use designations with soil and topographic characteristics, the
protection of historical and natural resources, existing land uses, and the availability of
public facilities.
Policy 3-2: Encourage the protection of fish, birds, and wildlife habitats by preventing
development on property designated as "environmentally sensitive" on the Comprehensive
Plan Map.
Policy 3-3: Encourage the preservation and protection of existing wetlands, ponds, seasonal
pools, swales, greenways and open space into natural areas as they are developed.
Comment:
- The Plan relies on City Code for stormwater and runoff regulations.
- The Plan includes the creation of parks around certain abandoned gravel mines,
including any necessary remediation thereof.
7. Hazardous Areas
GOAL 1: Prevent or limit development activity in areas considered hazardous.
Policy l -1: Lessen the threat of harm to people and damage to property.
Policy 1-2: Restrict or prohibit uses which are dangerous to health, safety and property due
to water or erosion hazards.
Policy 1-3: Control the alteration of natural flood plains, stream channels and natural

The Plan contemplates building out all City infrastructure into the CNURA and
providing incentives for businesses to build their own infrastructure as they develop.

requirements of the public infrastructure within the CNURA.

GOAL 1: Provide for the efficient, safe, and cost-effective movement of people and goods.
Policy 1-1: Maximize the benefits to the public from transportation expenditures.
Policy 1-2: Seek developer participation in roadway improvement costs that are uniquely
attributable to new development.
Policy 1-3: Consider the Airport Master Plan when reviewing development proposals
within the airport overlay of the Caldwell Industrial Airport.

Allow a reduction in rights -of -way width when reviewing PUDs, and other developments
when the proposed reduction would not compromise the safe movement of traffic.

Policy 1-6: Cut -de -sacs are discouraged in situations where the road can be extended to

- Generally, the only effects the Plan will have on this Goal is that additional roadways
will be improved within the CNURA, and additional walkways will be built within
public parks.

GOAL 1: Develop and preserve parks, green belts, and recreation facilities to meet the diverse
needs of a growing community.

ANN-19-12/SUP-19-21 to be held before the Caldwell Planning & Zoning Commission on October

met. On, or before, September 29, 2019, notice was published in the Idaho Press Tribuneand on,

the site and to all property owners within 300 feet of the project site; and on, or before, October 3,
2019 notice was posted on the site.
1.2 On October 14, 2019 the Caldwell Planning & Zoning Commission recommended approval of the
annexation requite and approved the special -use permit request.
1.3 Files and exhibits relative to this application are available for review in the Planning and Zoning
Department, 621 Cleveland Boulevard, Caldwell and at applicable public hearings.
II GENERAL FACTS
2.1 APPLICANT/OWNER: Scott Kraemer, 225 S. Buttercup Court, Nampa, Idaho, 83687.
2.2 REQUEST: The applicant is requesting to annex 5.3 acres with an M-1 zoning designation so as to
operate an amusement center on the property specializing in paintball.
2.3 COMPREHENSIVE PLAN DESIGNATION: The Caldwell Comprehensive Plan Map designation for the

2.4 Transportation/Connectivity: The subject property has frontage onto Ustick Road, a principal
arterial roadway and I-84, an ITD Freeway.
2.5 Public Services. Utilities and Facilities: The engineering department, fire marshal, building
department, police department, Canyon Highway District 44, Caldwell Airport, and Pioneer
Irrigation District were all sent a request for comment on September 17, 2019.
2.6 Parking: As per Section 10-02-05 of City Code, parking should be required for this project. City Code
requires paved parking areas, including all access roads and driveways.
2.7 Street Improvements/Right-of-Way: The subject property abuts Ustick Road, a principal arterial
roadway. The applicant should be required to construct their half of Ustick Road as a principal
arterial and dedicate the required right-of-way.
2.8 Landscaping: As per Section 10-07-02(2) of City Code, landscaping should be required for this
project. City Code requires a 25-foot wide grass landscape buffer along Ustick Road. The applicant
should be required to provide 1 Class II tree for every 35 feet of linear frontage and 1 shrub for
every 7 linear feet of frontage.
III PUBLIC TESTIMONY
3.1 Before the Planning & Zoning Commission, October 14, 2019
]arom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff
report. Mr. Wagoner stated the applicant is requesting to annex 5.3 acres with an M-1 zoning
designation so as to operate an amusement center on the property specializing in paintball. Staff
is requesting a deferral agreement on curb, gutter, road upgrades as Ustick Road is currently
under construction. One additional condition is a 6-month deferral for restrooms.
Scott Kraemer, 225 S Buttercup Court, Nampa, Idaho (applicant) stated this business has been
operating for 7 years in Nampa and they have been looking for a location in Caldwell. They
currently employ youth (16 and over) to learn a good work ethic and enjoy the sport. They also
have an (unofficial) youth program. The one issue is the airport and he has met with the airport
manager and he had no concerns whatsoever. They have netting that will go up and a 70 ft buffer
zone along the interstate. Safety is their number one concern. They have never had an injury or
any property damage in 7 years. It has been an exceeding pleasure dealing with all staff at the
City.

Commissioner Nelson asked how aviation will realign after construction.
Mr. Wagoner stated he didn't believe aviation will change. The driveway will change to the East,
but he would have to confirm that with the City Engineer.
Commissioner Doty asked about the restrooms.
Mr. Kraemer stated that staff would allow them a 6-month deferral. They just want to get through
the winter and then they will construct them.
Commissioner Doty asked if that would go to a septic.
Mr. Wagoner stated yes, if there aren't city services available then they can put in a septic system.
Mr. Kraemer said he has been in contact with SWDH and there are 2 septic systems on the
property, they are waiting to hear back from SWDH.
Commissioner Hunsicker asked if there was a concern or code regarding with having the lights on
until 9pm.
Mr. Wagoner stated there is not any code and staff does not have any concerns.
Mr. Kramer stated that in his letter he stated that all lighting will be facing downward.
Mr. Camden Harwood, 1210 Virginia Circle, Nampa, Idaho (in favor) stated he has worked with
Scott for the past 2 1h years and he has learned a lot in that time. He has learned leadership skills,
he has learned to step up when needed, he understands customers and how to help them, and he
has learned a great work ethic. He has also learned how to save money and budget for college. He
has also found the right balance with work, school, hobbies, family and friends. The environment
is like a family.
Mr. Gavin Peterson, 3564 S. Bo Daniel Place, Nampa, Idaho (in favor) stated that he thinks this
business is important because it provides an opportunity to work hard. As a referee his goal is
safety and for everyone to have a good time. It is a very positive and lovely influence. It's a great
place to have parties. Many different groups come; military, youth and church groups. It has
become an amazing experience and something to look forward to. He has learned how to work
hard and put forward his best self. He feels like he has gained a lot of responsibility.

VII CONCLUSIONS OF LAW - ANNEXATION
7.1 The Caldwell Planning & Zoning Commission has the authority to hear this case and recommend to
the Mayor and City Council that it be approved or denied. The public notice requirements were met
and the hearing was conducted within the guidelines of applicable Idaho Code and City ordinances.
VIII RECOMMENDATION - ANNEXATION
8.1 Based on the Findings of Fact and Conclusions of Law, the Caldwell Planning & Zoning Commission
hereby recommends to the Mayor and City Council that Case Number ANN-19-12 a request by Scott
Kraemer to annex 5.3 acres, more or less, with an M-1 (Light Industrial) zoning designation with an
Annexation Agreement for the property located at 11809 Ustick Road (Parcel R3093400000), in
Caldwell, Idaho is approved with the following conditions of approval:

submittal of any applications shall be adhered to in development of the subject property.
1X COMPREHENSIVE PLAN ANALYSIS - SPECIAL -USE PERMIT
The Caldwell Planning & Zoning Commission accepts the Comprehensive Plan Components as listed
below.

Goal 1.- Establish land -use management policies that protect property rights and the
environment, maintain a high quality of life, provide adequate land for all types of
development, and adequately buffer non -compatible uses.
Policy 1-1: Guide the growth and development of land uses in such a way that the health, safety,
and general welfare of residents will be protected.
9.2 The request was not found to be inconsistent with any of Comprehensive Plan Components.
All adopted city ordinances, standards and codes were used in evaluating the application.
X FINDINGS OF FACT - SPECIAL -USE PERMIT
10.1 The Caldwell Planning & Zoning Commission accepts the facts outlined in the staff report, public
testimony and the evidence list. All adopted city ordinances, standards and codes were used in
evaluating the application. The proposed use is conditionally permitted by the terms of the
ordinance and is subject to conditions of approval.
XI CONCLUSIONS OF LAW - SPECIAL USE PERMIT
11.1 The Caldwell Planning & Zoning Commission has the authority to hear this case and order that it be
approved or denied. The public notice requirements were met and the hearing was conducted
within the guidelines of applicable Idaho Code and City ordinances.
XII ORDER OF DECISION - SPECIAL USE PERMIT
12.1 Based on the Findings of Fact and Conclusions of Law, the Caldwell Planning & Zoning Commission
hereby orders that Case Number SUP-19-21 a request by Scott Kraemer to operate an Amusement
Center within the proposed M-1 (Light Industrial) zoning district for the property located at 11809
Ustick Road (Parcel R3093400000), in Caldwell, Idaho, is approved with the following conditions
of approval:
12.2 Comply with the all applicable city codes, ordinances, policies, and standards.
12.3 Dedicate as public right-of-way a minimum forty-eight (48) foot half width right-of-way (from
centerline) along the entire Ustick Road alignment (per City Standard R-810 A).
12.4 Enter into a deferral agreement for the completion of the Ustick Road street section including, but
not limited to, curb, gutter, sidewalk, asphalt paving, street lighting & storm drainage
improvements. The applicant shall work directly with the City Engineering Department in regards
to this condition and shall comply with this condition within 90 days of the signing of the Order of
Decision for Case File No. SUP-19-21.
12.5 Install a minimum 25-foot wide landscape buffer along Ustick Road, abutting the site. The buffer
shall contain a minimum of 1 Class I1 tree for every 35 feet of frontage and 1 shrub for every 7 feet
of frontage, along with sod turf grass ground cover as required by City Code Chapter 10-07. The

applicant shall have 12 months from the signing of the Order of Decision to complete this
condition.
12.6 Install a minimum 30-foot wide landscape buffer along 1-84, abutting the site. The buffer shall
contain a minimum of 1 Class II tree for every 35 feet of frontage and 1 shrub for every 7 feet of
frontage, along with sod turf grass ground cover as required by City Code Chapter 10-07. The
applicant shall have 6 months from the signing of the Order of Decision to complete this condition.
12.7 Provide a minimum of 15 paved parking spaces. All required parking areas, including but not
limited to the parking spaces, access roads, ingress and egress, and travel lanes shall be paved and
meet City of Caldwell Landscape Ordinance requirements. This condition shall be completed within
12 months of the signing of the Order of Decision.
12.8 Final approval shall be contingent upon the City Council approving the requested annexation, ANN-
19-12. If that annexation is not approved, the requested SUP-19-21 shall be null and void.
12.9 Comply with the requirements of the City Engineering Department as listed in Case File Exhibit PA-
1. The City Engineer has the discretion to reduce or eliminate certain requirements stated in
Exhibit PA-1 that he finds to not be pertinent to the request.
12.10 Install a minimum of 2 permanent restrooms that complies with all building code requirements,
within 6 months of the signing of the Order of Decision.
Case Number ANN-19-12 & SUP-19-21 was heard by the Caldwell Planning & Zoning Commission at a
public hearing held October 14, 2019.
The Findings of Fact, Conclusions of Law, Recommendation, and Order of Decision were administratively
approved and signed by the Planning & Zoning Chairman on the date noted below.
