The Engineering Department does not oppose a request by Jacksons Food Stores Inc. to annex
approximately 6.70 more or less, with an H-C (Highway Corridor) zoning designation and
development agreement. The subject property is located at 20078 Middleton Rd.
Rights -of -Way
1. Hwy 20/26. is classified as a Principal Arterial. Existing right -of- way along the subject
properties Hwy 20126 frontage equals fifty (50) feet. The applicant shall dedicate an additional
twenty (20) feet along the subject properties entire Hwy 20126 frontage to meet current city
requirements. Additionally, the applicant is required to meet any additional right-of-way
requirements of the Idaho Transportation Department.
2. Middleton Road is classified as a Principal Arterial. Existing right-of-way along the subject
properties Middleton Road frontage equals thirty-three (33) feet. The applicant shall dedicate
and additional fifteen (15) feet of right-of-way along the subject properties entire Middleton
Road frontage to meet current City requirements. Additionally, the applicant is required to meet
any additional right-of-way requirements of the Canyon Highway District #4.
Street
1. No street widening improvements will be required along Highway 20126 except for potential
improvements on the immediate corner to tie into Middleton Road.
2. Future development shall require the applicant to improve Middleton road along the proposed
site's west frontage. This will include (but is not limited to) street lights, signage, curb, gutter,
sidewalk, and asphalt to meet a section width of thirty-five (35) feet from top back of curb to
centerline.
Traffic Mitigation
The following are the required traffic related mitigation measures for the Jacksons Food
Store resulting from the traffic impact study dated Dec 19'h, 2014 by 6 Mile Engineering
pursuant to City Code Chapter 10, Article 10 and analysis provided by the City.
1. Jacksons is expected to generate 1,953 trips per day and 72 new trips in the critical (P.M.)
peak hour. Community Planning Association of Southwest Idaho has computed the average
trip length in Canyon County to be 7.3 mi. Traffic impact mitigation should presumably occur

at both trip ends so'/z of the trip length should be attributed to each end. It is estimated that
trips will encounter a major intersection every half mile along any given path. The capacity of
an average fully improved intersection (assumed to be the intersection of a collector and an
arterial road) is estimated to be 5,080 vehicles/hour. The total traffic mitigation required by
Jackson's is determined to be 10.3% (72 new PM Peak * 7.3 miles/trip * 0.5 trip ends * 2
trips 15080 vehicleslhr) of a typical intersection (or the value of a typical intersection).
a) The owner/developer/applicant shall design and construct roughly 10.3% of the
signalization improvements needed for an average intersection, as defined, at one or
more nearby (within 3.5 miles of the site) deficient locations to be determined by
Engineering staff. The Engineering staff shall have reasonable discretion to determine
the sites of construction and what design and construction equals roughly 10.3% of the
signalization improvements needed for an average intersection. Engineering staff can
provide information about applications with whose mitigation efforts the
owner/developer/applicant can combine to achieve even units of 100%.
i) The owner/developer/applicant may be allowed, at his option, to contribute monies in
lieu of construction to the City of Caldwell Roadway Trust Fund, but the basis for the
obligation is for construction. Monetary contributions must be made at a level
commensurate with costs to construct the same by the City and as estimated by the
City. This alternate provision for payment of money is not a requirement, is for the
benefit and convenience of the own erldeveloperlapplicant only and does not
constitute an Impact Fee.
ii) Improvements needed at and near the intersection of US 20126 and Middleton Rd
may be considered in lieu of some part or all traffic mitigation requirements.
Measures that may qualify for this purpose include:
(1) Added right-of-way and widening to accommodate turn lanes above and beyond
what is required for access directly to this development (per City review).
(a) Right-of-way provided for this purpose should be credited toward signal
mitigation at raw land value.
(b) Added Asphalt above the minimum required shall be credited based on actual
cost or contract bid.
iii) The average cost of a typical intersection is estimated at $425,000 for procurement
of design services, construction, and associated costs by the City, of which 10.3%
of that cost is what Jackson's contribution shall be.
3. The owner/developer/applicant shall keep the City informed of and comply with any
additional requirements Idaho Transportation Department has the final authority to impose.
Requirements of ITD shall be met independent of requirements of the City. ITD standards
shall be followed for roadway section depth on Highway 20126. The more strict of City or
State requirements shall be followed for roadway width and traffic mitigation measures on
Highway 20126.
4. Install the following improvements as per the Traffic Impact Study:
a) A dedicated westbound right turn lane on Hwy 20126 at the access point on Hwy 20126.
b) A dedicated eastbound left turn lane on Hwy 20126 at the access point on Hwy 20126.
c) A dedicated northbound right turn lane on Middleton Rd at the access point on Middleton
Rd.

d) Restriping of existing left hand turn lanes on Hwy 20126 and Middleton Rd to extend the
storage length (as specified in the Traffic Impact Study).
i) The foregoing improvements shall be designed to accommodate heavy vehicles as
well as passenger car traffic to minimize delay to development patrons and other
passenger car traffic.
ii) Dedicated turn lanes shall meet all current standards for length and taper.
Water
1. Water is available from an existing 12" line at Colville Court and Hwy 20126. Future
development shall require the applicant to extend these services east along Hwy 20126 in a
twelve (12) inch mainline to the subject property and meet any requirements established by the
City's water master plan. This mainline shall be extended to and through the site, meaning, it
shall be extended along the entire frontages of the property on both Middleton and Hwy 20126.
Sewer
1. The subject property is intended to be served from a twenty-four (24) inch mainline per the
Franklin Sewer Study 2005 updates. Currently that trunk line extends to the intersection of Hwy
20126 and KCID Road. The City has agreed to allow an interim commercial septic system to
facilitate immediate development of the subject parcel. The applicant shall agree to connect to
said trunk line and abandon the interim septic system at the time said trunk line has been
extended to the subject property. The applicant shall agree to pay any re-imbursement fees
associated with said trunk line extension. Additionally, the applicant shall agree to construct the
designated portion of said trunk line extending along the entire subject property's Hwy 20126
frontage as part of this project. All sewer connection fees shall be paid once City Sewer is
connected to the proposed site and the site is served by the City.
Storm Drain
1. Future development shall require the disposal of stormwater drainage in accordance with the
City Stormwater Management Manual including any subsequent updates. All flood way and
flood plain issues must be in compliance with City and FEMA standards and requirements.
Irriaation
1. Irrigation water for any and all landscaping shall be obtained from applicable Irrigation
District sources. City municipal water may be used only if the criteria specified in the
Landscape Ordinance Section 10-07-12 are met.
General
1. Prior to commencement of construction in any dedicated right-of-way, the City Engineer staff
is to be notified. Appropriate City personnel are to be notified in advance for all required
inspections.

2. The applicant shall maintain the site in keeping with the City's nuisance abatement program.
The maintenance will include the semi-annual mowing of all weeds within the parcel
boundaries and the removal of noxious weeds when they are identified.
3. The applicant shall develop the site in keeping with provisions of all applicable City
Ordinances and Policies.

Transportation Improvement Projects (TIP)
Comments: ITD is designing reconstruction, realignment, and widening of US
20/26 from Smeed Parkway to Middleton Road in Caldwell, construction is
considered "unfunded" at this time.
ITD plans to add right turn lanes and paved shoulder to three intersections along
the US 20/26 corridor (Midland, Northside, and Can -Ada) in FY2020.
Access Management
Comments: U.S. 20/26 is one of the few east -west roadways in the Treasure
Valley that runs from Caldwell to Boise and is identified as an Expressway in the
2040 Functional Classification map. The applicant is requesting a temporary full
access on US 20/26 and a full access on Middleton Road.
The Idaho Transportation Department (ITD) is in the final stages of the
environmental assessment for U.S. 20/26 from Eagle Road west to I-84 to include
recommended roadway improvements and to identify right-of-way needs between
now and 2040. The planning process is expected to be completed by the end of
2016. Additional information is available on the ITD website at:

The Idaho Transportation Department (ITD) has reviewed the referenced annexation application for the
Jackson's Food Store located at 20078 Middleton Road north of US-20126. ITD has the following
comments:
1. ITD has no objection to this application and does not require any mitigation.
2. Applicant must apply for and receive an approved Right -of -Way use permit prior to doing any
work or activity within the highway Right -of -Way. Please have the applicant contact Shona
Tonkin at 334-8341 for this permit.
3. The applicant is requesting a temporary access to US-20/26 at approximately 828 feet center to
center upstream from a signalized intersection. IDAPA 39.03.42 rules for an Urban State Route
over 35 mph upstream from a public road intersection is 790 feet. It appears this access would
meet current IDAPA 39.03.42 rules.
4. ITD's corridor plan requires a minimum of 70-ft of right-of-way as measured from the section
line in US-20.26. The supplied plat drawing appears to show the existing 50-ft of right-of-way
plus an additional 20-ft for a future right-of-way acquisition. This plat appears to meet ITD
minimum right-of-way requirements.
5. Future plans for the US-20i26;'Middleton Road intersection are for a half Continuous Flow
Intersection (CFI) to be constructed.
6. No trees are allowed within the clear zone of the ITD Right -of -Way. Only planting of forage,
plants, grasses, flowers, and shrubs with a mature height not to exceed 3 feet will be allowed.
7. No rocks over 4 inches maximum size will be allowed in the ITD Right -of -Way.
8. Section 49-221 of the Idaho Code restricts the placement of any hedge, shrubbery, fence, wall, or
other sight obstructions of any nature where they constitute a traffic hazard at the intersection of
roads with other roads, private alleys, bike or pedestrian paths when they are within the "vision
triangle" of vehicle operators. The boundaries of the "vision triangle" are defined as follows:
a. By extending perpendicular lines along the face of curb from their point of intersection 40
feet in either direction; and

9. Irrigation systems shall be no closer than 5 feet from the pavement edge and shall be adjusted so as
not to cause water to cover any portion of the highway pavement.
10. Provisions shall be established for the responsibility of future maintenance of any landscaping within
ITD Right -of -Way.
11. Idaho Code 40-1910 does not allow advertising with the right-of-way of any State highway system.
12. IDAPA 39.03.60 rules govern advertising along the State highway system.

TO WHOM IT MAY CONCERN:
Please be advised that an irrigation water delivery point exists for the property being proposed
for development. Pioneer Irrigation District's main concern is that all water rights within the
District are honored, and that access to irrigation water be provided to every parcel of land. The
delivery point for the subject property is headgate 12 — 100 Lateral.
All irrigation water distribution and drainage facilities, together with their corresponding
easements and rights -of -way, must be protected and retained. It is imperative that no one disrupt
the delivery and or drainage of irrigation water to from Pioneer patrons.
Pioneer Irrigation District's water rights are specific in the method in which the water is used;
the water rights are for irrigation use only. The water may not be used for any other application
including but not limited to industrial uses and watering livestock.
The easements and rights -of -way of all laterals, canals, drains and other facilities used to deliver
or drain irrigation water, must be kept clear of all encroachments and obstructions at all times.
No fences, structures, or other encroachments are allowed on any of the District's easements or
rights -of -way. Further, all irrigation easements and rights -of -way must be recorded on the
final plat.
There are to be no encroachments within Pioneer Irrigation District easements unless
specifically authorized by the District in writinp, as determined on a case -by -case basis.
A Land Use.. Encroachment Application (copy attached) must be completed and submitted to
Pioneer Irrigation District prior to engineering review or the drafting of any agreements

permitting the reconfiguration, relocation, or modification of, encroachment upon Pioneer
Irrigation District facilities or their corresponding easements and rights -of -way.
Please be advised that NO change to.�or crossing of a District facility can take place unless a
License or Crossing Agreement between the District and the ownerideveloper of the property has
been signed and recorded.
Pioneer Irrigation District will recommend disapproval of the final plat approval, until the
pertinent agreement has been executed and recorded. If construction begins without the required
agreement, Pioneer Irrigation District will seek judicial relief to stop the construction.
Pioneer Irrigation District requests that plans be received by November 15"', 2015. All
construction which may impact District facilities must be completed prior to the March 1",
2016 deadline. The construction time -frame which Pioneer Irrigation District allows is
November 1"' of the current year to March 1" of the following year.
Any proposed development upstream of water users dependent upon gravity flow -based
irrigation methods must be designed in a manner that protects and maintains the existing
downstream irrigation facilities and methods. All Proposed pressurized irrigation systems must
be separate from the existing gravity flow based irrigation system to the extent possible (with the
exceptions of diversion intake structures and return flow/bypass structures).
Please be advised the developer shall submit detailed engineering drawings of any proposed
relocations or modifications of Pioneer Irrigation District facilities, prior to preliminary plat
approval. All facility relocations or modifications are subject to the prior approval of the
Superintendent and/or the Board of Directors of Pioneer Irrigation District.
If construction is not completed by March 1" in a manner which allows for adequate delivery of
water, Pioneer shall perform or cause whatever work is necessary to allow adequate delivery of
water to patrons. This work will be performed at the convenience and discretion of Pioneer
Irrigation District. The developerilandowner shall pay the costs of this remedial work.
Any encroachment upon, or discharge of water into, a federal drain must meet the prior written
approval of Lupe Rodriguez of the Bureau of Reclamation. Pioneer Irrigation District does not
assume any responsibility for such an approval. Her telephone number is 383-2221. As with
Pioneer Irrigation District facilities, there shall be no encroachments or obstructions constructed
or placed within the federal facility rights -of -way absent the prior written permission of the
Bureau of Reclamation. The Mason Creek Drain has a 110 foot federal right of way, 55 feet
from centerline of drain.
Any construction impacting Waters of the United States may require a Clean Water Act Section
404 permit from the United States Army Corps of Engineers. Greg Martinez of the Army Corps
of Engineers can be contacted at 345-2154.
Prior to finalization of any agreements with Pioneer Irrigation District, Pioneer must receive a
copy of a Section 404 permit that has been properly executed. If the Army Corps of Engineers

determine that a Section 404 permit is not necessary for the proposed project, Pioneer Irrigation
District must be notified in writing by the Army Corps of Engineers that the Section 404 permit
is not required.
NOTE: This letter does not authorize any construction to commence until all the necessary
agreements with Pioneer Irrigation District have been executed and recorded.
