Box 8028 (208) 334-8300 Boise, ID 83707-2028 y itd.idaho.gov 9 2 s w 914TION pq March 29, 2018 VIA EMAIL Jarom Wagoner City of Caldwell Planning and Zoning Division 621 Cleveland Boulevard Caldwell, ID 83605 RE: VAR-18-01412 WEST SIMPLOT BOULEVARD The Idaho Transportation Department (ITD) has reviewed the variance application by Earl Priest for a variance to reduce the minimum front setback within M-1 (Light Industrial) zone from 20 feet to no less than 10 feet on a parcel located at 412 West Simplot Boulevard, north of SH-19 milepost 19.58. ITD has the following comments: 1. This project abuts the State highway system. 2. ITD Right of Way width in this location is 44.96 feet. 3. Per the Idaho Administrative Proceedures Act (IDAPA) 39.03.42 (8a.): "Improvements intended to serve patrons on private property adjacent to state highway right-of-way shall be setback from the highway right-of-way line so that stopping, standing, parking or maneuvering of vehicles on the right of way is not necessary. A minimum setback of fourteen (14) feet from state highway right-of-way line is recommended, unless a greater minimum is established by an engineering study. When an ordinance requires a certain number of parking spaces per square footage of building, the parking spaces shall not be included within the State Highway right-of-way." 4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway. 5. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant can contact Justin Pond, Program Manager for ITD's Headquarters Right -of -Way Section at (208) 334-8832 for more information. 6. ITD objects to the variance application as it proposes a setback smaller than IDAPA requires. If you have any questions, you may contact Tyson McCoy at (208)334-8335or me at 332-7190.
