ORDINANCE NO. 3494
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-3 (HIGH DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, following the public notice and hearing procedures set forth in
Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN23-000007 (Lavender Crossing
Annexation) at a public hearing held May 16, 2023.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-3 (High Density
Residential):
A parcel of land being a portion of the N % SW % of Section 1, Township 3 North, Range 3 West, Boise
Meridian, Canyon County, Idaho being more particularly described as follows:
COMMENCING at the '/. Corner common to Sections 1 and 2, T3N, R3W, from which the center -west 1/16
Corner of said Section 1 bears N89000'15"E, 1319.88 feet; thence N89000'15"E, 1239.05 feet along the
mid -section line and centerline of Laster Lane to the POINT OF BEGINNING; thence continuing
N89000'15"E, 50.10 feet; thence S63°28'16"E, 42.66 feet; thence S73°33'54"E, 43.97 feet; thence
S62054'54"E, 48.60 feet; thence S33056'54"E, 249.87 feet; thence S25015'47"E, 215.55 feet; thence
N63°22'10"E, 106.31 feet; thence N89008'49"E, 99.33 feet; thence S73'26'55"E, 46.96 feet; thence
S61 °25'41"E, 56.80 feet; thence S54°11'53"E, 62.77 feet; thence S47`02'45"E, 72.14 feet; thence

S89012'20"W, 919.59 feet along the 1/16 line to a point on the easterly line of Weston Pointe Subdivision
No. 2, Book 35 of Plats at Page 26, records of Canyon County, Idaho; thence N07°21'47"W, 192.88 feet
along said line; thence N14022'48"W, 449.82 feet along said line; thence N01008'18"W, 100.01 feet along
said line; thence N22°44'07"E, 135.93 feet along said line and its extension; thence N27025'38"W, 277.94
feet; thence N34°46'13"W, 166.98 feet; thence N62035'01"W, 184.83 feet to the POINT OF BEGINNING.
Parcel contains 14.027 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-3 (High Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 16th day of May, 2023.
