We do not have any objection to the proposed annexation and, in fact, support the City's effort to eliminate the confusion caused by the irregular city limits. District Engineer District 3 - An Equal Opportunity Employer - pQ , � City of Caldwell COMMUNITY DEVELOPMENT DEPARTMENT Land Use and Zoning Services STEVE HASSON Community Development Director August 20, 2004 Jeff Hebert, member Creekside Estates MHC L.L.0 228 East Plaza Suite H Eagle, Idaho 83616 Dear Jeff: This letter is in response to your letter received concerning the 36-space mobile home park known as Creekside Estates and how that property may be affected if it were included in an airport overlay zone and particularly a subset of that zone, known as the APO-1 zone: As you are aware, the City of Caldwell is contemplating the creation of an airport zone to preserve and protect the airport's trade and commerce potential as well as its long-term viability. Along with its creation, the airport overlay zone would curtail residential development within proximity of the airport. The need to protect the airport is heightened by the fact that many years ago the City had to reestablish the airport to its present location because the former site had not been safeguarded against development intrusion, to the extent, that it was rendered defunct for that purpose. The cost to relocate and redevelop an airport is enormous (about 20 million dollars in 2004 dollars). It is this concern about the possibility of having to move the airport a third time if we do not preserve its mission that becomes the overriding impetus for this action. The Creekside Estates MHP is located within an area of the airport overlay known as the APO-1 zone. This zone will exclude the development of residential units including: multiple family units, dormitories, congregate residences, apartment houses, hospitals, schools, and other noise sensitive uses from its confines. Accordingly, when and if this zone is constructed, to include the Creekside Estates MHP, that action would preclude you and your partners from further developing the park, beyond its present 36 space capacities. The park would also assume a land use term known as non -conforming. This designation means that the terms and conditions of the land use application that resulted in the permitting of the park would continue to be respected, but that further land use development activities there would be limited. BOX 1177 • CALDWELL, ID 83605 • (208) 455-3021 - (FAX) (208) 455-3050 Thus, if you were approved for 36- mobile home spaces at Creekside then you would be able to continue the park operation at that level but not increase its residential capacity. A land use that is designated non -conforming may not be expanded or enlarged unless it becomes conforming. Because this zoning designation does not contemplate the introduction of new residential uses within its boundaries, your further development of this property would necessitate you seeking a land use that was compatible with those allowed in this zone. I think it is important to define the limitations inherent in the prohibition of expanding or enlarging a non -conforming use so that you know what land activities you may engage in without concern that you trigger the need to make the land conforming with the provisions of the new zone. My view is that if your property is included in the APO-1 zone you will be able to continue moving mobile homes in and out of this park as long the as the number installed there does not exceed the number of pads that you are approved for. If your park is designed so that a space may accept either a single wide or a double wide of any length then you may continue that practice. You may also make for any normal operation and maintenance repairs necessary to sustain the viability of your operation. In other words you are afforded the opportunity maintain the park's status quo. Your property is located on the periphery of the proposed APO-1 airport overlay zone so there is a possibly that you could request its removal from that zone as part of the public hearing process or alternatively, ask that it be included in the less restrictive APO-2 zone that allows for residential uses. The less restrictive APO-2 zone requires that residential development be constructed with certain noise abatement features; however, I do not believe these abatement prescriptions apply to mobile homes. I would encourage you to attend the public hearings associated with the creation of this zone. Please call Jackie Hernandez at 455-3021 to learn where and when these meetings will be held. Creekside Estates MHP is a 36 space park located at 2903 East Chicago. Within the last couple of weeks, I have heard that the City of Caldwell is in the process of drafting a "Caldwell Airport Overlay Zone" ordinance which could affect the zoning and/or operation of Creekside Estates Manufactured Home park. Please advise me on how the adoption of this ordinance could affect the future operation of Creekside Estates MHP; under what parameters I can maintain it's current operation and what steps can I take to prevent this ordinance from having any negative impact on the Park's operations or value.
