Any development of this property shall be consistent with the conditions established in the aforementioned Development Agreement. 3. The City municipal water system is located in Aviation Way and is capable of providing service to the area. The closest available sewer facilities are located at the intersedion of Linden St. and Aviation Way. Aviation Way is designated as a Collector Street. As specific development proposals within the proposed annexation area are presented, the City will review right-of-way requirements as outlined in the City code along with other issues pertaining to development. 5. The City of Caldwell lnfrastructure lmprovement Policy requires new development to construct street improvements, including curb, gutter, sidewalk, and street widening. 6. Development Plans - Prior to any proposed use or commencing any construction, plans must be prepared by the developeds engineer and approved by the City Engineering Department which include the following items: a. Street sedion (including curb and gutter)b. Sidewalk ($foot width);c. Connection to the City water system;d. Stormwater facilities (per City Policy);e. lnigation system (per Pioneer lnigation District requirements). 7. The developer is to employ a responsible design professional, preferably the engineer of record, to oversee and inspect construction, to perform and/or observe all requisite testing of completed facilities, and to certify that improvements have been constructed according to approved plans and in compliance with applicable City, State, and Federalstandards. 8. Prior to commencement of construction in any dedicated right-of-way, the City Engineering Department shall be notifled and a "Permit To Use Right-of-Way' shall be obtained. Notification preferably will take place in a pre-construclion conference scheduled by the engineer of record in which all appropriate personnel and utilities are present. Appropriate City personnel are to be notified in advance of all required inspections. 9. As noted previously, provision is to be made for the disposal of stormwater drainage in accordance with the City Stormwater Management Policy. A copy of this policy is available upon request. The developer's engineer is to provide calculations, which indicate that the assumptions in his stormwater drainage ptan comply with the requirements of the stormwater policy. 4 Page 1 of2 ttr ?, o o 10. lnigation water for any and all landscaping shall be obtained from Pioneer lnigation District sources. 11. Appropriately licensed public works contractors shall perform all construction within rights-of-way. The City municipal water system is located in Aviation Way and is capable of providing service to the area. The closest existing sewer facilities are located on the North side of the Canyon Hill Lateral Canal in Aviation Way. 2. Aviation Way is currently designated as a Collector street, which requires a minimum of 60 feet of right-of-way. 3. Aviation Way is currently under design for widening of existing asphalt pavement and paving of areas that are cunently unopened or gravel with the intent on having Aviation Way opened from U.S. Hwy 20126 to Linden Street. As part of the design and for the safety of the driving public, this specific property is targeted for acquisition. 4. The development area is within 2,620 ft. of the Northwest end of an existing Airport runway. The Airport Master Plan includes the extension of the existing runway to the Northwest and the servicing of larger aircraft than presently use the Airport. This means that the proposed annexation site is in the low-level glide path of the runway. The fly-in and fly-out rotations track over the site and aircraft elevations are not high enough to substantially attenuate the noise effects from these aircraft. Portions of the property lie within the future Runway Protection Zone, which does not permit the building of any structures within the zone. Additionally, the approach surface (precision or non-precision) will restrict the height of structures outside of the protection zone. 5. The location of this property relative to the existing and planned runways restricts its ability to develop very much beyond its present condition. Because of this, the Airport Master Plan has designated this parcelfor acquisition in accordance with standard Federal procedures. Page 1 of 1 qF.,
