COURSE OF PROCEEDINGS
on August 1, 2006, the Caldwelt Community Development Department received the final platapplication on Case No. SUB-1 14(2)F-04.
Files and exhibits relative to this application will be available for review in the CommunityDevelopment Department, cardwell city Hall, as well as all public hearings.

LOCATION: The site is on the south side of Homedale Road approximately % milewest of theintersection of Homedale Road and Lake Ave.
REaUEST: T he Applicant requests f inal subdivision plat approval for Windsor Creek #2Subdivision to develop one hundred twenty (120) residential and eight (8) common lots. Thesubdivision is located in an R-1 (single-Family Residential) zone.

2.4 BACKGROUND: Windsor Creek #2 Subdivision received preliminary plat approval from the
City Council in April 21,2005.
2.5 PUBLIC FACILITIES:
2.5.1 PUBLIC SERVICES. UTILITIES. AND FACILITIES: The Engineering Department has reviewed
the proposed f inal plat for Windsor Creek Subdivision No. 2 and provides the following
comments regarding the project and the submitted final plat:
1. The water system is not operational. The water system has been constructed; pressure
tests have been submitted and approved. But no clean water samples have been received.
2. All weather surfaces are in place. Compaction test results for the roadways have been
submitted to the City for review and approved.
3. Street signs have been installed
4. Sewer system is operational. The line has been constructed, pressure tests have been
approved, and video has been received.
5. Construction security will have to be provided for those items not yet completed prior to
signing of the final plat. The city has not agreed on a bond amount for those
improvements not yet constructed.
6. The final plat drawing shall be corrected in accordance with the marked-up copy done
October 30, 2006 and mailed to Mason & Stanfield lnc. on October 30, 2006.
ln an effort to expedite the addressing process of the final plat the City requests that two
electronic copies on 2 separate CD's, in AutoCAD format be returned with the revised copy of
the final plat.
2.5.2 FIRE DEPARTMENT: On August 8, 2006, the Caldwell Fire Department was notified of this
request. No comments were received.
2.5.3 PIONEER IRRIGATION: On August 8, 2006, Pioneer lrrigation was notified of this request.
Comments received were:
The Lowline canal is a Pioneer lrrigation District facility and has a 16 foot from top of bank
prescriptive use easement on both sides. There is to be no obstructions within said easement.
This must be recorded on the final plat. The Wilson Drain Feeder is a Bureau of Reclamation
facility which has a 110 foot federal right of way, 55 feet from centerline of drain on each side.
There is to be no obstructions within said right of way. Said right of way must be recorded on
the final plat. The Wilson Feeder is a Pioneer irrigation District and Black Canyon lnigation
District facility. The Wilson feeder has 1 10 foot right of way, 55 feet from centerline of feeder
on each side. All lrrigation District easement must be maintained with no obstructions within
said right of way and must be recorded on the final plat. Note: This letter does not authorize
any construction to commence until all the necessary agreements with Pioneer irrigation
District have been executed and recorded.
2.6 CONSTRUCTION COMPLETION/FINANCIAL GUARANTEE: Subdivision Ordinance No.
2558 states that "the form of financial guarantee shall be submitted to the City Engineer within
thirty (30) days following the date of final plat approval by the City Council or approval of the
final plat may be null and void. At the discretion of the City Council, a thirty (30) day extension
may be granted. Upon submittal of the approved financial guarantee to the City Engineer, the

final plat, with all applicable signatures shall be released to the subdivider for recordation".
(Section 1 1-02-06(1 )c).
2.6.1 By the time the 30-day time period for the financial guarantee to be in place arrives, the
estimate of costs for remaining construction will normally be substantially reduced from the
time the City Council first hears the final plat approval request. This allows the developer to
continue to work toward completing construction of the improvements concurrently with the
approval process.
2.6.2 As noted above, there remains some finish work on the development at the time this report
was written. The correct course of action may be approval conditioned with a recommendation
for financial security to cover the remaining work. lt is anticipated that this information will be
forthcoming the night of the hearing before Council. The Applicant is currently working with the
Engineering Department and should soon have an agreed upon solution for City Council's
review.
2.6.3 All requirements placed on the preliminary plat by City Departments and any other
agencies having approval authority shall be met prior to submitting a request for final plat
approval, or a financial guarantee for completion of work shall be submitted in compliance with
Section 11-02-04, Subsection 7, Subdivision Ordinance No. 2558.
III APPLICABLE LEGAL STANDARDS
IV STAFF COMMENTS
4.1 Applicant has or will meet the standards as set forth by the Engineering Department.
4.2 A financial guarantee amount has not been established with the City Engineering Department.
4.3 Applicant will meet the standards as set forth by the City Landscape Ordinance.
4.4 The current final plat is consistent with the preliminary plat.
4.5 The Applicant shall meet any requirements set forth by applicable irrigation and drainage
districts.
