Dear Deb,
Our team is pleased to submit the above-referenced Development Agreement Amendment Narrative as part of the
Hearing Review Application package. We are requesting a development agreement modification for our project
Caldwell 23 (CMP 20-02/ZON-20-03/DA 20-02), which was originally recorded on 11/18/2020 at the Canyon
County Recorder’s Office. This request for modification is being made based on the three (3) Roundtable
Meetings held on 12/9/21, 12/22/21 and 1/7/22 and that were held with City of Caldwell representatives.
Narrative Description of the Request
1. Specific item/requirement being appealed
Caldwell 23 (CMP 20-02/ZON-20-03/DA 20-02) page 9 – Refer to attached Exhibit A for modifications
Article II – 2.3 PLANNING – 1. Standards and Amenities Requirements:
d. 4% minimum open space. 10% minimum qualifying open space
m. Platting is required prior to construction of the multi-family component of the development. If required,
platting requirements shall be in conformance to Caldwell city code.
2. Reasons for the appeal/amendment
Article II – 2.3 PLANNING – 1. Standards and Amenities Requirements:
d. Clarification issued by City of Caldwell Planning and Zoning.
m. City of Caldwell Planning and Zoning clarified that platting was not required based on developer’s intent
for phasing and division of parcels as explained and discussed during the Roundtable Meetings.
3. Site-specific limitations and/or impediments on the property
None identified at this time.
