In follow-up to the Board of Directors meeting you attended on 7I8104, the options
discussed for the Wood Springs subdivision irrigation system, outstanding punchlist
items and easement issues are outlined below:
1. You will fix all of the easement encroachment issues by moving/removing
structures erected within easement boundaries. This includes not only the
fence we discussed, but foundations, patios, etc. located too close to
irrigation supply lines, as well as ensuring proper clearance of 16' around the
pump station building.
2. You may approach the City of Caldwell about taking over maintenance of the
system/pump station.
3. You may have residents of the subdivision form a homeowner's association to
take over maintenance of the system/pump station.
As stated in the meeting, Pioneer will not take over maintenance of the system as it
stands today. Please advise us of your decision as soon as one is made. If you should
have any questions, please don't hesitate to call.

Please be advised that there are some very important issues that must be addressed prior
to final plat approval.
Please refer to letters dated April 30, and May 30, 2003 from Earl. Masan and Stanfv;ld,
recommending plan approval of inner pressure irrigadoln lines and pump station There
has not been any construction to observe as to date.
Please refer to a letter dated July 2, 2003 from Moffatt, Thomas, Barrett, Rock & fields
This is a rough draft to the Construction, Operation and Maintenance agreement that'"
sent to Mr. Rich Pickett, of Silverhawk Development. In addition to the previous letter,
an additional letter was sent by Moffatt, Thomas, Barrett, Rack a Fields pertaining to the
same matter on July 28, 2003. There has not been a signed and recorded copy of laic.

After review of the revised improvement plans for the above -mentioned project, Earl, Mason, &
Stanfield, Inc. believes the design engineer has addressed the items of concern we originally
addressed. The design engineer however, should review the location of the pressure irrigation main
along the Parker Gulch Drain. It appears it maybe designed within thn Drain easement_ If ttie
pressure main is within the Parker Gulch Drain easement plans may need to be redesigned.
If the District has no additional concerns Earl, Mason, & Stanfield, Inc. recommends approviil of
The construction plans.
Earl, Mason, & Stanfield, Inc. shall be notified of the date and time of the pre -construction
meeting. Earl, Mason, & Stanfield, Inc. will conduct construction observation for Pioneer
Irrigation District. Upon completion of constriction, mylar record drawings Shall be forwara ed to
Earl, Mason, & Stanfield, Inc. for Pioneer Irrigation District use.
This letter does not authorize any construction to commence until the necessary agreements with
Pioneer imgation District have been executed and recorded
Our review does not guarantee a problem free system. Said review is only for general confoimance
with the Pioneer irrigation District Standards. The developer is responsible for providing a filly
functional system that follows the intent of the District standards.

Agreement for the Wood Springs Development between Silverhawk Development and Pioneer
Irrigation District. A copy ofthis draft agreameot has been submitted to Pioneer for its review.
If you have any comments/changes that you would like to suggaat, please note those within the
document or call me at 345-2000.
Again, this is a draft until it is approved by both SUverbawk and Pioneer Irrigation District
Upon said approval, you will be instructed to sign and notarize the Agreement and return it to
me so that it can be forwarded on to Pioneer for its signature. Once signatures are in place and
notarized, the Agreement will be recon ed in Canyon County, Idaho, and a fully executed copy
will be sent to you for your records.

NOTICE IS HEREBY GIVEN that the Caldwell City Council wall conduct a pub is hearing
in the public meeting room of the Caldwell Police Department, 110 South 5'" Aventis --
Caldwell, Idaho on Monday, July 7, at 7:00 p.m., in order to hear the following--
Case No. SUB-76F-02, a request by Sllverhawh Development for final plat approval of
Wood Springs Estates Subdivision consisting of 16 residential and two common atrea
lots In an R-1(Single Family Residential) zone. The site abuts the east side of Parker
Gulch and the worth a Ida of W. Linden Street approximately 625 feet west of Airport
Avenue.
You are being notified because Idaho Code, 67-6509, Local Planning Act 67-61i09.
requires notice of this public hearing to be provided to all po itical subdivisions providing
services to the City of Caldwell and to all property owners or purchasers of record rvho
own property within 300 feet of the subject area. Correspondence regarding the
proposal Is to be submitted to the Community Development Department no later
than five (5) wonting days prior to the public hearing and will be made a part of the
public record during the public hearing. Any written testimony received beyond
that date must be brief In order to be read or acted upon. Public testimony will be

TO WHOM IT MAY CONCERN -
Please be advised there is a delivery point in place for the property being proposed for development.
Pioneer Irrigation District's main concern is that all water rights within the District be honored, and
that access to irrigation water be provided to every parcel of land. Delivery point for thas property
is gate 40 — Lowiine Canal.
All existing easements, right-of-ways, and other means used to honor the water ights to
downstream weterusers must be maintained and allowed to continue to exist. it is irnpiurative that
no one disrupt the delivery of water to a downstream water user.
Any lateral, canal, drain or other means used to deliver water, along which there is a right-of-way
or easement, must have the same kept clear of all obstructions at all times. No fences, structures,
or other materials are allowed on any of the District's easements or right-of-ways AND they must
be recorded on the final plat. The Lowline Canal has a 20 foot prescriptive use easement.
Any discharge or nun -off into a federal drain must meet the approval of Mr. John Caywood of the
Bureau of Reclamation_ Pioneer Irrigation District does not assume any responsibility Tor such an

Please be advised that IF it is the intent of the developer to put in it pressurized irrigation systern and
have Pioneer take over said system once the development is completed, the following steps are

1. Said system must be put in according to the current Standards and Specifications of
Pioneer Irrigation District.
2. The developer must contact the office of Earl Mason & Stanfield to make arrangements
for on -site inspections to be made at various points of construction. An eng;nccr from
Earl Mason & Stanfield must be involved in the inspections as thcy are the engineers
for Pioneer Irrigation District and are familiar with the requirements of Pioneer.
3_ The engineering fees will be the responsibility of the developer and/or owner, and a
deposit must be paid in advance to Pioneer Irrigation District before the District will
authorize Earl Mason & Stanfield to review engineering plans. Estimated cc sts for the
District's engineering fees are $500 plus $5.00 per lot. If that amount fails tc. cover the
costs involved due to the necessity to revise plat maps, etc., additional costs +vill
be billed out and paid prior to the District's signing off on the final plat.
4. If it is the developers plan to have Pioneer Irrigation District take over a pressurized
irrigation system for the subdivision, it will be necessary that the pump site b-, designed
at the District's current point of delivery. Service to the subdivision from the pump site
must have its own private delivery line from the delivery point to the subdivisi.on.
5. A Maintenance Agreement must be written up and recorded at the expense of Lhe
Developer and/or owner. All Maintenance Agreements must be reviewed by and
approved by the District's Attorney, Scott Campbell, of Moffatt Thomas in Boise, The
least expensive way to have a Maintenance Agreemcnt drawn up which meet<., the needs
of the District is by having Mr. Campbell himself draw it up. Otherwise there will be
two attorney fees for said developer and/or owner to pay. Mr. Campbell may be
contacted at 345-2000. A deposit of $1000.00 must be paid to Moffatt Thomas to cover
the attorney fees before the work can begin. Any unexpended portion of the deposit
will be refunded.
6. Earl Mason and Stanfield must walk through the site and develop a punch list to be
completed prior to recommending that Pioneer Irrigation District take over the
pressurized irrigation system.
If it is NOT the intent of the developer to request Pioneer Irrigation District to take over a
pressurized irrigation system within their completed development, then the above six strRps do not
apply to their planned development.
Any proposed development which will have downstream woterusers using gravity flow irrigation
must develop their irrigation system in a manner which will insure the downstream watumisers the
ability to acquire at least as much irrigation water for gravity flow irrigation as what they received
prior to any development or construction taking place. The gravity flow irrigation system must be
totally separate from the proposed pressurized irrigation system within a subdivision.

The Engineering Department has reviewed the proposed final plat for Wood Springs Estates
Subdivision. The department provides the following comments on the submitted final plat:
1. The water system is not operational. The water system has not been constructed and testing
on the water system has not been done. The plat will not be signed and building permits will
not be issued until this emergency service requirement has been completed.
2. The roadways have not been constructed. The plat will not be signed and building permits will
not be issued until this emergency service requirement has been completed.
3. Street signs have not been installed. The plat will not be signed and building permits will not be
issued until this emergency service requirement has been completed.
4. Sewer system is not operational. The sanitary sewer line has not been constructed, tested, or
taped. The plat will not be signed and building permits will not be issued until this emergency
service requirement has been completed.
5. Construction security will have to be provided for those items not yet completed prior to
approval of the Final Plat. A "Construction Punch List' has not been issued for this
development. The developer and the City of Caldwell have not agreed to bond amount for
improvements not yet constructed.
6. A pre -construction conference for this development was held on June 19, 2003. The proposed
date of completion for the before mentioned emergency service requirements, in a scheduled
prepared by Sommers Construction, Inc. for Wood Springs Estates, is September 9, 2003.
7. The final plat shall be corrected in accordance with the marked -up copy done June 23, 2003
and mailed to Skinner Land Survey Co. Inc. on June 24, 2003.

6_ Earl Mason and Stanfield must walk through the site and develop a punch list to be
completed prior to recommending that Pioneer Irrigation District take over the
pressurized irrigation system.
If it is NOT the intent of the developer to request Pioneer Irrigation District to take over a
pressurized irrigation system within their completed development, then the above six steps do not
apply to their planned development.
Any proposed development which will have downstream waterusers using gravity flow irrigation
must develop their irrigation system in a manner which will insure the downstream wate:..users the
ability to acquire at least as much irrigation water for gravity flow irrigation as what they received
prior to any development or coastmetion taking place. The gravity flow irrigation system must be
totally separate from the proposed pressurized irrigation system within a subdivision.

The CFD has previously met and discussed this project with the Applicants and city staff. A similar project
for this site had been previously submitted as Maple Wood Estates. In its present form, as submitted, there
are a couple of changes we are requiring regarding street name and fire hydrant locations.
Any deviation from approved plans which requires further review and approval of the Fire Marshal. New
conditions or requirements may be imposed as the result of any changes or exceptions. All conditions
noted in this plan review pertain to this project, to and through its completion and intended use.
Itemized Conditions:
1. Acceptance of water supply for fire protection is contingent upon acceptance of the water system by the
City Engineer and DEQ.
2. All required fire hydrants are to be installed and fully operating prior to any combustible materials being
brought on site.
3. The Applicant has provided an acceptable means of secondary access to/from this project.
4. The submitted street name of Wood Springs is accepted. However, to conform with the city's street
naming policy that portion south of Maple Street will carry the suffix of Place (Wood Springs Place) and
that portion between Maple and Oak Sts. will carry the suffix of Avenue (Wood Springs Avenue).

5_ The locations of proposed fire hydrants are to be modified. One new fire hydrant shall be located on the
SE corner of Oak and Wood Springs Avenue. The other shall be located directly at the south end of Wood
Springs Place between lots 513 and 5C.
6. A minimum required fire flow of 1,000 GPM is required from each fire hydrant.
7. Street name signage shall be installed prior to combustible construction starting.
8. Distinct and legible temporary addresses are required for all lots and any buildings under construction
until such time as permanent address numbers are posted.
9. All-weather access roadways are to be installed and made operational prior to combustible construction
starting.
10. The civil engineer shall submit a revised plat map that contains the corrections noted in this plan
review.
11. The Applicant/Developers shall carefully instruct aU contractors and sub -contractors on this project of
the importance of fire and life safety on the job site. Specifically the following common fire code
violations are often encountered on construction sites:
• Fire hydrants that are obstructed or blocked by vehicles, construction materials, weeds, realty
signage or debris
• Roadways that are partially or completely obstructed or blocked by unattended construction
equipment or delivery vehicles
• Missing, neglected or obstructed temporary addresses or street name signage
• Open burning (warming fires) on construction sites
• Not removing debris and keeping sites as trash -free as possible
12. Applicants and their engineering firms are cautioned to seek out and receive a CFD approval stamp and
sign off on all "final' plat maps submitted for recording to Canyon County to ensure that all conditional
items have been properly rectified and corrected.
13. Fire separation between the common -walled units shall be as stipulated by the Building Official per the
IBC.
NOTE: The CFD is responsible for issuing addresses. No addresses for building permits will be
issued until such time as the CFD has been provided with a stamped copy of the final recorded plat
map for this subdivision.
The CFD looks forward to working with the Applicant and their representatives on this project. For further
