Notes
1. The owner shall comply with the requirements of Idaho Code
$131-3nn5 eoneer"ing 1.rtgntion water.
2. No easement shown or designated hereon shall preclude the
construction and maintenance of hard -surfaced driveways, landscaping,
parking, or other such nonpermanent improvements.
3. The 40-fool Right -Of -Way, the public road known as South Indiana
Avenue, as shown hereon, is hereby dedicated to the public.
J. No residential tots shall be allowed to take direct access to Indiana
Avenue.
5. This development recognizes Idaho Code §22-4503, Right to Farm
Act, which states: 'No agricultural operation or an appurtenance to it
shall be or become a nuisance, private or public, by any changed
conditions in or about the surrounding nonagricultural activities after the
some has been in operation for more than one (1) year, when the
operation was not a nuisance at the time the operation began; provided,
that the provisions of this section shall not apply whenever a nuisance
results from the improper or negligent operation of any agricultural
operation or appurtenance to it.
6. The Utility Easement shown hereon is perpetual, non-exclusive,
appurtenant to the lots shown hereon, and is hereby granted to the
owners of the lots shown heron for the installation and maintenance of
lot owners utilities by public and private utility companies and sanitary
and storm water sewer service lines.
7. The Irrigation Easement shown hereon is perpetual, non-exclusive,
and is hereby granted to Pioneer Irrigation District for the installation
and maintenance of underground irrigation facilities and their
appurtenances for existing rights and uses of the 25A Loleral and the
Low lane Canal.
