AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 3, BY THE ADDITION OF A NEW ARTICLE, ARTICLE 12, CREATING AN
APPOINTED OFFICIAL WHO SHALL BE THE DIRECTOR OF AVIATION;
AMENDING CHAPTER 3, ARTICLE 3, SECTION 03-03-01, CALDWELL CITY CODE,
PERTAINING TO THE APPOINTMENT OF APPOINTED OFFICIALS; PROVIDING
FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING
ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN
CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State
of Idaho:
Section 1. Chapter 3 of the Caldwell City Code is hereby amended by the addition of
a new Article, Article 12, Section 03-12-01 and 03-12-02, as follows:
ARTICLE 12
03-12-01: Appointment
03-12-02: Powers and Duties
03-12-01: APPOINTMENT:
The Director of Aviation shall be appointed as provided in Section 03-03-01 of this Chapter; and
shall hold office for the duration of the appointment unless sooner removed by the Mayor with the
concurrence of the Council.
03-12-02: POWERS AND DUTIES:
(1) The Director of Aviation shall be responsible for aviation activities in Caldwell and the
general operation of the Caldwell Executive Airport.
(2) The Director of Aviation shall at all times have authority to take such action as may be
necessary for the handling, policing, protection and safeguarding the public while present at the
airport and to regulate vehicular traffic at the airport.
(3) The Director of Aviation shall report directly to the Mayor.
(4) The Director of Aviation supervises the Airport Manager and individuals employed as
administrative assistants and other office staff assisting with the management of the Caldwell
Executive Airport.

Section 2. Chapter 3, Article 3, Section 03-03-01, of the Caldwell City Code, is hereby
amended as follows:
03-03-01: APPOINTMENTS:
The mayor shall appoint, subject to the approval of the majority of the full city council: a city
clerk, deputy city clerk(s), city attorney, city engineer and public works director, police chief, fire
chief, city treasurer -finance director, director of aviation, human resources director, and planning
and zoning director. The mayor shall appoint, subject to approval of the full city council, such
other officers as may be deemed necessary for the efficient operation of the business of the
municipality.
Section 3. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 4. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.
Section 5. All ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3495
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 3,
BY THE ADDITION OF A NEW ARTICLE, ARTICLE 12, CREATING AN APPOINTED
OFFICIAL WHO SHALL BE THE DIRECTOR OF AVIATION; AMENDING CHAPTER 3,
ARTICLE 3, SECTION 03-03-01, CALDWELL CITY CODE, PERTAINING TO THE
APPOINTMENT OF APPOINTED OFFICIALS; PROVIDING FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
Section 1: Amends Caldwell City Code Chapter 3, by the addition of a new Article 12, providing for a new
appointed official position for a Director of Aviation for the Caldwell Executive Airport.
Section 2: Amends Caldwell City Code Chapter 3, Article 3, Section 03-03-01, by providing for the
appointment of the airport manager.
Sections 3 through 5: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions, and orders.
Ordinance No. 3495 provides an effective date, which shall be on the I Ith day of April, 2023. Ordinance
No. 3495 was passed by the Council and approved by the Mayor on the 4th day of April, 2023. The full
text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The
Mayor and City Council approved the foregoing summary on the 4" day of April, 2023, for publication on
the 11 th day of April, 2023, pursuant to Idaho Code § 50-901 A.
