Call to Order - Hearing Examiner, M. Jerome Mapp, opened the meeting for the public hearing at 7:02 p.m. Review of Proceedings - Mr. Jerome Mapp outlined the procedures for the public hearing. Members Present: Brian Billingsley (Senior Planner), David Richey (Associate Planner), Dee Fernandez (Secretary), Brent Orton (Engineering Department) and Mark Hilty (City Attorney). lll. Old Business A. Mr. Mapp approved the minutes of the July 25, 2006 meeting. B. Case Number VAR-29-06, a request by Windsor Creek LLC, for a variance of ordinance 11-03-02, Sfreef Location and Alignment. The site is located south of Homedale Road and east of Lake Avenue. Testimony: Brian Billingsley, Senior Planner, informed Mr. Mapp that the applicant requested this case to be ionfinued. Mr. Mapp approved the case to be continued. Mr. Mapp asked if anyone in the audience was in attendance for this case; there was no one' Case continued - Mr. Mapp continued case number VAR-29-06 to the September 26, 2006 Hearing Examiner public hearing. lV. Testimony: Brian Billingsley, Senior Planner, informed Mr. Mapp that this case is to be continued due to an erroi in the mailing notice (site address). Mr. Mapp approved the case to be continued. Mr. Mapp asked if anyone in the audience was in attendance for this case; there was no one. The siteis located at3521South Montana. Testimony: David Richey, Associate pranner, presented the staff report. Brent Orton, Engineering department, read additional conditions into the record thatwere not included in the staff report. This information was given to the applicant at themeeting, off the record. Mr. Mapp stressed the importance of the applicant being made aware of conditions priorto public hearings. Brad Dugan, applicant, signed in favor and provided testimony. His reason for theannexation request is to have City services (sewer and water); Southwest Health Districtwill not allow him to have a septicsystem. Public testimony closed - Mr. Mapp closed public testimony. Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable to theComprehensive Plan components listed in Sections 5.1 through 5.4 in the staff report. Findings of Fact: The Hearing Examiner accepted the general facts as ouflined in thestaff report and public testimony as a part of the Findings.- Conclusions of Law: The Hearing Examiner accepted the Conclusions of Law asoutlined in the statf report Recommendation: The Hearing Examiner recommended approval of Case NumberANN-126-06, a request by Brad and Jennifer Dugan to annex a 0.661-acre parcel ofland. into the City of Caldwell with R-1 zoning,- with the condition of meeting therequirements of the Engineering department as stlted by Brent orton. Mark Hilty, City Attorney, provided testimony about the history of development of the site, and a temporary parXihg allowance madl by the previous Community Development Director, Gian Paolo Mammone. Brent orton, Engineering Department, answered Mr. Mapp's question about a development ag reement. Brian Billingsley, Senior Planner, testified about the surrounding land use of the property. Mr. Bittingli"v pt"i"nted PZ-1000, a map submitted by the applicant' He stated that six letters were received from nearby property owlerq that objected to the applicant's request. He read the names and addresses of the letter writers into the record. Mr. Mapp reviewed the letters for reasons of objection. Larry Knopp, applicant's representative and architect, signed in favor and gave testimony. Gary McAllister, applicant, signed in favor and provided testimony' He read a letter from Zions Bank intotherecord. fhe letterwas marked as exhibit PZ-1001' John Blaisdell, applicant, signed in favor of the application and provided testimony' Travis Manning signed in opposed to the application and gave testimony' He is concerned about increased traffic on 10th Avenue, and wants the neighborhood to remain as R-1 zoning. Ken Stringfield signed in opposed to the application and gave testimony' He is concerned about t6e lighting,'increased traffic,'the parking lot where cars still park, and dust from tne parring ioi. ii" submitted exhibit PZ'1002 a letter from Melvin Landers' PZ-1003 a petition siin"o oV 26 neighborhood residents, and PZ-1004 photographs and a letter from Melissa Stringfield. Katherine Kerrick signed in opposed to the application and gave testimony' She submitted PZ-1005 a black binder. Mark Hilty answered Mr. Mapp's question about the approval process of the rezone application separately from the special use application, since a portion of the site does not require a zone change. Public testimony closed - Mr. Mapp closed public testimony. Findings of Fact: The Hearing Examiner accepted the general facts as outlined in the staff report and public testimony as a part of the Findings. Conclusions of Law: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Recommendation: The Hearing Examiner recommended approval of Case Number ANN-126-06, a request by Brad and Jennifer Dugan to annex a 0.661-acre parcel of land into the City of Caldwell with R-1 zoning, with the condition of meeting the requirements of the Engineering department as stated by Brent Orton. Mr. Mapp stated the following conditions:1. Applicant shall provide site plan showing all streets, existing and easements including Fairview.2. Development should show everything except R-1 zone.3. There shall be 20 feet of landscaping along the public street.4. There shall be landscaping in front and parking in the rear. 5, There shall be connectivity for sidewalks and interior driveways. 6. Landscaping: Mr. Mapp agrees that a detailed landscaping plan is not required, but it should be detailed enough. He does not want a "sea of asphalt."7. Mr. Mapp wants to see elevation of the buildings. He needs more detail in order to make an informed decision. A development agreement will not provide the detail that is required.8. Case is deferred to next hearing examiner meeting. These details shall be submitted to Brian Billingsley in Community Development at least two weeks prior to the next Hearing Examiner meeting on September 26, 2006, in order for the neighbors to have reasonable time to review the information. Zone change request is not approved. Both cases deferred to next meeting. Mr. Mapp has no problem with the special use permit application as a concept, but he does not have enough information to make a decision tonight. For any questions, Mr. Mapp instructed the audience to contact staff. Case deferred to September 26,2006.
