AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 2, BY THE ADDITION OF A NEW ARTICLE, ARTICLE 6, PERTAINING
TO THE REMOVAL OF MEMBERS FROM BOARDS AND COMMISSIONS;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State
of Idaho:
Section 1. Chapter 2 of the Caldwell City Code is hereby amended by the addition of
a new Article, Article 6, Section 02-06-01 and 02-06-03, as follows:
ARTICLE 6
CITY APPOINTED COMMISSIONS, COMMITTEES, AND BOARDS

02-06-01: Purpose
(1) The City of Caldwell has several boards and commissions, which operate in an advisory
capacity to the mayor and city council. Board members/commissioners are generally made up of
community members who serve in a volunteer capacity, with certain membership requirements
depending on the board or commission set forth in Idaho Code or in the specific City Code
governing the same. Appointments to boards, commissions, or committees are made by the mayor,
with the consent and approval of the city council.
02-06-03: Appointments & Removals
(1) Pursuant to City and State Code, Commission, Committee, and/or Board members are
qualified, selected, and appointed for a specified length of time as determined by each code section
specific to that specific Commission, Committee, or Board. These appointments are typically
between three and five years. Appointments shall be made by the Mayor with the consent and
approval of the City Council.
(2) Unless expressly limited or prohibited by City or State Code, Commission, Committee
and/or Board members may be removed at any time during their specified term by the Mayor with
consent and approval of the City Council. The absence in City or State Code of provisions
governing removal shall not constitute express limitation or prohibition. In the event State Code
does provide an express prohibition or limitation on the ability to remove members of any
Commission, Committee, and/or Board, the City Council, by the adoption of this Chapter 2, Article
Ord. 3492 —Page 1
6, does intend to embrace all remaining and additional authority related to the removal of members
not expressly governed by such State Code.
Section 2. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.
Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.3492
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 2,
BY THE ADDITION OF A NEW ARTICLE, ARTICLE 6, PERTAINING TO THE REMOVAL OF
MEMBERS FROM. BOARDS AND COMMISSIONS; PROVIDING FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
Section 1: Amends Caldwell City Code Chapter 2, by the addition of a new Article 6, pertaining to the
purpose of City boards and commissions and the appointment and removal of members thereof.
Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability. repeals conflicting ordinances,
resolutions, and orders.
Ordinance No 3492 provides an effective date, which shall be on the 14th day of March, 2023. Ordinance
No. 3492 was passed by the Council and approved by the Mayor on the All day of March, 2023. The frill
teat of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The
Mayor and City Council approved the foregoing summary on the 71h day of March, 2023. for publication
on the loth day of March, 2023, pursuant to Idaho Code § 50-901 A.
