Scott Woods, the develope/s representative has sent us a bond amount in the sum of $92,000 for items
remaining to be constructed at the above referenced project. The engineering staff has not had a
walkthrough of the subdivision and has not reviewed and approved the bond amount. As of 9/01/05 the
sewer is not operational, water is not operational, all-weather surface is in-place, and street signs should be
installed by 9102105.

Subject: Case Number SUB-SUB-57(4)F-00 (Virginia Park #4)
Brown Bus Company would request on behalf of Vallivue School District that all new
subdivisions be designed with dedicated areas within the subdivision for multiple bus
stop locations. Vallivue School District has a policy that no student living within a
subdivision should be required to walk more than 3/1Oth of a mile to there designated bus
stop. These areas shouldbe off of private property owner's property and be euiry 3/10th
of a mile within the subdivision. These dedicated areas should be lighted and large
enough for 20-25 students to congregate.
Any subdivision being built within 1-% miles to an existing school building should have
a lighted sidewalk or walking path to the school. Under Idaho code any student living
within 1-% miles of a school are not eligible for bus transportation. These student need
to have a safe walking path to get to and from school.

NOTICE tS HEREBY GIVEN that the Caldwell City Councilwill conduct a public hearing
on Tuesday, September 6, 2005, at 7:00 p.m. in the community room o[ the Caldwell
police Depirtment, 110 S. 5h Avenue, Caldwell, ldaho in order to hear the following:
Case No. SUB-57(4)F-00 (Virginia Park 1tu4), a request by Dyver Development for final
plat approval to divelop 6'6 residential lots and 3 common lots on approximately 157
acres'in an R-1 (Single-Family Residential) zone. The site is located east of KCID Road
and west of Ward Line, approximately 500 feet south of Marble Front Road or known as
SE % of the NW % of Section 19, T4N., R2W'
you are being notified because ldaho Code, 67-6509, Local Planning Act 67-6509,
requires noticJ of this public hearing to be provided to all political subdivisions providing
services to the site and to all property owners or purchasers of record who own property
within 300 feet of the subject'atea. Correspondence regarding the proposal is to be
submitted to the Community Development Department no later than five (5)
working days prior to the pdUlic hearing and witl be made a part of the public
record-Auriirg ihe public hearing. Any written testimony received beyond that
date must Ue Uriet in order to be read or acted upon. Public testimony will be taken
at the hearing and made a part of the record.
Case files and exhibits relative to this request are on file at the Caldwell Community
Development Department and are available for review during the hours of 8:00 a.m. to

The Engineering Department has reviewed the proposed final plat for Virginia Park Subdivision No.
4 and provides the following comments on the submitted final plat:
1. The water system is not operational. The water system has been constructed, pressure tests
and clean water samples have been received. The water system is not connected to the City of
Caldwell water system, and water will not be connected until Pioneer lrrigation District will let
them cross their facilities. The system should be operational sometime in the middle of
October. The final plat will not be signed, and no building permits will be issued untilthis
emergency requirement is complete.
2. All weather surfaces are not in place. Compaction test results for the roadways have not been
submitted to the City for review and approval. The plat will not be signed and building permits
will not be issued untilthis emergency service requirement has been completed.
3. Street signs have not been installed.
4. The sewer system is not operational. The line has been constructed, pressure tested, taped,
and approved. The sewer lift station is under construction and should be fully operational by the
10h of September. The final plat will not be signed, and no building permits will be issued until
this emergency requirement is complete.
5. Construction security will have to be provided for those items not yet completed prior to signing
of the final plat. The city has not agreed on a bond amount for those improvements not yet
constructed.
6. The final plat drawing shall be corrected in accordance with the redlines mailed to W&H Pacific
on August 2,2005.
7 . ln an effort to expedite the addressing process of the final plat, the City is asking that an
electronic copy, in AutoCAD format, be returned with the revised copy of the final plat.

General:
The CFD has not recently met and to discuss this phase of the Virginia Park Subdivision
with the Applicants. There is an issue to be resolved relatins to a lack of secondarv
access for this phase. This phase is a deviation from the sequencing of phasing that was
originally established when this project was first proposed. See Itemized Condition #3
below, or contact the Fire Marshal immediately, to discuss other mitigation options.
Any deviation from approved plans will require further review and approval of the Fire
Marshal. New conditions or requirements may be imposed as the result of any changes
or exceptions. All conditions noted in this plan review pertain to this project, to and
through its completion and intended use.
Itemized Conditions:
l. Acceptance of water supply for fire protection is contingent upon acceptance of the
water system by the City Engineer and DEQ.

2. All required fire hydrants are to be installed and fully operating prior to any
combustible materials being brought on site. This may be done on a Phase-by-Phase basis
as those phases are developed. Hydrants to meet or exceed City of Caldwell standards.
3. Secondary access of the roadway system is not provided and, therefore, is NOT
APPROVED. Phase #4 is not connected to any other existing phases and does not show
a means of secondary access and egress. The Applicant shall provide secondary assess.
OPTIONS: The CFD suggests a "temporary" roadway in one of two locations. Access
could be taken via a temporary roadway through lots known as Block 1, Lot 5 or 6, or,
Block 2,Lots 5 or 6. Either option would provide secondary access out to S. KCID Rd.
Temporary roadways must be an all-weather road (compacted pit run) a minimum of
twenty feet (20') wide. This roadway shall be maintained until such time Phase #4 is
provided permanent secondary access through other phases connected to it. This interim
roadway may be blocked with a gate or a chain and padlock connected to posts at either
side, if desired. Signage stating "Fire Lane - Keep Clear at All Times " shall be
posted on either end ofany chain or gating across it.
4. No "raised" (curbed and landscaped) medians will be allowed in the roadways where
they create islands, except for the entry on Greenwqt St. off N. KCID Rd. as long as
there is no less than twenty feet (20') of roadway (curb-face to curb-face) on either side
of that median. Roadway level bricks or stamped concrete may be substituted for
medians where a median-like design is desired but raised medians are not permitted.
5. The roadway names that were submitted by the Applicant on the preliminary plat map
dated 09-03-04 have been accepted, rejected and/or modified, as reflected in the list
below, such that they will conform with the city's street naming ordinance and policy.

9. Distinct and legible "temporary" addresses are required for any structures under
construction until such time as permanent address numbers are installed and posted

12. The Applicant/Developers shall carefully instruct all conffactors and sub-contractors
on this project of the importance of fire and life safety on the job site. Specifically the
following common fire code violations are often encountered on construction sites:
o Fire hydrants that are obstructed or blocked by vehicles, construction
materials, weeds, realty signage or debris
o Roadways that are partially or completely obstructed or blocked by
unattended construction equipment or delivery vehicleso Missing, neglected or obstructed temporary addresses or street name signageo Open burning (warming fires) on construction siteso Not removing debris and keeping sites as trash-free as possible
13. Applicants and their engineering firms are cautioned to seek out and receive a CFD
approval stamp and sign off on all oofinal" plat maps before submiuing them for recording
to Canyon County. This is to ensure that all conditional items and roadway names are
properly shown and all conditional changes have been made correctly.
NOTB: The responsibility for assignment of addresses is a function of the Caldwell
Engineering Department. Dave Marston of their Mapping Division assigns the
addresses. Building permits are not issued until addresses are assigned.
14. New "as built" master plat maps shall be submitted with each new phase submittal
that will show, to the same scale, all phases previously built. Such maps shall clearly

Please be advised that Pioneer lnigation District has not yet reoeived an executed license agreement for the
proposecl crossirEg of the 300 (Eolton) Lateral. Construction within the 300 Lateral rnust not be performed
prior to November 1, 2005, unless othenrise authorized by the Board of Directora of Pioneer lnigation District.
Please be advised that he Noble Drain has a 110-foot Fecleral Right of Way, and must be rccorded on the
final plat. There is to be no obstructions within said Right of Way. There is to be NO storm runoff into the
Noble Drain. All water must be rEtained on-site.
Any construction that impactrs Waters of the United States may rcquire obtaining a 4V permit from the Conc ot
Engineers- Greg Martinez of the Corp of Engineers can be contacted at 345-2154.
Prior to finalization of any Agreements with Pioneer lnigation District. Pioneer tnigation District must receive a
copy of a 444 permit that has been properly e:<ecuted. lf it is determined by the Corp of Engineers that a 4@
permit la not required, Pioneer lnigation District must be notified in writing by fire Corp of Engineers that said
404 permit is not required.
