E-mail: droot@cjyofcaldwell.org Thank you, Debbie Root, MBA, PCED Senior Planner Planning & Zoning bcy e Order of Decision By the Mayor and City Council City of Caldwell, Idaho July 20, 2020 Subject: Order of Decision - Case No. SUB-2017-05 (Virginia Park #11) THE FOLLOWING LAND USE ACTION IS THE PRIMARY FEATURE OF THIS APPLICATION: In the matter of the request of the City of Caldwell for Final Plat approval of Virginia Park #10; which consists of 59 residential lots and 3 common lots on 13.86 acres in an R-1 (Low Density Residential) zone. TABLE OF CONTENTS: 1 COURSE OF PROCEEDINGS II GENERAL FACTS III APPLICABLE LEGAL STANDARDS IV STANDARD CONDITIONS OF APPROVAL V CONDITIONS OF APPROVAL COURSE OF PROCEEDINGS 1.1 On May 14, 2020 the Caldwell Planning and Zoning Department received the final plat application for Case No. SUB-2017-05. 1.2 Files and exhibits relative to this application are available for review in the Planning and Zoning Department, 621 Cleveland Blvd., as well as applicable public hearings. II GENERAL FACTS 2.1 APPLICANT: Corey Barton, 1977 E. Overland Road, Meridian, Idaho, 83642. 2.2 REPRESENTATIVE: Kent Brown, 3161 E. Springwood Drive, Meridian, Idaho, 83642. 2.3 LOCATION: 309 KCID Road, Caldwell, ID. 2.4 REQUEST: The applicant is requesting final subdivision plat approval for Virginia Park #11 consisting of 59 residential lots and 3 common lots on 13.86 acres. The subdivision is located in an R-1 (Low Density Residential) zone. III APPLICABLE LEGAL STANDARDS 3.1 City of Caldwell Zoning Ordinance No.1451, as amended 3.2 City of Caldwell Comprehensive Plan 3.3 Idaho Code, Title 67, Chapter 65, Local Planning Act 3.4 City of Caldwell Subdivision Ordinance No. 2768, as amended IV ENGINEERING DEPARTMENT STANDARD CONDITIONS OF APPROVAL 4.1 The Engineering Department has reviewed the proposed final plat and provides the following comments regarding the project and the submitted final plat: SUB-20E-05 Page 1 of 6 Final Plat Order of Decision- Virginia Park #11 r- 1. The following items must be completed before signing of the final plat. These items cannot be bonded for: a. The water system is not operational. The water system has been constructed and pressure tested. Clean water samples have not been received. The final plat will not be signed and not building permits issued until this emergency requirement is complete. b. All weather surfaces are in place. Compaction test and core sample results have been submitted, reviewed and approved for the roadways. c. Street signs have been installed. d. The sewer system is operational. The sewer system has been constructed, pressure tested and video has been submitted and approved. Interim as-builts have been approved. e. The pressure irrigation system within the public roadway is not operational. The pressure irrigation system has been constructed but has not been pressure tested. f. The storm drain system located within the public roadway is not operational. The storm drain system has been completed and passed a visual inspection by the City. Interim as-builts have been approved. 2. Construction security, per City Code section 11-04-07, will have to be provided for those items which are not among the above mentioned items and not yet completed prior to signing the final plat. The City has not agreed on a bond amount for those improvements not yet constructed. 3. The final plat drawing has been submitted to the City of Caldwell and has been reviewed but not yet approved. The final plat drawing will have to be done in accordance with City codes, policies, and ordinances prior to the City signing the final plat. 4. After signature and recordation of the final plat the Engineering Department will process building permits per City Code section 11-04-07(B); processing permits for 90 days, or until 50% of the total building permits ultimately available for this phase of development have been issued, whichever occurs first. All remaining permits will be released for processing upon final completion of all required improvements, annexation and dedication. 5. In an effort to expedite the addressing process of the final plat. The Engineering Department requests an electronic copy in AutoCAD format be returned with a revised full set bond copy of the final plat. SUB-20E-05 Page 2 of 6 Final Plat Order of Decision- Virginia Park #11 V CONDITIONS OF APPROVAL 5.1 Applicant shall meet the platting requirements as set forth by City Code and in the preliminary plat approval for this final plat, and for any letters of credit required. 5.2 Recorded mylars of the final plat shall be submitted to the Caldwell Engineering Department. 5.3 One paper copy of the recorded mylar shall be submitted to the Caldwell Planning and Zoning Department. Case No. SUB-2017-05 was reviewed by the Mayor and City Council on July 20, 2020. The Order of Decision was approved by City Council members and administratively signed by Mayor Nancolas, on the date noted below. ATTEST: Mayor Garret L.
