Original of this Letter of Credit. All drafts presented under the credit must contain the clause "Drawn under Washington Trust Bank Letter of Credit No. 22435". Any and all banking charges, other than those of the issuing bank, are for the account of the beneficiary. Since the beginning of the Weston Pointe project, Pioneer irrigation District has required a separate pump station, or an upgrade to Ashton Hills Pump station to accommodate Weston Pointe. It was determined that an upgrade to the Ashton Hills pump station, would be a better option for your project. The item of concern at this time is the upgrade to the siphon that supplies water to the Ashton Hills Pump station_ During the 2003 irrigation season, Pioneer Irrigation District allowed a temporary tie-in to Ashton Hills pump station to supply the first few homes being built in Weston Pointe (anticipating the upgrade). We're at the point now, that the present supply of water at the Ashton pump station is not adequate enough to handle what it was designed for (Ashton, Hickman Sub) and Weston Pointe as it nears completion_ Plans for an upgrade to the siphon must be approved by Pioneer Irrigation District by December 15, 2004, or we'll have no other alternative but to completely isolate Weston Pointe Subdivision from water delivery for the 2005 irrigation season, due to an inadequate water supply through the siphon. This means the subdivision would have no water for the 2005 season. As you are also aware, assuming that the plans are approved by Pioneer Irrigation District, Black Canyon Irrigation District must also be contacted on said siphon, and whatever agreements and/or time frames that BUD may have. Prior to finalization of any Agreements with Pioneer Irrigation District, Pioneer Irrigation District most receive a copy of a 404 permit that has been properly executed. if it is determined by the Corp of Engineers that a 404 permit is not required, Pioneer irrigation District must be notified in writing by the Corp of Engineers that said 404 permit is not required. Construction of the siphon must be completed prior to March 15, 2005. This letter does not authorize any construction to commence until the necessary agreements with Pioneer Irrigation District have been executed and recorded, and construction plans have been approved. if you should have any questions or cornments, do not hesitate to call. Please also note that the pump station has not yet been built. Note: Weston Pointe Subdivision is currently operating under a temporary tie-in to Ashton Hills Subdivision. The present Ashton pump station is not capable of handling additional usage. It is my concern that critical items within the subdivision may need to be corrected and the pump station must be built prior to final plat being recorded. NOTE; This letter does not authorize any construction to commence until all the necessary agreements with Pioneer Irrigation District have been executed and recorded. The required hydrants for Unit #2 have been installed at the proper locations. The random fire hydrant I inspected at the north end of Ormsby Ave. was dry and did NOT have water to it. 2.) Paved roadways are installed and drivable. However, there are no barricades to denote the end of pavement at the northern terminus of both Weston and Ormsby Aves. 3.) There are no street name signs installed yet for this unit. 4.) There is a dangerous and large pile of dry weeds along the wooden fence north of and adjoining 5121 Westin Ave. This must be cleaned up ASAP. I have spoken with Eric Maine, the developer's representative, and agreed on a bond amount in the surer of $87,321.85 for items remaining to be constructed at the above referenced project. As of 10/28/04 the sewer is operational, water is operational, all-weather surface is in -place, and street signs have been installed. Page 1 of 1 P/) -4 Memorandum To: Steven Hasson, Community Development Director From: Ben Weymouth, Assistant City Engineer Tim King, Engineering Tech 11 �V Re: SUB-46(2) F-00 Weston Pointe # 2 Subdivision Date: October 21, 2004 The Engineering Department has reviewed the proposed final plat for Weston Pointe # 2 Subdivision and provides the following comments on the submitted final plat: The water system is not operational. The water system has been constructed. Testing on the water system has not been completed. 2. Compaction test results for the roadways have not been submitted to the City for review and approval. All weather surfaces are in place. 3. Street signs have not been installed. The final plat will not be signed, and no building permits will be issued until this emergency requirement is complete. 4. The sewer system is not operational. The main lines have been constructed but not approved. 5. Construction security will have to be provided for those items not yet completed prior to signing of the final plat. No agreement has been made to bond for those improvements. 6. The final plat drawing shall be corrected in accordance with the marked -up copy done October 21, 2004 and mailed to Earl, Mason & Stanfield, Inc. on October 22, 2004. 7. In an effort to expedite the addressing process of the final plat, the City is asking that an electronic copy, in AutoCAD format, be returned with the revised copy of the final plat. 8. Sherman Ave. Nampa, 1D 83686 To: City Of Caldwell Community Development Department From: Brown Bus Company Date:10-20-04 Subject: Case Number SUB45(2)F-00 (Weston Point 42) Brown Bus Company would request on behalf of Vallivue School District that all new subdivisions be designed with dedicated areas within the subdivision for multiple bus stop locations. These areas should be off of private property owners property and be every 3/10'' of a mile within the subdivision. These dedicated areas should be lighted and large enough for 20-25 students to congregate. Any subdivision being built within 1 '/2 miles to an existing school building should have a lighted side walk or walking path to the school. Under Idaho code any student living within 1 % miles of a school are not eligible for bus transportation. These student need to have a safe walking path to get to and from school.
