If you have a cough, feve r, or are not feeling well, please contact Planning & Zoning staff to arrange participation remotely. The City of Caldwell follows the CDC guidelines to allow for distancing in the public meeting area and provide masks/hand sanitizer on site. Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During the registration process, you will be asked what item on the agenda you wish to speak about. Please use the case number as listed within the writte n notice. On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public meetings” button on the center of the page. After registration, you will receive a confirmation email containing information about joining the virtual meeting. CONSENT CALENDAR: [ALL CONSENT CALENDAR ITEMS ARE ACTION ITEMS] 1. The Caldwell City Council dispenses with the three (3) reading rule of Idaho Code §50-902 for all ordinances. 2. Approve the minutes for the Caldwell City Council Regularly Scheduled meeting held on November 15, 2022; the Caldwell Pathways and Bike Routes Committee Regularly Scheduled meetings held on August 18, 2022; and the Caldwell Pathways and Bike Routes Committee Special meeting held on July 28, 2022; 3. Approve Order of Decision for the denial of Case No. ANN22-000013/SUB22-000024 for Banner Ridge Subdivision; 4. Approve Order of Decision for the denial of Case No. AMD-22-05 (Appeal of SUP22-000006) for Canyon Crossing Storage; 5. Accept the resignation of Joe Ramirez from the Caldwell Urban Renewal Agency Board of Commissioners effective November 11, 2022; 6. Approve request from Caldwell Bowling Center, Inc. for a transfer of the Alcohol Beverage License associated with a corporate name change for the facility; 7. Approve Resolution authorizing the purchase of one (1) 2018 Ford Explorer from Corwin Ford in the amount of $32,236 to be used by the Caldwell Police Department; 8. Approve Resolution authorizing the execution of the YMCA Services Agreement in the amount of $540.00 for services associated with the Youth Forum event scheduled for January 11, 2023; 9. Approve Resolution authorizing the Amendment to Purchase and Sale Agreement with Sundowner, Inc. effective upon approval and expires December 31, 2025; 10. Approve Resolution authorizing the execution of a Cooperative Agreement with Idaho Transportation Department associated with the installation on conduit along Hwy. 20/26 in the amount of $42,993.00; 11. Approve Resolution accepting an Easement for a water main line located at the southwest corner of Homedale Road and Montana Avenue; Page 2 of 2 12. Approve Resolution accepting a License Agreement from Pioneer Irrigation District for construction of a new sewer trunk line under the Phyllis Canal; 13. Approve Resolution authorizing the execution of a Cooperative Agreement with Valley Regional Transit for the annual assessment and service contribution; 14. Set the public hearing date for Tuesday, December 20, 2022 at 6:00 p.m. at the Regularly Scheduled City Council Meeting concerning proposed increased fees above 5% of that previously charged and new fees associated with the Caldwell Airport. OLD BUSINESS: 1. ACTION ITEM: Public Hearing (Quasi-Judicial): CASE NO: ANN22-000018, CPM22-000006 and SUB22- 000032 (Peregrine East): (Continued from 11/1/22) A request by Terry O’Brien of J-U-B Engineers, on behalf of Endurance Holdings LLC, for an annexation of parcel R3280700000 (approx. 20.38 acres) with a proposed zoning designation of R-1 (Low Density Residential) and a development agreement. Surrounding zoning designations include R-1 (Low Density Residential), agricultural (County), and RS-6 (single-family residential –Nampa) zone, to include the approval of the accompanying Development Agreement associated with ANN22-000018. Concurrently, the applicant is requesting a comprehensive plan map amendment from Residential Estates to Low Density Residential, along with a preliminary plat for Peregrine East Sub. Peregrine East Sub includes 16.56 acres with 56 total lots that will include 49 single-family residential lots, and seven (7) qualified common lots totaling 2.00 acres or a total percentage of 12.1%, to include approval of Resolution No. 340-22 for the comprehensive plan map amendment associated with CPM22-000006. The project will be developed in one (1) phase and is located west of 12246 Orchard Avenue, and East of 15088 Impact Lane on the North side of Orchard Avenue, parcel R3280700000, in Caldwell, Idaho. 2. ACTION ITEM: (Continued from 11/1/22) - Consider Bill No. 67 (Ordinance No. 3461) for CASE NO: ANN22- 000018 (Peregrine East) with a request to move for its passage by title only and approve the summary for publication. NEW BUSINESS: 1. ACTION ITEM Public Hearing (Quasi-Judicial): CASE NO: ANN22-000011 / SUB22-000023 (Greenmont Subdivision): A request by Patrick Connor, Providence Properties LLC, on behalf of Lionwood Properties LLC, for an annexation of parcel R3255200000 (approximately 28.99 acres), with a proposed split zoning designation of C-2 (Community Commercial) in the northern half and R-2 (Medium Density Residential) in the southern half of the property, to include the approval of the accompanying Development Agreement associated with ANN22 - 000011. The subject property, located at the southeast corner of E. Ustick and Indiana is designated as Medium Density Residential for the southern half of the property and Business for the northern half. The applicant is concurrently requesting approval of a preliminary plat for Greenmont Subdivision, comprised of 97 total lots including 70 single-family lots, 11 commercial lots, and 16 common/open space lots. 2. ACTION ITEM: Consider Bill No. 36 (Ordinance No. 3430) for CASE NO: ANN22-000011 / SUB22-000023 (Greenmont Subdivision) with a request to move for its passage by title only and approve the summary for publication. 3. ACTION ITEM: Consider Bill No. 16 (Ordinance No. 3410 amending the Caldwell City Code regarding the name change from the Caldwell Industrial Airport to the Caldwell Executive Airport (said name change already having been formally effectuated) and reducing the number of airport commission members from eight (8) to seven (7) with a request to move for its passage by title only and approve the summary for publication. 4. ACTION ITEM: Resolution No. 423-22 authorizing that certain personal property known as the airport hangar located on all Lots 16 and 17, Block 1, Aviation Way Subdivision at the Caldwell Executive Airport be declared as surplus property, declaring an intent to convey, exchange, or offer for sale said property, declare the value, an d set the public hearing date of Tuesday, January 17, 2023 at the Regularly Scheduled City Council Meeting at 6:00 p.m. 5. ACTION ITEM Consider Bill No. 78 (Ordinance No. 3472) to annex Brittany Heights Subdivision Phase No. 3, Peregrine Estates Subdivision Phase No. 5, Cirrus Point Subdivision Phase No. 6 into the Caldwell Municipal Irrigation District with a request to move for its passage by title only. 6. ACTION ITEM Consider Bill No.79 (Ordinance No. 3473) to annex Mandalay Ranch Subdivision Phase No. 3 into the Caldwell Municipal Irrigation District with a request to move for its passage by title only. 7. ACTION ITEM Consider Bill No. 80 (Ordinance No. 3474) to annex Adams Ridge Subdivision Phase No. 5 into the Caldwell Municipal Irrigation District with a request to move for its passage by title only. 8. ACTION ITEM Consider Bill No. 81 (Ordinance No. 3475) to annex Jefferson Park Subdivision into the Caldwell Municipal Irrigation District with a request to move for its passage by title only. 9.
