ADMINISTRATIVE APPROVAL
WHEREAS the Planning and Zoning Director, in accordance with Section 10-03-02 of
the Caldwell Zoning Ordinance considered an application for an administrative approval
to reduce a rear yard setback from the required twenty (20) feet to eighteen (18) feet to
accommodate an addition to an existing residence. The subject property is zoned R-3T
(Multi Family High Density; Individual Mobile Home Overlay) and is located at the
southeast corner of N. Ninth Avenue and Galveston Street (716 N.Ninth Avenue).
WHEREAS the Planning and Zoning Director, after reviewing the particular
circumstances, authorized the administrative approval in accordance with the Exhibit "A'
site plan and subject to the following terms and conditions:
a) The addition shall maintain a minimum eighteen foot setback from the rear yard
property line.
b) No structures shall be constructed over any existing utility improvements or utility
easements.
c) The Administrative Approval shall expire if the use authorized herein has not been
inaugurated within one (1) year of the date of approval.
FINDINGS AND REASONS FOR APPROVAL INCLUDE THE FOLLOWING:
A. An application was properly filed in accordance with Section 10-03-02(7) of the
Zoning Ordinance.
B. Notice of application was mailed to property owners within 300 feet in accordance
with Section 10-03-02(7)D of the Zoning Ordinance.
C. The request qualified for an administrative review since the extent of the
modification requested was equivalent to or less than 25% of the requirement.
D. The extent of relief being granted, i.e., from 20 feet to 18 feet, is minimal and
matches the existing setback of the original building.
E. The subject property is somewhat unique since the rear yard abuts the side yard of
the neighboring property to the east.
F. The structure is single story and will not impair light, air, visibility, or other
natural amenity.
G. The addition is compatible with the established pattern of development in the
neighborhood which includes high density residential and commercial buildings.
H. The granting of relief will not be detrimental to the public, health, safety or
welfare.
The applicant or any property owner within a 300-foot radius of the exterior boundaries
of the subject property may appeal the decision of the Planning and Zoning Director
provided written notice of the appeal is submitted to the Planning and Zoning
Department within ten (10) days after the date of approval.

NOTICE IS HEREBY GIVEN, that the Caldwell Planning and Zoning Department has
received a request for an administrative approval to reduce a rear yard setback from the
required twenty (20) feet to eighteen (18) feet to accommodate an addition to an existing
residence.
The subject property is zoned R-3T (Multi Family High Density Residential; Individual
Mobile Home Overlay) and is located on the southeast corner of N. Ninth Avenue and
Galveston Street.
Interested persons are invited to offer input regarding the consideration of said
administrative approval application on or before Friday, March 10, 1995.

Hall, 455-3021.

lines, and a detailed illustration of the proposed request, and where applicable,
topography, landscape areas, signs, lighting, parking and traffic circulation, etc.
3. An elevation plan (where applicable) or photographs or renderings to help illustrate
the nature of the request.
The Planning and Zoning Director reserves the right to not officially accept this application
until total review is accomplished and all required information is submitted.
