LEGAL NOTICE IS HEREBY GIVEN, that the Caldwell City Council will hold a public
hearing in the City Hall Council Chambers, 621 Cleveland Boulevard, Caldwell, Idaho, on
Monday, September 16, 1996, at 7:30 p.m.
The purpose of the hearing is to consider:
A Final Plat for Day Addition subdivision and associated waiver request for property
located generally at the northwest corner of Paynter Avenue and W. Holly Street at
710 S. Paynter Avenue file # 96-06-SUB.
Additional information is available from the Planning and Zoning Department, Caldwell City
Hall, 455-3021.
Interested persons are invited to attend the public hearing and offer testimony regarding
the consideration of the request.

The owner is requesting a two -lot subdivision Final Plat and waiver of
subdivision regulations.
DESCRIPTION: The property under consideration for a waiver consists of 0.161 acres (233,80' by
115'), and would be split into two lots. LOT ONE: consists of the applicant's existing
home and is platted as a 123,80' by 115' (14,237 sq.ft.). LOT TWO: is platted as 70'
by 115' (8,050 sq.ft.and it is planned as the location of a preexisting home site. The
property is part of the Day Addition, Block 1, Lots 1
BACKGROUND:
♦ Part )f this application is a request to deviate from Subdivision Standards of the City of Caldwell. This
is an item the Planning and Zoning may send a recommendation or choose to defer the discussion to City
Council. The City Council is the governing body that may waive adopted ordinances. The applicant has
requested a right not to install curb, gutter, and sidewalk.
*Staff Note: The sidewalks, curbs, and gutters have not been installed in this area, !n this
specific case the request is not unreasonable based on the fact of the M-1 Zone and age of
housing.
FACTS:
1.Legal requirements and public hearing meeting at Planning and Zoning have taken place and are part of the file.
Subdivision Ordinance
Section 11-03-05, Lot Planning, establishes requirements far lot specifications.
SUMMARY OF POINTS AND CONCLUSIONS:
* The proposal meets requirements of the Subdivision Ordinance, related to procedures for
processing subdivision requests and specifications for developing lots.
* The proposal, as presented, will be compatible with the existing neighborhood.
Staffrecommends approval of the Minor Subdivision 96-06-Sub and its' associated wavers based on the submittal
is compatabile to the community and specific site, and neighborhood. The project is representing utilization of an
existing house on an in -fill lot and is a suitable solution to affordable housing.

REQUEST: The owner is requesting a two -lot subdivision.
PROJECT DESCRIPTION:

LEGAL REQUIREMENTS have been met.
FACTS AND CONCLUSIONS OF LAW:
SUBDIVISION ORDINANCE
a. Section 11-01-02, Purpose and Intent, includes providing for orderly growth and
harmonious development, achieving individual property lots of reasonable utility
and livability, insuring adequate provisions for public utilities, and promoting
conveyance of land by accurate legal description, and providing logical
procedures to achieve these objectives.

b. Section 11-02-02 (3), Compliance With ,Idaho Code, requiring submission of plat
plans to the City for approval by its Council. if the piece of land is to be divided
into two (2) or more parts of any residential .-or, the boundaries having been fixed
by a recorded plat.
Section I1-02-07 (6), Information Required: Final Plat Submittal, Short Plat
Procedure, outlines the requirements for requesting the preliminary plat and final
plat as a single process,-
]. the proposed subdivision does nor exceed ten (10) lots,
2, no new street dedication or street widening is involved,
3. no major special development considerations are involved such as
development in flood plain, hillside development, etc.,
4, all required information for both preliminary and final plat is complete
and in an acceptable form.
d. Section 11-03-05, Lot Planning, establishes requirements for lot specifications.
On August 22, 1996, the Planning & Zoning Commission recommended approval of a
request for a two lot subdivision of property located on the northwest corner of Paynter
and Holly Streets, and contingent on City Council approval of the applicant's request to
waive requirements for sidewalks, gutters, and curbs.
