To Replat Lot 6 and a portion of Lot 5, Block 2, Dela Cherie Sub. No. 2,
creating De La Cherie Subdivision No. 3, Block 1, Lot 1.
The site is located east of Brookside Drive and south of Ash Street.
LEGAL REQUIREMENTS:
1. Notice of public hearing mailed to property owners of the subject area and to property
owners within 300 feet of the subject area on June 2, 1996.
2. Notice of public hearing mailed to agencies on May 28, 1996.
3. Notice of public hearing published in the official newspaper on June 3, 1996.
4. Notice of public hearing posted at property in accordance with State Law.
5. Agenda posted 48 hours in advance of the hearing.

2. SUBDIVISION ORDINANCE REVIEW
11-02-06 Final Plat
(1) Zoning: This proposal meets the requirements for minimum lot size for the R-1
zoning district.
(2) Easements: Ten foot easements are provided for along the north, west, and south
boundary and five foot along the east boundary.
(3) Final Plat Submission: The applicant has submitted a final plat for the approval of the
Planning and Zoning Commission.
(4) Final Plat Review: The planner has reviewed this plat and has noted no deviations of
the Subdivision Ordinance. The City Engineer had no negative comment on this proposal
for Final Plat. Utilities, having an interest in said REPLAT, have been notified of this
proposal with no negative comments being received at this time. Adjacent property
owners were notified of the requested replat and have not voiced any objections.
SUMMARY:
The City Council approved the final plat of De La Cherie Subdivision No. 2 on March 2, 1992.
This Planned Unit Development subdivision included a common lot (Lot No. 5). This lot was to
be developed as a private drive and a common landscaped area with a berm. The private drive
was constructed to access Lots 4, 6, 7 and 8. The landscaped portion of Lot 5 buffers Brookside
Drive from the interior of the subdivision. The applicant wishes to access Brookside Drive with
a private driveway from his garage. Except for a portion of the berm toward the south side which
would accommodate his driveway, the landscaping and berm will remain and be maintained by
the applicant.
