♦ Final Plat approval of De La Cherie Subdivision No. 3

DATE: July 1, 1996
APPLICANT: Gene and Phyllis Baxter
LOCATION: The site is located east of Brookside Drive and south of Ash Street,
LEGAL NOTICE has been met and is part of this file.
FACTS:
i . The Comprehensive Plan Designation is Low Density Residential.
2. The property is zoned R-1 (Single Family Residential).
3. Brookside Drive is classified as a Local Roadway on the Caldwell Functional Street
Classification Map.
4. This request has been reviewed for compliance with the City of Caldwell Subdivision
Ordinance with no concerns addressed.
CONCLUSIONS:
Final Plat review by the City of Caldwell Planning, Fire and Engineering Departments has been
accomplished and it has been recommended for approval.

Commissioner Roos statedl...c it is the purpose of this Commission . weigh everyone's rights. The
rights of a property owner to do things with their own property and the right of a person that would be
affected by these things. He stated that the Commission has an obligation to the residents of the area.
Everything surrounding the area of the proposed project are all residential, with the exception of a small
dentist's office. He stated that the Commission should take into consideration the feelings of all of the
residents that have given testimony tonight.
A motion was made by Commissioner Roos that Case No. 96-03-Zone Change -Espresso Break,
a request for a zone change from R-3, Multi -Family High Density Residential, to either a C-!,
Neighborhood Commercial or C-2, Community Commercial, for the purpose of operating a
coffee shop and located at 622 South Tenth Avenue, be denied for the following reasons:
1. To keep the R 3 buffer zone intact
2. To not increase the traffic flow and protect the children as much as possible
3. To keep in accordance with Section 10-01-03: Zoning Districts Purpose Statement:
D.C-1, which states in part " The purpose of the C-1 (Neighborhood Commercial)
Zone.....regulated to provide local commercial service needs primarily located at
selected places at the perimeter of low -density residential neighborhoods. This
zoning district is intended to restrict incompatible uses which may be better located
in the community..."
4. The project does not meet the definition of a neighborhood store.
The motion was seconded by Commissioner Gilbert.
Roll Call Vote: Yes: William Roos, Bill Gilbert, Madeline Buckendorf, Sonia Huyck,
No: None
Motion passed.

The next item was Case # 96-01-REP- De La Cherie Subdivisioq, a request to Replat Lot 6 and part
of Lot 5, Block 3 of the De La Cherie Subdivision No.
Chairperson Pilote asked if any of the Commissioners had a conflict of interest. Commissioner Huyck
stated that she had a conflict of interest and abstained.
Ed Christopher presented the staff report. He stated that all legal requirements had been met. He stated
that the applicant had requested that a portion that was commonly known as Lot 5, be split off and added
to Lot 6, thereby creating De La Cherie Subdivision #3, Block 1, Lot 1.
The applicant was represented by William Mason, who is employed by Skinner, Earl and Associates,
Caldwell. He stated that he was present to answer any questions concerning the request.
He stated that he received notification that the utilities had vacated or relinquished their interest in the
easement along Lot 5 and west of Lot 6. This included the telephone, gas, power and cable companies.

Chairperson Pilote stated that were is a building all ready in construction on the property. She inquired
as to how the building permit was granted before the issue tonight was settled. Mr. Mason responded
that he did not know how that happened. He speculated that the building permit was granted without
the proper channels going through. However, the permit was issued by the Engineering Department.
The first speaker was Gene Baxter, who passed.
Chairperson Pilote then closed the public hearing. Discussion from the Commission ensued.
Commissioner Roos stated that the Replat made sense.
A motion was made by Commissioner Gilbert that Case No. 96-01-REP De La Cherie
Subdivision, a request to Replat Lot 6 and part of Lot 5, Block 3 of the De La Cherie Subdivision
No. 2 be approved for the following reasons:
1. It makes sense to replat it that way.
2. It is a moot issue, since the building permit was issued by the Engineering
Department prior to the request for replat to be considered.
The motion was seconded by Madeline Buckendorf.
Roll Call Vote: Yes: Bill Gilbert, Madeline Buckendorf, William Roos, Bettie Pilote
Abstain: Sonia Huyck
No: None
Motion passed.

Chairperson Pilote reminded the Commissioners of the workshop next Thursday. She also reminded the
Commissioners that the process of reviewing the Caldwell Comprehensive Plan had been started.
Chairperson Note reiterated the fact that the Commission needs to be sure that the facts and conclusions
for each Motion are stated and recorded in the Minutes.
There being no further business, Chairperson Pilote adjourned the meeting at 9:30 p.m.
