HomeMy WebLinkAbout77-AN-01 Howshaw 20 AcresBILL NO. 5 ORDINANCE NO. 1413 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PURSUANT TO THE PROVISIONS OF IDAHO CODE SECTION 50-222, BY ANNEXING THERETO A CERTAIN TRACT OF LAND CONTIGUOUS TO AND NOT EMBRACED WITHIN THE PRESENT LIMITS OF THE CITY OF CALDWELL, IDAHO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO: PREAMBLE It appearing that a petition in writing has been presented to the City Council of the City of Caldwell, Idaho, signed by the owners of certain real and personal property requesting annexation of their properties to the City of Caldwell, Idaho: The City Council of the City of Caldwell, Idaho, does ordain as follows: SECTION ONE The City Council of the City of Caldwell, Idaho, hereby determines that the petition was signed by the owners of certain real property and personal property which would be subject to taxation by the City of Caldwell, Idaho, in the event of annexa- tion, within the territory described as follows: See attached Exhibit "A" which contains a description of the real property subject to this Ordinance, which by this reference is incorporated herein. and that such territory is contiguous to the City of Caldwell, Idaho, and not embraced within the city limits, and is within the area described in the petition, and that therefore the City Council of the City of Caldwell, Idaho, has jurisdiction to annex the above described territory to the City of Caldwell, Idaho. SECTION TWO The corporate limits of the City of Caldwell, Idaho, are hereby extended and increased so as to include and embrace within the corporate limits of the City of Caldwell, Idaho, the territory ORDINANCE - 1 described in Section One hereof, and such territory is hereby annexed and declared to be a part of the City of Caldwell, Idaho. SECTION THREE The map or plat attached to this ordinance is an accurate map of the territory annexed, and the, same is hereby adopted as the official map and plat of the territory hereby annexed, which map and plat show the legal boundaries thereof, together with the avenues, streets, alleys and lanes and the locations thereof, and the same are hereby dedicated to the public use for the pur- poses designated on the map or plat. SECTION FOUR The Mayor of the City of Caldwell, Idaho, is hereby authorized and directed to certify that the map is an accurate map of the territory annexed under the provisions of this ordinance. SECTION FIVE The City Clerk of the City of Caldwell, Idaho, is hereby ordered to perform the following statutory duties within ten (10) days following the effective date of this ordinance: To file a certified copy of such ordinance with the auditor, the treasurer, and the assessor of Canyon County, Idaho, and to file a certified copy with the Idaho State Tax Commission. The Clerk of the City of Caldwell is further hereby required to cause one copy of the legal description and map of the territory hereby annexed prepared in a draftsman -like manner, together with a legal description prepared in a draftsman -like manner, to be filed with the county recorder and county assessor of Canyon County, Idaho, and to file a copy of said documents with the Idaho State Tax Commission, all to be done within ten (10) days following the effective date of this ordinance. ORDINANCE - 2 I9 SECTION SIX On the filing and recording of the copy of this ordinance, together with the attached official map, in the office of the County Recorder of the County of Canyon, State of Idaho, the fee of all avenues, lanes, streets, highways, roads, and alleys shown in and on the map and plat shall vest in the City of Caldwell, Idaho. SECTION SEVEN If any provision of this ordinance shall be held invalid, its invalidity shall not affect any other provisions of this ordinance that can be given effect without the invalid provision, and for this purpose the provisions of this ordinance are hereby declared to be severable.
