John ConnoIlyr associate City At.torney, has reviewed t.he draftordinance and e xpressed some concerns about Article Mn thatthe designaEing of such property might const.iCute a takingwithout compensation. He did, however, find in ldaho Stat.e Code enabling legislation under Chapt.er 46, 67-46A1 , which would backup the language in the proposed ordinance. The Commission discussed due process procedures and recommendeda paragraph regarding public hearings to be inserted betweenSections I and 2r Article IV. They then requested the aid of EheCity Attorney in refinj.ng the ordinance and tent.atively dlscussedpresenting it t.o the Council on the 18th of January. Tom indicated he has been working with Lurene Thurston t.o obtain information on properties within the proposed boundaries under congideration (6th to lgth and the railroad to alley betweerrBlaine and Arthur).
