City of Caldwell, Idaho, upon recommendations of the Plannlng and
zoning commissJ-on pursuant to Section 6-L-7, cardwelr code and
followlng the public hearing procedures as requJ.red Ln Section 6-
4-3, CaldweII Code, that the following described property be
redesJ-gnated from Medlum Density Residential to General
Commercial on the City's Comprehenslve P1an, and that said change
to the Comprehenslve Ptan is in the best interest of the City of
Caldwell, Idaho:

BACKGROUND:
A Special Use Permit was considered and approved by the Planning
and Zoning Commission on May L0, L99O for the property between
Boise Avenue on the west, First Avenue on the east, Frontage Roadon the north and Galveston Street on the south. The permit
authorized the use of the subject property for auto, marine andrecreational vehicle sales. On June 4, 1990, the City Council
approved a request to vacate First Avenue between GalvestonStreet and Frontage Road. Subsequently, the use and improvementof the property was initiated. It should be noted that all
improvements west of the center I ine of vacated First Avenue have
been accomplished in violation of the zoning ordinance. This
area is zoned R-2 (Medium Density Residential) and is limited toresidential development.

EVALUATION:
The requested amendment to the Comprehensive Plan is intended as
an initial step in seeking an expansion of the C-4 T zoning to
the east. The applicant is requesting a change involving Block
22 and for property east of the center line of First Avenue to apoint approximately 110 feet within BIock 23. A parcel,
approximately 40 feet wide, is designated to remain residentialand intended to serve as a buffer between the two land use

consideration is whether the zoning and the land use is
transitional or whether the area is a viable commercial area

The vacation of First Avenue has served to remove the buffer
between the commercial and residential zoning. If a PIan
amendment and zoningr classification is approved, provisions
should be taken to protect established residential uses
located with the eastern portion of Block 23.
A number of options are available to the Commission.

The Cornrnission may include the vacated street right-of-wayin the recommended Plan change and leave the two residential
lots within the western portion of Block 23.

RECOMMENDATION:
