sub-standard paving when selrer extensions were made, requiring the abutting property owners to, bear the cost ofreplacing the pavement through creation of a locarimprovement districL. rf sehrer extensions were made in
lTeas where paving was considered to be up to standard, thecity paid the cost or assessed it as part of the sewer cost.rn_ this case, t!" city deemed the removed pavement to ;;--sub-standard and created a tocal improvement district toassess the cost to the abutting owners. The owners, plaintiffs herein, contended that, the removed pavement wasnot substandard, that the creation of an LrD viotated theirconstitutional rights, that the city had created a nuisancebv refusing to ;e,place the pavement at its expense, and thatthe city had viorated theii civil rights under 42 u.s.c.S 1983. Held for the City. -
1. The cityts decision to remove the pavement was anexercise of legislative discretion and was not arbitrary andcapricious.
