RE: Augustina Subdivision
Dear Mr. Rizzuto:
Subsequent to our discussions, I offer the following:
1) The above referenced plat was approved by City Council and recorded at the
Canyon County Recorder's office on October 9, 1996 in book 23, page 38.
The staff report referenced 'setbacks shall be as follows: minimum 20 foot rear yard
setback; minimum 15 foot rear year setback when the rear lot line abuts an open
space lot; all side yard setbacks shall be a minimum 5 feet with the exception of
those lots shown on Exhibit A as having zero foot side yard setbacks; and a
minimum 20 foot front yard setback."
It is my understanding that the conditions outlined in the staff report, including the
aforementioned setbacks, were approved by City Council. Unfortunately, this was
not made a clear part of the case file and has caused some confusion when
persons have sought building permits.
4)Fortunately, this confusion can be eliminated by recording an amended plat that
includes the setback criteria in the notes. The amended plat does not have to go
to a public hearing, but does have to be signed by: City Clerk, City Engineer, Coun$
Treasurer, and County Recorder (when re-recorded). The amended plat does go
before City Council on a meeting agenda but only for their information.
A new mylar, both pages, has to be prepared and the following must be placed at
the top of sheet 1:

To amend the plat of Augustina Subdivision as recorded in
the Canyon County Recorder's Office on October 9, 1996,
in book 23, page 38 by adding paragraph 6 to the list of Notes.
6)The following statement is to be added to the amended plat under Notes:
6. Setbacks shall be a minimum of 20 feet in the rear yard or a minimum of 15 feet
when the rear lot line abuts an open space lot; front yard setbacks shall be a
minimum of 20 feet; all side yard setbacks shall be a minimum of 5 feet when the
lot is developed with a single-family dwelling. Zero side yard setbacks shall be
permitted at the interior lot line between Lots 2 and 3, 5 and 6, 8 and 9, 10 and 11,
13 and 14, 15 and 16, 17 and 18,21 and22, when developed with two-family
dwellings.
The recording of an amended plat should eliminate any confusion or misunderstandings
regarding approved development of this subdivision. lf you have any questions, please

Preliminary Plat Augustina Subdivision
Dear Mr. Wheeler,
We have processed your request for a time extension for Augustina Subdivision preliminary plat.
The City of Caldwell Subdivision section ll-02-04 (6)C states:
preliminary plat time extensions are to be considered in increments of one (l) year and
may be granted administratively by the Planning and Zoning Director in accordance with
Section l0-03-02 of the Zoning Ordinance provided the basic circumstances and
conditions upon which preliminary plat approval was granted have not changed.
I have reviewed the basic circumstances and conditions upon which the preliminary plat was
granted and find no significant change. A time extension is hereby granted for the preliminary
plat of Augustina Subdivision to February 13,1997.

Status of the Final Plat
Dear Nancy:
As discussed during our telephone conversation on January 2, 1996, as soon as we have
resolved some engineering design issues for this development we will be submitting the final
plat for City Council approval and final signature.
We understand that bonding is an option in the City of Caldwell and we may need to discuss
