secure tltle for mortgage purposes wlth thls encroachment 1f, ln fact,1t does exlst.
I dlscussed the matter wlth Joe Gamboa thls afternoon and he sald that
Terry Durbln had been on the slte three dlffenent tlmes and, accordlngto Terry, the house nas encroachlng on the c-d-s but dldnrt say honfar. I also dlscussed wlth Joe the course of actlon by the Ctty. Flrst
would be the proof that the house was on the c-d-s. Next, 1f lt 1s onthe c-d-s, Joe would accept a recordable lnstrument whlch gave a varlance
by the Clty Councll that the house could, ln fact, exlst wlth the en-
croachment . ,
I called 8111 Norman and gave hlm the above. lnformatlon. He ls golng
to check the encroachment and repont back to me.
I lnfonmed 8111 that thls was only a s1lght encroachment such that I
coulil recommend that the c-d-s as 1t now exlsts 1s larger than that
nequlred by ondlnanee (exlstlng 100 feet 1n dlameter - the ordlnance
requlrement 90 feet ln dlameter) and there ls stl11 a posslblllty of the
r-o-w fon Jay Lane to extend to another stneet r-o-w. I would reeommend
the varlance be granted on thls bas1s.
