Dear President McCluskey:
This office represents M & B Realty Company, the owners of a tract
of land located in the 200 block on Joliet Street with approxi-
mately 250 feet frontage on that street. tlr. Byrle lt{orse is presi-
dent of that corporation.
I!tr. I,lorse was shocked and dismayed to read the Caldwell News Tri-
bune issue dated December L7, L975, pertaining to action taken
with respect to the property which is referred to above. He has
asked me to write you in order to clarify the situation as it now
exists and perhaps correct some impressions and decisions which
have been mad,e.
Prior to my clientsr purchasing this property, Mr. Morse went to
city HalI where he talked to Mr. Dufur and Ivlr. Lewis concerning
any- problems involved in the division and use of the ProPerty by
u I E nealty. IIe was advised that the proPerty was too smal"l to
require formal subdivision and recording of Plat. It was requested
thi€ tre grant an 8-foot easement along the Northwest side of the
property for sevJer purposes. My clients were and are willing to
grant this easement. Mr. Morse was advised that Mr. Lewis would
present the matter pertaining to the easement to the Planning Com-
mission. Mr. Morse was not advised that he would be reguired to
seek a variance from any ordnance pertalning to the construction of
curb, gutter, sewer or laving, or iny other matter, and did not
undersfand or propose to suUmit that matter to the Planning Conrnis-
sion. He merely understood that it was a routine matter on the
easement which would be handled by the City officials. He was not
advised of the time and pJ.ace when this matter would be taken uP
before the Planning Commission, and only read about the action
following publication in the paper of the action by that Corwriesion.
He was further not advised that the matter would come before the
