CROOKS Plonning & Zonlng Diroclot 52I CLEVETAND BTVD. cAtDwELr, loAHo 83605 TETEPHONE ,i55-3(}2l tAx 455-3003 PLANNING AND ZONING COMMISSION ACTION REPORT Meeting of March 16, 1995 WHEREAS, the Planning and Zoning Commission on March 16, 1995, considered an application for a variance to allow a reduction of the rear yard setback from the required 20 feet to 5 feet affecting a corner of one of the dwelling units in Georgia Square multi-family housing complex in the C-2 (Community Commercial) zoning district, on property located on the northwest corner of Blaine Street and Georgia Avenue, applicant: Georgia Square Partners. WHEREAS, the Planning and Zoning Commission, after considering public testimony presented by interested persons and reviewing the particular facts and circumstances associated with the request voted to approve the Variance subject to the following terms and conditions: 1 That the Variance is granted to allow a reduction of the required 20' rear yard setback to 5' affecting a corner of one of the dwelling units, as depicted on the site plan labeled Exhibit "A-1". 2. That the Variance is not transferable from one property to another. FINDING O 1 2 F FACT/CONCLUSIO NS OF LAW: An application for a Variance was properly filed in acrordance with the provisions of Section 10-03-05 of the Municipal Code. The legal requirements were done in accordance with the procedures outlined in Section 10-03-05 (3) of the Municipal Code. Legal notice of the Varrance application and public hearing was published in the local newspaper. Neighboring property owners were notified of the request and public hearing. Notice was posted on the premises not less than one week prior to the public 1 TERMS AND CONDITIONS: o o hearing. An agenda was posted at City Hall 48 hours in advance of the meeting in accordance with ldaho Code. A public hearing was conducted by the Planning and Zoning Commission in accordance with procedures contained within Section 1043{4(3) of the Municipal Code. A representative for the applicant provtded supporting testimony. There was no opposing testimony. The Planning and Zoning Commission, in granting approval of the Variance concluded the following: a) the odd configuration of the property and in particular the peculiar angle of the rear property line was determined to constitute a unique circumstance related to the physic€l characteristics of the property. b)the unique circumstance resulted in a hardship which prevented reasonable enjoyment and use of the property; c)the granting of the variance would not be in conflict with the Comprehensive Plan and will not effect a change in zoning. d)the granting of the variance would not be materially detrimental to the public health, safety or welfare or injurious to the property or improvements of other property owners. The applicant, or an affected person having interest in real property within 3OO feet of the subject property, is advised of the right to appeal the decision of the planning and Zoning commission. written notice of such an appeal shall be filed with the city clerk within fifteen (15) days after the decision of the planning and Zoning Commission.
