Our house was constructed in late 1984 or early 1985. I{e have
lived there since the faII of 1985 and purchased the ProPerty in
1987. The house was constructed at the extended set back line
caused by the tenporary eul-de-sac, naking its buildingl set back
20 feet fron the set back line required in an R-2 zone.
Our request is that we be allowed to extend the current
to the norual set back Iine for an R-2 zone. We feel
would be an asethetic improverent to the block.

We have spoken with both the City's Planning Departnent and the
Cityts Engineerin8 Departnent. Mr. Rednond suggested that we
request a vacation of the cul-de-sac since it was never
constructed, however Mrs. Robison felt that a variance would be
nore in line with our intent.

l{e are requesting a variance to encroach into the temporary cul-
de-sac easement that affects our lot. During the PlattinS Processin 19??r a tenporary cul-de-sac was provided for at the west end
of Beech Street. The plat also states that when the street is
extended the cul-de-sac reverts to ProPerty owners. At the tine
that the street was actually constructed in 1978r the city did not
require that the tenporary cul-de-sac be built nor hes it been
built since that tine.

meeting Thursday, September 211 1989, at 7:3@ p.m. in the CityIla1l Council Chambers. 62L C1eveland Boulevard, Caldwell, Idaho.
The purpose of the hearing ig to consider an application for a
variance requested by Rita and Jerry Earl, 2704 Beech. Street, toconstruct an addition which will encroach into the temporary cul-de-sac easement at the west end of the section of Beech Street
adjacent to the above property. Said encroachment will ext.end tothe 2o-foot fronE seLback Iine.
The public is invited to attend Ehe public hearing and offertestimony regarding t.he granting of said variance.
