A RESOLUTION OF THE URBAN RENEWAL AGENCY OF THE CITY OF
CALDWELL, IDAHO, AUTHORIZING AN IMPROVEMENT PROJECT FOR THE
ALLEYWAY BISECTING THE BLOCK BETWEEN MAIN STREET AND ARTHUR
STREET SOUTHWESTERLY OF KIMBALL AVENUE FROM THE PLAZA TO THE
USPS PROPERTY.
THIS RESOLUTION is made on the date hereinafter set forth by the Urban Renewal
Agency of the City of Caldwell, Idaho, an independent public body corporate and politic,
authorized under the Idaho Urban Renewal Law of 1965, as amended, Chapter 20, Title 50, Idaho
Code, a duly created and functioning Urban Renewal Agency for Caldwell, Idaho, hereinafter
referred to as the "Agency."
WHEREAS, the Agency recently entered into that certain Development and Disposition
Agreement dated November 14, 2022 with Aztec Development, Inc. ("Aztec') regarding the
redevelopment of property located at the corner of Arthur Street and Kimball Avenue extending
from Arthur Street to the alleyway ("DDA"); and
WHEREAS, to incentivize the redevelopment project, Agency has committed to
construct, at its expense, certain improvements to the alleyway adjacent to the project, including
pedestrian access from the Plaza to the alleyway across Kimball Avenue; and
WHEREAS, the DDA has several contingencies which may result in the redevelopment
project contemplated by Aztec not going forward as currently planned; and
WHEREAS, Agency has decided that it will construct the Alleyway Improvement Project
even if the broader redevelopment of the site does not proceed.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
THE URBAN RENEWAL AGENCY OF THE CITY OF CALDWELL, IDAHO:
Section 1. That the "Alleyway Improvements" described in Section 11 and Attachment 9
of the DDA are hereby approved as an independent urban renewal project. For purposes of
clarifying the scope of this alleyway improvement project, the DDA is incorporated here by this
reference.
Section 2. The Agency's staff is authorized and directed to work with the City of Caldwell,
Idaho to, plan, budget for and construct the Alleyway Improvements even if the broader
redevelopment contemplated by the DDA does not proceed.
