AN ORDINANCE DETERi'IINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANOS
SHOULD BE ANNEXEO TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE H.C & R.2
(HIGHWAY CORRIDOR & MEDIUM DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO ADD SAID PROPERW TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF lN CONFLICT HEREWTH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO
FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH
CANYON COUNW, STATE OF IDAHO AND THE IDAHO STATE TAX COMiIISSION, PURSUANT TO
TDAHO CODE, SECTTON 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALOWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section l. That the Caldwell City Council, upon recommendation of the Caldwell Heanng Examiner and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No.
1451, approved Case No. ANN22-000007 (The Charles Annexation) at a public hearing held this 6th day
of October, 2022
Section 2. The parcel is contiguous to the City of Caldwell, ldaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as H-C & R-2 (Highway
Corridor & Medium Density Residential):

West, Boise Meridian, Canyon County, ldaho, more particularly described as follows:
BEGINNING at the NE corner of said Section '14, thence S89"42'56'W, 288.64 feet along the north
boundary of said Section 14; thence S00'25'56'W, 170.74 feet; thence N89''10'04"E, 288.05 feet to a point
on the east boundary of Section 14; thence SOO'39'03"W, 1 152.95 feet along said east boundary to the SE
comer of the NE % NE % of said Section '14; thence S89'39'32'W, 1325.20 feet along the south boundary
of said NE % NE % to the SW corner of said NE % NE %; thence N00'36'47"E, 1322.24 feet along the west

easterfy boundary of said Section 1 1 ; thence N89'20'30'W, 1327 .24 feel lo the west boundary of said N E
%SE%,lhence N00'36'37"E, 953.60 feet along said west boundary to the NW corner of said NE%SE %,
thence N89"42'25"E, 1328.22 feet along the north boundary thereof to the POINT OF BEGINNING
Contains 29.40 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, ldaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, ldaho as H-C & R-2 (Highway Conidor & Medium Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in etfect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, ldaho shall, within 10 days following the etfective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared an a draftsman-like manner'Plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of ldaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certifled copy of this ordinance with the State Tax Commission of
the State of ldaho, all in compliance with ldaho Code 63-215.

This ordinance provides for annexation of a parcel of land to be annexed into the City of Caldwell as H-C
r_R-2 (Highway Corridor & Medium Density Residential) zoning.
HC Zone
A portion of the E % SE % of Section 11 and the NE % NE % of Section 14, Township 3 North, Range 3
West, Boise Meridian, Canyon County, ldaho, more particularly described as follows:
BEGINNING at the NE corner of said Section 14, thence S89'42'56"W, 288.64 feet along the north

The Ordinance includes a provision to amend the official maps of the City by designating the above-
described property as H-C & R-2 and providing an effective date, which shall be on the 1 1th day of October,
2022. Orcinance No. 3425 was passed by the Council and approved by the Mayor on the 6th day of
Octobet,2022. The full text of the Ordinance is available at Caldwell City Hall, 41 'l Blaine Street, Caldwell,
ldaho. The Mayor and City Council approved the foregoing summary on the 6thr day of October, 2022, fot
publication on the l lth day of October, 2022, pursuant to ldaho Code 50-9014.
