That the Caldwell City Council, following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON22-000003_ (0 N. 2'1s'St.) at a public hearing held this 6th day of October, 2022. Section 2. The parcel is within the City of Caldwell, ldaho and the applicant has requested that said following described property should be rezoned to C-3 (Service Commercial) zone: A parcel of land located in the NE % NW % of Section 26, Township 4 North, Range 3 West, Boise Meridian, Canyon County, ldaho, being further described as follows: COMMENCING at the N % Corner of said Section 26i thence N89'57'02'W, 719.78 feet along the North line of NE % NW % of Section 26, from which the W 1/16 corner of said Section 26 bears N89"57'02'W, 613.32 feet; thence S00"02'02"E, 213.83 feet to the POINT OF BEGINNING; thence continuing S00'02'02"E, 209.00 feet to a point on the northeasterly right-of-way line of Commercial Way; thence N42"28'41"W, 69.34 feet along said northeasterly right-of-way line; thence continuing on said northeasterly right-of-way line N42"28'25"W, 101 .69 feet; thence from a tangent which bears N42"35'00'W, along a curve to the right with a radius of 35.01 feet and having a central angle of 94'45'34", an arc length of 57.90 feet with a chord bearing N04'47'47"E, 5'1.53 feet to a point on the southeasterly right-of-way line of North 21st Avenue; thence along said southeasterly right-of-way line from a tangent which bears N52'12'M"E, along a curve to the right with a radius of 680.18 feet, having a central angleof 04'38'01", an arc length of 55.01 feet with a chord bearing N54"31'05'E, .99 feeti thence S89'38'32"E, 66.28 feet to the POINT OF BEGINNING. Contains 0.375 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, ldaho, are hereby instructed to so designate the same above described property on the official zoning map and other aree maps of the City of Caldwell, ldaho as C-3 (Service Commercial) Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. A parcel of land loc€ted in the NE % NW % of Section 26, Township 4 North, Range 3 West, Boise Meridian, Canyon County, ldaho, being further described as follows: CoMMENCING at the N % Corner of said section 26; thence N89"57',02'W, 719.78 feet along the North tine of NE %NW % of Section 26, from which the W 1/16 corner of said Section 26 bears N89'57'02"W, 613.32 feet; thence SOO"O2',O2"E, 213.83 feet to the PoINT OF BEGINNING; thence continuing soo.o2'02"E, 209.00 feet to a point on the northeasterly right-of-way line of commercial way; thence N42"28'41'W, 69.34 feet along said northeasterly right-of-way line; thence continuing on said northeasterly right-of-way line N 42"28'25"W,101.69 feet; thence from a tangentwhich bears N42'35'00'W, along a curve t;the righiwith a radius of 35.01 feet and having a central angle ol 94"45'34", an arc length of 57 90 feet with a ciord bearing NO4'47'47"E, 5'l .53 feet to a point on the southeastedy right-of-way line of North 21st Avenue, thence along said southeasterly right-of-way line from a tangent which bears N52'12'04"E, along a curve to the right with a radius of 680.18 ieet, having a central angleof 04'38'01", an arc length of 55.01 feet with a choid bearing N54'31'05"E, 54.99 feet; thence S89'38'32"E, 66.28 feet to the POINT OF BEGINNING. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as C-3 and providing an etfective date, which shall be when published in the ldaho Press Tribune on the 11!h day of Octoblr, 2022. O.d,ir|ance No.3424 was passed by the Council and approved by the Mayor on the 6th day of October, 2022.
