COIIRSE OF PROCEEDINGS
The Caldwell Commrmity Development Departuent issued a notice of public hearing on
application SIIB-33F-99 (Silver Bow Estates, Phase 2) to be held before the Planning and Zoning
Commission on April 22, 1999. Public notice requirements set forth in Idaho Code, Chapter 65,
Local Planning Act, were met. On April 5, 1999 notice was published in the Idaho-Press
Tribune; on April 5, 1999, notice was mailed to a1l property owners within 300 feet of the project
site and to all political zubdivisions providing services to the subject property; and, on April 15,
1998, norice was posted on the site.
Files and exhibits relative to this apptcation are available for review in the Community
Development Deparment, Caldwell City Hall, and will be available for review at the hearing.
II GENERALFACTS

2.3 PROPOSAL: fhs AFplicant seeks final subdivision plat approval of 60 lots developed on
approxjmately 8.36 acres located in an R-l zone. (See copy of Plat)

BACKGROTIND INFORMATION: Silver Bow Estates, a Planned Unit Development, received
preliminary plat approval on October 17 , 1996. On March 3, 1997, Cily Council approved final
plat approval ofPbass 1. final plat approval ofPhase 2 will complete the project.
2.5 LOCATION: At the western boundaqr of Silver Bow, Phase 1. Silver Bow, Phase 1 is located on
the west side of Monta::a Avenue, approximately one-fourth mile north of Homedaie Raod.
2.6 LEGAL DESCRIPTION: A part of the NE 7+ SW %, Section 3, Township 3 Nort}, Range 3
West, B.M.
2.7 NATURAL RESOLIRCES AND HAZARDOUS AREAS: The project site is not within the near
vicinity of the Boise River or Indian Creek, and is not within a floodplain.
2.8 LAND USE: The project site is zoned R-1. The site is bordered on all sides by City R-1, with the
exception of County Ag on the north.
2.9 COMPREHENSM PLAN DESIGNATION: Low Density Residential

2.9.1 Low Density Rgsidential is defined as "suitable primarily for single-family residences. Other
uses characteristic of lowdensity residential areas such as churches, schools, neighborhood parks,
comparable public facilities and essential utility installations are appropriate. The residential
density is from I to 6 dwelling units per net acre."
2.10 AREA OF CITY IMPACT: The project site is not within the Arca of City Impact.
2.I I PUBLIC FACILITIES:
2.1 l.l Schools - Caldwell and Vallivue School Disricts were notified of the request for final plat
approval on April 5, 1999.
2.11.2 Fire Protection - All conditions placed on the preliminary plat by the City's Firc Marshall have
been met.
2.1 1.3 Utilities - Water/Sewer - Domestic water and sewage disposal is provided by the City's water and
sewage facilities.
2.11.3 Inigation - Pioneer Irrigation District was notified of the request on April l, 1999 for fi"al plat
approval.
2.11.8 Financial Guarantee - Gordon Law, in a memorandum dated April 8, 1999 noted that he has no
objection to final plat approval but that some ofthe construction items have not been completed.
The Applicant has informed planning staff that an engineer's estimate of costs and tlpe of
financial guarantee will be submitted to Mr. Law prior to the P&Z hearing
7.12 TRANSPORTATION: Access to the lots are from Flint Drive, Graycliff Drive, Cold Creek
Drive, and Broadview Way, which interconnect with Silver Bow, Phase l. The interior skeets of
Silver Bow, Phase 1 interconnect with Montana Avenue.
2.t3 PARKS. RECREATION AND OPEN SPACE: All of the common/recreational areas are located
within Phase 1, which was recorded in 1997.
2.14 HISTORIC AREAS: This prolr, ty is not within the City's area of historic significance
7.15 HOUSING: The project provides 60 residential lots. Single-family dwellings are permitted
outight in an R-l zone; duplexes Day be pemitted through the special use permit's public
hearing process.
2.16 COMMLINITY DESIGN: The proposed project will be accessed by interior public streets that
interconnect with Montana Avenue, which is classified as a minor arterial.

The Engineering Departrnent has completed a walkthru of Silverbow Estates Phase 2
Subdivision. Earl & Associates has completed a final punch list that is acceptable to the City of
Caldwell.
The final bond amount will be calculated based on the "Engineers Opinion ofCost", which is
attached. The Engineering Department will require a letter of credit equal to the final bond
amount prior to signature of the final plat.
