1, W. Ash Street and Sunset Avenue rights of way shown hereon are dedicated to the public for public
use.
2, Direct lot access to W. Ash Street is prohibited unless specifically allowed by the City of Caldwell.
3, Any resubdivision of this plat shall comply with the applicable zoning regulations in effect at that time.
4. Lot 1 Block 1 is a common area lot for landscaping and is to be owned and maintained by the Sunset
Subdivision Homeowners Association. Lot 1 Block 1 also is to have a utility blanket easement
5, Lot 2 Block 1 is a common area lot for storm water detention and is to be owned and maintained by
the Sunset Subdivision Homeowners Association. Lot 2 Block 1 also is to have a blanket utility
easement.
6, Lot 10 Block 1 is a common area lot for a Private Pressure Irrigation Pump Station and is to be owned
and maintained by Sunset Subdivision Homeowners Association. The Landscaping of said lot will be
maintained by the Sunset Subdivision Homeowners Association. The Pressure Irrigation Pump Station
and piping will be maintained by Sunset Subdivision Homeowners Association. Lot 10 Black 1 also is to
have a blanket utility easement.
7. Per the City of Caldwell, Lots 1 through 10 Block 1 have a 35.00 feet wide inigation easement for the
Hoshaw Drain.
8, Irrigation water has been provided from Pioneer Irrigation District. in compliance with Idaho Code
31-3805(b). Lots within the subdivision will be entitled to irrigation water rights, and will be obligated for
assessments from Pioneer Irrigation District.

10, Per the record deed, the north boundary goes out to section line with no rlw take. recorded plat
shows a 25' rlw dedication. The Boundary of this plat follows the deed of record.

OWNERS CERTIFICATE
We, Shepherd Redevelopment, LLC being first duly sworn, depose and say that we are the owners of SUNSET SUBDIVISION more
particularly described in the legal description below, state that it is our intention to include said property in this subdivision plat, and
that we do for ourselves, our heirs, transferees, successors and assigns, do hereby dedicate, donate and convey to the public forever
the public streets shown on this plat as W. Ash Street and Sunset Avenue. The easements as shown on this plat are not dedicated to
the public, but are intended only for the right and purpose as designated within this plat and no permanent structures other than those
for utility, irrigation or drainage purposes is to be erected within the limits of said easements. The individual lots described in this plat
will be provided domestic water by the City of Caldwell, compliant with paragraph 1, section 50-1334 of the Idaho Code.
SUNSET SUBDIVISION is a portion of Tracts 31 and 33 of "The Pioneer Subdivision" as on file in Book 4 of Plats at Page 52 in the
Office of the Recorder of Canyon County, Idaho, said Tracts located in the SW 114 SE 114 of Section 28, Township 4 North, Range 3
West, Boise Meridian, Caldwell, Canyon County Idaho, more particularly described as follows:
Commencing at a found 3 inch diameter Canyon County Surveyor brass disk marking the NW corner of said SW 114 SE 114, (center
south 1116 corner), said corner bears N. 0017' 53" E., a distance of 1322.36 feet from a found 3 inch diameter aluminum disk marking
the SW corner of said SW 114 SE 114, (south 114 corner);
Thence along the northerly boundary of said SW 114 SE 114 and along the centerline of W. Ash Street, S. 89 23' 56" E., a distance of
514.02 feet to a found 5l8 inch diameter iron pin marking the POINT OF BEGINNING;
Thence continuing along the northerly boundary of said SW 114 SE 1l4 and along the centerline of said W. Ash Street,
S. 89 23' 56" E., a distance of 148.00 feet to a found 518 inch diameter iron pin marking the NE corner of said Tract 31;
Thence along the easterly boundary of said Tract 31, S. 00 22' 08" W., a distance of 330.33 feet to a found 518 inch diameter iron pin,
said pin being the NW corner of said Tract 33;
Thence along the northerly boundary of said Tract 33, S. 89 24' 35" E., a distance of 166.24 feet to a found 518 inch diameter iron pin;
Thence S. 00 41' 48" W., a distance of 132.43 feet to a found 518 inch diameter iron pin;
Thence S. 00 26' 29" W., a distance of 197.98 feet to a found 518 inch diameter iron pin marking a point on the northerly boundary of
Sylvan Manor as on file in Book 15 of Plats at Page 24 in the Office of the Recorder of Canyon County, Idaho and the southerly
boundary of said Tract 33;
Thence along the northerly boundary of said Sylvan Manor and southerly boundary of said Tract 33, N. 89 25' 14" W., a distance of
233.23 feet to a point marking the centerline extended of the Hoshaw Drain, said point witnessed S. 89 25' 14" E., a distance of 30.88
feet with a found 5l8 inch diameter iron pin;
Thence along the centerline of said Hoshaw Drain, N. 35 21' 35" W., a distance of 137.00 feet to a point, said point witnessed N. 78
45, 44" E., a distance of 38.35 feet with a found 518 inch diameter iron pin;
Thence continuing along the centerline of said Hoshaw Drain, N. 00 22' 08" E., a distance of 549.91 feet to the POINT OF
BEGINNING.
SUNSET SUBDIVISION contains 3.39 acres more or less.
SUBJECT TO: All existing rights of way and easements of record or implied appearing on the above -described parcel of land.
