Case No. SUB-24F(2)-99, a request by Gem Star Properties for final subdivision plat approval ofAshton Hills
Subdivision No. 2. The final plat consists of 56 residential lots and is located within an R-l (Single-Family
Residential) zone. The site is located adjacent to the south side of Ashton Hills Subdivision No.1, which is
adjacent to the south side of Ustick Road, east of Lake Avenue.
Case No. SUB-22P-98, a request by V.E. Graves & Sons for an additional one year extension of the
preliminary plat approval of Sunset Manor, a planned unit development consisting of 12 lots located on
approximately 3.3 acres within an R-l zone. The site is an extension ofSunset Avenue; Sunset Avenue in this
vicinity interconnects with Linden Street.

Preliminary Plat
The Engineering Department provides the following comments on the referenced
preliminary plat:
l DEVELOPMENT PLANS-priorto submittal of the final plat, plans must
be prepared by the developer's engineer and approved by the City's
Engineering Department, which includes the following items:
a. Street section and alignment (including curb and gutter)
b. Sidewalk (4' width on the extension of Sunset Ave.)
c. Sanitary sewer (per City and DEQ requirements)
d. Potable water (per City and DEQ requirements)
e. Storm waters (per Engineering D€partment requirements)
f. Sreet lighting (must meet Idaho Power design standards plus conform
identically to the lamp, ballast and sensor switching equipment used
by Idaho Power)
g. Street signage (per City and MUTCD requirements)
h. Irrigation system ( per Pioneer lrrigation District requirements)
2. The dweloper is to employ a responsible design professional, preferably
the engineer ofrecord" to oversee and inspect construction, to perform
and/or observe all requisite testing ofcompleted facilities, and to certifu
that improvements have been constructed according to approved plans and
in compliance with applicable City, State, and Federal Standards.

3. Before commencement of construction in any dedicated right-of-way or
construction of ary improvement intended for dedication to the City, the
City Engineering staff is to be notified. This preferably will take place in
a pre-mnstruction conference scheduled by the engineer-of-record, in
which all appropriate personnel and utilities are present. Appropriate city
personnel are to be notified in advance ofall testing (including
compactioq pressure, and colifornr, etc.) and given opportunity to be
present during conduct oftlte tests. The engineer-or-record, or his
designated representative, is to witness all tests, and log ofinspection
visits and testing results is to be kept by the engineer-of-record or his
representative.
4. As noted previously, provision is to be made for the disposal of storm
water drainage in accordance with the Engineering Department's Storm
Water Policy. A copy of this policy is available uPon request. The
engineer-of-record is to provide calculations that indicate the assumptions
in his storm drainage plan comply with the Engineering Department's
Storm Drainage Policy. For any off-site discharge to live irrigation water,
written approval from the agency responsible for the receiving water body
is required before final plat approval.
5. The development is to include a pressure irrigation system. The design of
this pressure irrigation system is to be reviewed and approved by Pioneer
Irrigation District and a letter obtained indicating their approval ofthe
design. The design ofthe system is to give due consideration to any
upstream drainage rights and downstream irrigation rights that are affected
by the pressure irrigation system. This letter of approval must be
completed and submitted to the City before final plat approval.
6. The easements shown on the preliminary plat comply with the subdivision
ordinance with the exception ofa sideJot easement between "a" and "b"
lots. The development is submitted as a planned unit development, under
th€ premise that townhouses will placed on the lot, and that zero lot lines
are needed. The Engineering Department has no objections to the zero lot
lines without easements in this instance.
7. All stree! sewer, water, fire protectiorq and streetlight facilities must be
dedicated to the City. Some conveyanc€ facilities for stonn water
drainage may be eligible for dedication to the City. The landscaping in the
street island is to be maintained by the homeowners association and is not
to be dedicated to the City nor made a responsibility of the City. The City
also reserves the right to remove the landscaped island if the area is not
properly maintained.

8. Upon recordation ofthe final plat, the Engineering Department is to be
provided a reproducible copy, suitable for blueJine reproduction
9. Prior to approval of the final plat, subdivision facilities must be completed
or appropriate construction security provided. There may be temporary
restrictions to obtaining building permits, even with acceptable
construction security, depending on fire protection and emergency service
requirements. All facilities must be complete before allowing occupancy
in any residence.
The previous comments are generic in nature and are submitted with all
subdivisions. The following comments are specific to the preliminary plat
documents submitted with this application:
l. The southerly easement for Lot l-A ofBlock lis designated as l0' in
width. The Engineering Department would request that a 15' easement be
provided to allow for future storm drain construction. It is not to be the
developer's obligation to construct this drain.
2. The Engineering Department requests that the developer confer with the
property owner North and East ofhis development to see ifthat property
owner would be interested in constructing curb, gutter, and street widening
in connection this project. The obligation and cost for constructing curb
and gutter and street widening on the neighbor's side does not belong to
this developer.
3. Note #4 refers to the storm water detention area in Lot 5 and Block 2. The
Engineering Department requests that a statement be added to this note
indicating that the storm water detention facility including discharge
structures is to be perpetually maintained by the homeowners association
or by the property owner oflot 5.
4. Note #6 refers to the pressure irrigation system for the development. The
Engineering Department requests that the note be expanded to include a
statement that the design ofthe irrigation system must have the approval
of Pioneer Irrigation District.
5. Note #12 refers to an easement being provided for the Hoshaw drain. The
Engineering Departmeft requ€sts that the note be expanded to include a
statement that the easement be provided before improvement plan
approval and construction.

6. The Engineering Department wishes to inform the Planning and Zoning
Commission that this preliminary plat was prepared largely in
conformance with previous Engineering Department comments. The
developer and his engineer have request€d that Sunset Ave. not be opened
to W. Ash St.. The Engineering Department had responded that we would
accept not opening Sunset Ave. at this time, but that the right-of-way
should be provided. The developers complied with that request' The City
will not open Sunset Ave. unless traffic diclated the need for its opening.
Also, note tlnt the Engineering Department had expressed some objection
to the landscaped island in Sunset Ave. The dweloper's engineer has
responded by realigning the approach to the island in a way that will be
less confusing to traffic flow pattems. The Engineering Department
appreciates very much the developers and the engineer's willingness to
discuss with them the issues before submittal to the Planning and Zoning
Commission.

Dear Ms: James:
The Bureau of Reclamationrs Hoshaw Drain lies partially within
this proposed subdivision. This federal drain provides essential
storm water drainage of this Caldwell neighborhood. This drain
was constructed and is maintained under authority of the Act of
August 30, 1890. That act reserved in the patent for lands that
left the public domain after that date, t'...a right of way
thereon for ditches or canals constructed by the authority of the
United Statesrt (26 Stat. 39L; 43 U.S.c. 945). The PioneerIrrigation District is contracted to operate and maintain the
drain within this right of way.
Per your conversation with John caywood of my staff, hle assertthis right-of-way extending 35 feet from the drain centerline.
The approved plat should shohr thls.
