ORDINANCE NO. 3424
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE C-3 (Service Commercial) ZONE; DETERMINING THAT SAID CHANGE IN ZONING
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING
THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON
THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON22-000003 (0 N. 21s' St.) at a public hearing held the 18h day of August,
2022.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to C-3 (Service Commercial) zone:
A parcel of land located in the NE'/. NW'/<of Section 26, Township 4 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, being further described as follows:
COMMENCING at the N '/< Corner of said Section 26; thence N89'57'02"W, 719.78 feet along the North
line of NE Y4 NW '/< of Section 26, from which the W 1/16 corner of said Section 26 bears N89057'02' W,
613.32 feet; thence S00002'02"E, 213.83 feet to the POINT OF BEGINNING; thence continuing
S00002'02"E, 209.00 feet to a point on the northeasterly right-of-way line of Commercial Way; thence
N42028'41 "W, 69.34 feet along said northeasterly right-of-way line; thence continuing on said northeasterly
right-of-way line N42'28'25"W, 101.69 feet; thence from a tangent which bears N42035'00"W, along a curve
to the right with a radius of 35.01 feet and having a central angle of 94045'34", an arc length of 57.90 feet
with a chord bearing N04047'47"E, 51.53 feet to a point on the southeasterly right-of-way line of North 21st
Avenue; thence along said southeasterly right-of-way line from a tangent which bears N52012'04"E, along
a curve to the right with a radius of 680.18 feet, having a central angle of 04038'01", an arc length of 55.01
feet with a chord bearing N54031'05"E, 54.99 feet; thence S89'38'32"E, 66.28 feet to the POINT OF
BEGINNING. Contains 0.375 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as C-3 (Service Commercial)
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3424
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as C-3 (Service
Commercial).
A parcel of land located in the NE % NW % of Section 26, Township 4 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, being further described as follows:
COMMENCING at the N % Corner of said Section 26; thence N89057'02"W, 719.78 feet along the North
line of NE '% NW '% of Section 26, from which the W 1/16 corner of said Section 26 bears N89°57'02"W,
613.32 feet; thence S00°02'02"E, 213.83 feet to the POINT OF BEGINNING; thence continuing
S00002'02"E, 209.00 feet to a point on the northeasterly right-of-way line of Commercial Way; thence
N42028'41"W, 69.34 feet along said northeasterly right-of-way line, thence continuing on said northeasterly
right-of-way line N42028'25"W, 101.69 feet; thence from a tangent which bears N42035'00"W, along a curve
to the right with a radius of 35.01 feet and having a central angle of 94045'34", an arc length of 57.90 feet
with a chord bearing N04047'47"E, 51.53 feet to a point on the southeasterly right-of-way line of North 21 st
Avenue; thence along said southeasterly right-of-way line from a tangent which bears N52012'04"E, along

BEGINNING. Contains 0.375 acres, more or less.
The Ordinance includes a provision to amend the official maps of the City by designating the above -
described property as C-3 and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 23rd day of August, 2022. Ordinance No. _3424_ was passed by the Council and
approved by the Mayor on the 181h day of August, 2022. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the foregoing
summary for publication pursuant to Idaho Code 50-901A on the 18'h day of August, 2022.
