The Engineering Department does not oppose the request by Retail Development of North
America for annexation of approximately 59.68 acres into the City with an R-1, C-1 and C-2
designation. The site abuts Karcher Road and Florida Ave. However the Engineering Department
does provide the following list of comments concerning future development of this site:
Riqhts-of-Wav
Florida Ave is classified as a Collector. The applicant shall be required to dedicate as
public right-of-way a thirty-three (33) foot one half width right-of-way along the Ftorida Ave
frontage if not already present to meet City of Caldwell requirements.
2. Karcher Road is classified as a Principal Arterial and State Highway The applicant shall be
required to dedicate as public right-of-way a seventy (70) foot one half width right-of-way
along the Karcher Road frontage if not already present to meet City of Caldwell
requirements. Future development shall require an additional thirty (30) foot setback
adjacent to the dedicated seventy (70) feet right-of-way to facilitate future righlof-way
needs per ldaho Department of Transportation Department recommendations.
Street
1. Future development will require adherence to the City's lnfrastructure lmprovement Policy.
Construction of curb, gutter and sidewalk improvements will be required in accordance
with City standards.
Sewer & Water
1. Future development will require the applicant to connec{ to the City of Caldwell Municipal
Water System and comply with the City of Caldwell Water Master Study.
2. Future development of any parcel will require the applicant to connect to the City of
Caldwell Municipal Sewer System and comply with the Dixie lnterceptor Sewer Study,
including updates.

1. Future development of the site will require compliance with the City of Caldwell Storm
Water Management Policy.

1 . lrrigation water for any and all landscaping shall be obtained from applicable lrrigation
District sources. City municipal water may be used only if the criteria specified in the
Landscape Ordinance Section 10-07-12 are met.
1, The Applicant will maintain the site in keeping with the City's nuisance abatement
program until such time as the development occurs. This maintenance will include the
semi-annual mowing of all weeds within the subdivision boundaries and the removal of
noxious weeds when they are identified. The developer will apply all appropriate dust
abalement procedures as part of the construction process.
2. The Applicant shall develop the site in keeping with provisions of the City's Landscaping
Ordinance No. 2428 and Tree Ordinance No. 2437.

Brown Bus Company would request on behalf of Valliwe School District that all new
subdivisions be designed with dedicated areas within the subdivision for multiple bus
stop locations. Valliwe School District has a policy that no student living within a
subdivision should be required to walk more than 3/1Oft ofa mile to there desigrated bus
stop. These areas should be offof private property owrer's property and be every 3/l0u
of a mile within the subdivision. These dedicated areas should be lighted and large
enough for 20-25 students to congregate.
Any subdivision being built within 1-% miles to an existing school building should have
a lighted sidewalk or walking path to the school. Under Idaho code any student living
within t-% miles ofa school are not eligible for bus transportation. These student need
to have a safe walking path to get to and fiom school.

We have reviewed the Transpo(ation knpact Study (IIS) prcpared by Kittelson & Associates for the
Sawgrass Village development. We agree that this development will have a significant impact on the
interiection ofsH 55 and Florida Ave. As a condition ofplat approval we are requesting that the
city of caldwell require the developer to install a trafEc signal at the intersection ofSH 55 and
Florida Ave;. along with roadway widening thal includes a southbound left tum lane and a
westbomd right tum lane. The two direct access points on to SH 55 are in a Type [V access control;
access in this-type ofcontrol will need to be applied for at the district level and approved or denied
by our executive committee. Any and all work to be done within the right ofway requtes a P€rmit.
Permits can be obtained through our permit agents. Please have the developer contact Matt Ward

The ldaho Transportation Department (lTD) appreciates the opportunity to comment on the
above relerenced application. Perthe city's December 1 notlce (dated October24,2005)
regarding the applicant's request to annex 59.68 acres of property located on Karch€r Road
(State Highway 55) near Florida; ITO asks the City of Caldwell to consider the following as
conditions of approval:
General Comments:o This property is located adjacent to SH-55. This segment of SH-55 highway is a regionally
significant Principal Arterial, which serves as an important connection for commerce
between US-95 and l-84.o Access management on this highway is implemented through th€ ITD Access Control
Policy.o The applicant has requested annexation and a significant change in the type and intonsity
o, use for the referenced property.o ITD recognizes highway widening is necessary. Unlortunately we have no funds for right of
way acquisition, or construction lunding programmed in the next five years. Th€ City
should ksep this in mind while approving annexations.
Site speclllc comments:o The development design, as shown in the Preliminary Plat meets current ITD Access
Management Policy for State Highway 55.
We ask the City ol Caldwell to consider the lollowing as conditions of approval:
Setbacks. The applicant should provide for a setback of 100' from the centerline of the existing
right of way to accommodate the luture expansion oI the corridor to lour lanes.
Traffic lmpact Study. The applicant should complete a Traflic lmpact Study (TlS) to
determine development impacts to tho State Highway. ITD may require improvements to the
State Highway to mitigate for these impacts. Typical improvements may include: acceleration
and deceleration lanes, center turn bays and/or intersection signalization. The TIS should be
submitted to K€vin Sablan at the ITD letterhead address. Work in th€ Right of Way requires a
permit. You may contacl Matt Ward at the number below.
Noise Abatement for Residential Development. Should the development include
residential buildings, please require the following:

1. The applicant shall provide tratfic noise abatement by constructing a berm or a berm and wall
combination approximately parallel to the state highway and ofl the state right oI way.
2. The top of the berm, or berm and wall in combination, shall be a minimum of ten leet higher
than the elevation at the centerline of the state highway.
3. ll a wall is proposed, the wall shall meet the following standards:
a. Wall materials shall be impervious concrete or stucco, unless otherwise approved by
the ldaho Transportation Department as a sound attenuating material.
b. lntermittent breaks in the berm or berm and wall in combination will degrade the
function and should not be allowed.
4. Alternative noise abatement designs that meet Federal Highway Administration guidelines
may be proposed by the developer. The applicant should contact Greg Vitley, Environmental
Section Manager.
Work on the State Hlghway. A permit will be required for any work on ths highway. See contact below.

Canyon Highway District No. 4 has reviewed the above referenced subdivision and annexation request
and provides the following comments:
I . Tralfic Impacts. The District is concemed about the impacts of the proposed development on
the surrounding road network. ln particular, the District is concerned about the impacts on the
inGrsections of Karcher Road (Hwy 55) & Florida Avenue and Homedale & Florida- A traffic
impact study should be required for the project to assess the impacts ofdevelopment on the
surround roads and streets and recommend mitigation measures. The development agreement
should include a provision that tlre developer contribute a proportionate share, based on tlre
volume of traffic contributed by the development, ofthe cost ofany traffic mitigation (i.e. traffic
signals and intersection improvements) at locations impact by this development that will be
completed later.
2. trloride Avenue Fmntage Improvemen$. A 40' right-of-way dedication along Florida Avenue
is required. T}e frontage shall be improved to meeting the City of Caldwell's arterial sheet
standard, except that surfacing depths shall meet the Highway District Standards.

Pioneer lnigation District's main concem is that all waler rights wilhin the Dir;trict be honored, and that
access to inigation water be provided to every parcel of land. Delivery point for said property is
gat6 83 - Phyllis Canal.
Atl existing easemenb, right-of-ways, and other means used to honor the water r(]hts to
downstream wateruserE must be maintained and allowed to continue to exist. lt is imperative that no
one disrupt the delivery of water to a downstream waler user.
Any lateral, canal, drain or other means used to deliver water, along whiclr there is a right-of-way or
easement, must have the same kept olear of all obslructions at all times. No fences, structures, or
other materials are allowed on any of the District's easements or rEht'of-ways AND they must be
recorded on the final plat. The Phyllis Canal has a 20 foot prescriptive ulse easemonl from top of
bank, both sides. The Peterson Lateral has a 16 foot from top o1i bank prescriptlve use
easemGnl, both sides.
Any discharge or rurroff into a federal drain must meet the approval of lvlr. John Cayr,vood of the
Buieau of Riclamation. Pioneer lrrigation District does not assume any responsibility for such an

Please be advised that in order lo satisfy the City of Caldwell and Canyon County requirements and
lF it is the intent of the developer to pul in a pressurized inigation system and have Pioneer take over
said system once the development is completed, the following steps are neaessery:
1 . Said system must be put in according to the cunent Standards and Specifications of
Pioneer lnigation District.
2. A Construciion, Operation and Maintenance Agreement must be written up and recorded
at the expense of the Develop€r andlor owner. All agreements must be reviewed by and
approved by the District's Attorney, Scott Campbell, of Moffatt Thomas in Boise. The
least expensive way to have an agreement drawn up which meets the needs of the District
is by having Mr. Campbell himself draw it up. Otherwise there vvill be two attomey fees for
said developer and/or owner to pay. Mr. Campbell may be centacted at 345-2000. A
deposit of $1000.00 must be paid to Moffatt Thomas to cover the attomey fees before the
work can begin. Any unexpended portion of the deposit will be refunded. Pioneer
lnigation District will remmmend disapprovai of final plat apF,roval until the necesoary
agreement has been executed and recorded.
3. The engineering fees will be the responsibility of the developer and/or owner, and a
deposit must b€ paid in advance to Pioneer lnigation District before the District will
authorize Earl Mason & Stanfield to review engineering plans. Plans must be received
by Pioneer lffigation District by December't5th 2005. All r:onstruction whlch may
impact district facilites must be completed prior to the March 156 zoOG deadline.
The construction time-frame which Pioneer allows is November 'l"t of the current
year to March 15th of the following year. Estimated costs for the District's engineering
fees are $500 plus $5.00 per lot. lf that amount fails to cover the costs involved due to the
nscessity to revise plat maps, etc., additional oosts will
be billed out and paid prior to the District's signing off on the final plat.
4. lf it is the developers plan to have Pioneer lnigation District take ,:ver a pressurized
inigation system for the subdivision, it will be necessary that the pump site be designed at
the District's current point of delivery. Service to the subdivision ffitm the pump site must
have its own private delivery line from the delivery point to the subdivision.
5. The developer must contact the office of Ead Mason & Stanfield to make aftlngemenk
for on-site inspections to be made al various points of constnlc'tion. An engineer from
Earl Mason & Stanfield must be involved in the inspeclions as they are the engin€ers for
Pioneer lrrigation Distficl ard are familiar with the requirements of Pioneer.
6. Earl Mason and Stanfield must walk through the site and develop a punch list to be
completed prior to recommending that Pioneer lnigation District take over the pressurized
inigation system.

lf it is NOT the intent of tho developer to reguest Pioneer lnigation Dlstrict to take over a pressurized
irrigation system within their completed development, then the above six steps do not apply to their
planned development.
Any proposed development which will have downstream waterusers using gravity flow inigation must
develop their inigation system in a manner which will insure the downstream waterusers the ability to
acquire at least as much inigation water for gravity flow irrigation as what they received prior to any
development or mnstruction taking place. The gravity flow irrigation systent must be totally separate
from the proposed pressurized inigation system within a subdivision.
Please be advised, the developer shall submit detailed drawings of any proposed relocations of
Pioneer lnigation Distrlct's facilities, prior to preliminary plat approval. Any said relocations are
subject to appoval from the Superintendent and/or the Board of Direclors of Pioneer Inlgation District
Any construction that impacts Waters of the United States may require obtaining a 4O4 permit from
the Corp of Engineers. Greg Martinez of the Corp of Engineers can be contacted al34'5-2154.
Prior to linelization of any Agreements with Pioneer lrigation Districl, Pioneer lnigation District must
receive a copy of a 404 permit that has been properly executed. lf il is determined by the Corp of
Engineers that a 404 permit is not required, Pioneer lrrEation District must be notified in writing by the
Corp of Engineers that said 4M permit is not reguired.
NOTE: This letter does not authorize any construction to commonce until all the necessary
agrE€menls with Fioneer lnigation District have boen executed and ret:orded.
