BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 12, Article 1, Section 12-01-05, entitled "FEES," is amended, as follows: 12-01-05: FEES: From and after July 21, 1979, applicants for constructing, repair or remodeling of any building or structure shall pay to the building official fees established by the building official by rules and regulations subject to approval by the City Council. The calculation of fees shall be based on the valuation of proposed work. If, in the opinion of the building official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official. Final building permit valuation shall be set by the building official. (1) Refunds: Before commencement of any construction regulated under the issuance of a valid permit, the building official may authorize the refunding of no more than eighty percent (80%) of building permit fees paid, when requested in writing by letter or form, and all rights granted by the permit are terminated. Plan review fees and deposits shall not be refundable. Section 2. That Chapter 12, Article 1, Section 12-01-21, entitled "Amendments to the International Building Code, International Residential Code, and International Energy Conservation Code," is -amended, as follows: 12-01-21: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL ENERGY CONSERVATION CODE: IRC R108.3 Building permit valuation is amended to read "The application for a permit shall provide an estimated permit value at the time of application. Permit valuation shall include total value of work, except when such work will form the basis for the valuation of a different permit. If, in the opinion of the building official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official. Final building permit valuation shall be set by the building official" IBC 109.3 Building permit valuation is amended to read, "The application for a permit shall provide an estimated permit value at the time of application. IBC section 109.4; IRC section R108.6, "Work Commencing Before Permit Issuance" is amended to read as follows: Any -person who commences any work on a building or structure before obtaining the necessary permit, shall be subject to an investigation fee in the amount established by the building official up to quadruple of the permit fee. Investigation fees shall be in addition to the required permit fee. IBC table 2902.1, "Footnote G" is amended to read: "g. For business occupancies, excluding restaurants, and mercantile occupancies with an occupant load of thirty (30) or fewer, service sinks shall not be required." IBC table 2902.1, add the following "Footnote H" to read: "H. For infill hangars constructed which are immediately adjacent to at least two (2) existing hangars and for which no water and sewer service is already available, which hangars would normally governed as "storage" above, no Water Closets, Lavatories, Bathtubs/Showers, Drinking Fountains, or Service Sinks shall be required." Add the following as Section C101.5.2: C101.5.2 Industrial, electronic, and manufacturing equipment. Buildings or portions thereof that are heated or cooled exclusively to maintain the required operating temperature of industrial, electronic, or manufacturing equipment shall be exempt from the provisions of this code. Such buildings or portions thereof shall.be separated from connected conditioned space by building thermal envelope assemblies complying with this code. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 5. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 7'h day of July, 2022. ATTEST: Mayor Jarom r City Clerk (or Deputy) ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3404 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 12, ARTICLE 1, SECTION 12-01-05, CALDWELL CITY CODE, PERTAINING TO FEES FOR BUILDING PERMITS; AMENDING CHAPTER 12, ARTICLE 1, SECTION 12-01-21, CALDWELL CITY CODE, PERTAINING TO AMENDMENTS TO THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL ENERGY CONSERVATION CODE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. Section 1: Amends Chapter 12, Article 1, Section 12-01-05, Caldwell City Code, by allowing additional discretion for the building official to set building permit fees. Section 2: Amends Chapter 12, Article 1, Section 12-01-21, Caldwell City Code, by providing for additional discretion for the building official to set building permit fees, and by creating a special provision related to infill hangars constructed at airports. Sections 3 through 5: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3404 provides an effective date, which shall be on the 12th day of July, 2022. Ordinance No. 3404 was passed by the Council and approved by the Mayor on the 7' day of July, 2022.
