CITY OF CALDWELL
Due to the COVID-19 pandemic, we invite interested parties to participate in public hearings either electronically or
in person. If you have a cough, fever, or are not feeling well, please contact Planning & Zoning staff to arrange
participation remotely. The City of Caldwell follows the CDC guidelines to allow for distancing in the public
meeting area and provide masks/hand sanitizer on site.
Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During
the registration process, you will be asked what item on the agenda you wish to speak about. Please use the case
number as listed within the written notice.
On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public
meetings” button on the center of the page. After registration, you will receive a confirmation email containing
information about joining the virtual meeting. REGISTER HERE: https://www.cityofcaldwell.org
Written comments must be received at least eight (8) days in advance of the meeting to the Planning & Zoning
Department at P&Z@cityofcaldwell.org to be included within the staff report. All comments received after the staff
report has been transmitted will be included in the case file and provided as late exhibits at the appropriate public
hearing.

Review of Proceedings
I. CONSENT CALENDAR:
1) ACTION ITEM: Approve minutes of the April 12, 2022 Planning and Zoning
Commission Meeting.

III. NEW BUSINESS:
1) ACTION ITEM: Case Number AMD-22-03 (Remove from agenda. This case will be
renoticed as a partial vacation of the Plat VAC-22-01): A request by Sawtooth Law
Offices, PLLC to vacate plat notes referencing common lots and common lot ownership
requirements as set forth in Idaho Code §50-1306A and Caldwell Municipal Code §11-
06-01 to allow for the common areas within said plats to be lot line adjusted and deeded
to the adjacent properties for individual ownership and maintenance of the street
landscape buffer areas. This application request affects Sky Ranch Business Center
Subdivision plats and replats Phases 1-3 where notes reference common lots and
ownership requirements. The properties are located south of Hwy 20/26 and along Smeed
Parkway, Caldwell, ID.
2) ACTION ITEM: Case Number ANN22-000006: A request for annexation of
approximately 1.74 acres inclusive of three strips of land, parcels R34089010C (0.59 ac)
and R34090010 (1.08 ac) R34089010B (0.07 ac) lying adjacent to Mandalay Ranch No. 1
and the Mason Creek Drain with a zoning designation of “R1” (Low Density Residential).
The applicant is required to extend and complete the major pathway and landscaping from
the current west termination point to Middleton Road. The subject properties are located
approximately 480 feet north of the intersection of Middleton and Hwy 20/26 on the west
side of Middleton Road.
3) ACTION ITEM: SUP22-000004 AMD-22-02: Nexio Capital is requesting a special use
permit for a 72 unit multi-family development, Celeste Place, on parcel R32764010 west
of Celeste Ave., approximately 3.31 acres currently zoned “R3” (High Density
Residential). The gross density for the proposed project is 21.8 units per acre.
Concurrently the applicant is requesting to amend the existing Development Agreement
applicable to the subject property, Dakota Crossing #3 [ANN-136-06 & SUB/PUD-161P-
06] recorded as instrument #2007025033. The development agreement amendment will
provide for additions/deletions/modifications of conditions specific to the new proposed
development plan.
4) ACTION ITEM: CMP22-000002 ANN22-000005 SUP22-000005: A request by
developer Nexio Capital (Justin Christiansen), to amend the 2040 Comprehensive Plan
Map from Highway Corridor to High Density Residential with a request for annexation of
parcels R32786 & R32785010, 4.95 acres more or less, with an “R3” (High Density
Residential) zoning designation and concurrently a request for approval of a special use
permit for a 96 unit multi-family development with a gross density of 19.39 units per acre.
The subject properties are located on the northeast corner of Celeste Avenue and Karcher
Road at 12492 Karcher Road, Nampa, ID.

Public Information/Responsibility: For public hearing cases that are scheduled to be heard by City
Hearing Bodies and are not heard on the noticed date: The hearing body is required to provide a “date
certain” for when that case will be heard (typically on the next hearing agenda but not always). Additional
notices are not required and are NOT sent to property owners or posted on the site. Please check the
city’s website for agendas and updates or contact staff for the hearing date that the particular case is to be
heard.
Next Special Planning and Zoning Commission Meeting is on August 9, 2022. Any person needing
special accommodations to participate in the meeting should contact the City Office at 208-455-3021 prior
