T0rfl_ P.a1 t t City cf Coldrusll tel: 455-3021 memorondum TO Planning and Zoning Commission Planning and Zoning DepartmentFROM: SUBJECT: Preliminary Plat Extension for Park View Subdivision on property located at the western end of Morrison Street north of Parker Avenue and Sunset Avenue DATE: May 4, 1995 BACKGROUND The Planning and Zorung Commission, on April 7,1994, considered and approved a preliminary plat for the Park View Subdivision involving approximately 5.8 acres which authorized the division of the proeprty into 15 residential lots, 2 common lots, and I lot to be dedicated ot the City for a future neighborhood park site. June 6,1994, City Council approved the final plat for Park View Subdivision. EVALUATION: Section 1l-02-04(6)8 of the Subdivision Ordinance states that approval of a preliminary plat is valid for a period of twelve (12) months from the date of Commission action. There are no clear guidelines contained within the City's Subdivision Ordinance for reviewing preliminary plat extensions. However, the recommendation of the Staffis to review the extension in the context of applying new codes, ordinances, and policies that may have come into effect subsequent to the original approval or adjusting the plat to respond to major changes which have occurred in the surrounding areas. Staffs determination is that there are no new requirements applicable to this plat or significant changes in the surrounding area which may affect the design of the plat. RECOMMENDATION: Approve the Preliminary Plat extension for Park View Subdivision subject to the attached terms 1 t - and conditions. The development concept authorized by the preliminary plat approval consists of the division of 5.8 acres of property in 15 residential lots, 2 common lots for open space and parking, and a 1.25 acre parcel to be dedicated to the City for a future neighborhood park site. More recently, and also in corurection with the proposed development, the City Council authorized the vacation of Morrison Street between Parker and Sunset Avenues. EVALUATION: The final plat of Park View SuMivision has been submitted for the review and approval of the City Council. The Platuring and Zoning Departnent, the Engineering Deparfinent and other affected City departments have reviewed the final plat for Park View Subdivision. It has been determined tlrat compliance with all applicable SuMivision Ordinance requirements and imposed terms of the preliminary plat and the vacation of Morrison Street have or can be satisfied. However, there is one item that warrants additional comment at this time. A private street now provides exclusive access to Block 1 of the SuMivision. Also, common off-street parking is being provided on [,ot 4, Block 1 and on [.ot 5, Block 2. Since these improvements are not pafi of the pubtc right-of-way, there is a question as to their time frame for their construction. tI The Staff is recornrrrending a condition requiring that the improvements associated with [-at 4, Block 1 and [.ot 5, Block 2 be constructed concurrently with the public right-of-way improvements. This item has been discussed with the applicant and is acceptable. RECOMMENDATION: That the City Council conditionally approve the final plat of Park View SuMivision. Suggested conditions include: That the access and off-street parking improvements and requirements associated with I-ot 4, Block 1 and [,ot 5, Block 2 be installed concurrently with construction of street improvements associated with the public right-of-way. 1 I !o City cf Coldrusl!
