SUB-31P(E)-99 POWELL ESTATES PUD BEFORE THE CALDWELL HEARING EXAMINER CITY OF CALDWELL, IDAHO IN THE MATTER OF THE APPLICATION OF PROVIDENGE DEVELOPMENT GROUP, LLC FOR AN ADDITIONAL ONE YEAR TIME EXTENSION FOR PHASE II OF THE PRELIMINARY PLAT OF POWELL ESTATES, A PLANNED UNIT DEVELOPMENT TABLE OF GONTENTS:I COURSE OF PROCEEDINGS,II GENERAL FACTS,!I! TESTIMONY,M APPLICABLE LEGAL STANDARDS,V FINDINGS OF FACT,VI CONCLUSIONS OF LAW,VII ORDER OF DECISION I COURSE OF PROCEEDINGS 1.1 The Caldwell Community Development Department issued a notice of Public Hearing on application SUB-31P(E2)-99, to be held before the Caldwell City Council on September 4,2001. Public notice requirements set forth in ldaho Code, Chapter 65, Local Planning Act, were met. On August 19, 2001 notice was published in the ldaho Press Tribune, and on August 17, 2001 notice was mailed to all property owners within 300 feet of the project site; and, on August 28,2001 notice was posted on the site. 1.2 Files and exhibits relative to this application are available for review in the Community Development Department, Caldwell City Hall, as well as at the applicable hearings. II GENERAL FACTS 2.1 APPLICANT (S): Providence Development Group, LLC, 701 S Allen St. Ste 103, Meridian, lD 83642 2.2 OWNER (S):Alvin Powell, 4706 Lake Avenue, Caldwell, lD 83605 PROPOSAL: Approval of a one-year extension of the phasing schedule approved by Caldwell Hearing Examiner on May 2, 2000 granted to Powell Estates, a Planned Unit Development consisting of 109 residential lots,5 common-area lots, and 4 commercial lots. lncluded in the request was approval of a development agreement that is applicable only to the 4 commercial lots. DEVELOPMENT SCHEDULE: The Applicant received approval for the development to occur in three phases: Phase 1 (55 residential and 4 common lots) to be completed by fall of 1999; Phase 2 (54 residential and 1 common lots) to be completed by summer 2000; and Phase 3 (4 commercial lots) as the market dictated. The approval of a one- year extension of the preliminary plat did move all three phases forward by one year, therefore Phase 2 is to be completed by this summer. The Applicant indicates in his narrative (A-1) indicates the development to be started in the spring oI 2002 and completion in the summer of 2002. o 2.3 2.4 s-l o City of Caldwell Zoning Ordinance No. 1451 City of Caldwell Comprehensive Plan ldaho Code, Title 67, Chapter 65, Local Planning Act o 2.4.1 The approved Development Agreement, which is applicable only to the development of the 4 commercial lots requires the Applicant to complete development of these lots within an 8-year time period (Section \E,2, and Section ll,2b of Agreement). lf build-out has not been completed within the 8-year time frame, the Applicant must request approval of an amendment to the Agreement in order to extend the established time period. The Development Agreement will not be affected by the one-year extension; however, the Agreement does include a clause for amendment. lt development of the 4 commercial lots does not occur within the 8-year time period, the Applicant may seek an extension at that point in time. 2.5 LOCATION: Northeast corner of the intersection of Florida Avenue and Ustick Road 2,6 PUBLIC FACILITIES: 2.6.1 Schools - The Caldwell and Vallivue School Districts were notified of the request through mailing of the public hearing notice on August 17,2001. 2.6.2 lrrigation - The site is within the jurisdiction of Pioneer lrrigation District; the District was notified of the request through mailing of the public hearing notice on August 17 ,2001. 3.1 Reserved !V APPLICABLE LEGAL STANDARDS 4.1 4.2 4.3 V COUNCIL' S FINDINGS OF FACT (this is not a motion but direction on how to make the motion) 5.1 VI statement should be made that the general facts outlined in the staff accepted as Findings of Fact and then any facts brought forward under The City Council has the authority to hear this request and to make the decision to approve or deny; the hearing was legally noticed and posted, and was held under the requirements of ldaho Code and City ordinances. Schedule for phasing shall be extended by one year, and the initial approval; as outlined below,shall remain. t 6.1 vil ai,i of \I a e 7.2 Pursuant to ldaho Code 50-1316, no lot shall be offered for sale or sold until the final plat has been approved and recorded. 7.3 No building permits shall be accepted for processing until the final plat has been approved and recorded. 7.4 No building permits shall be issued without written approval of the Fire Marshal. 7.5 The one-year extension for preliminary plat approval shall be effective for twelve (12) months from the date of signing of this Order of Decision. No other extension shall be granted unless granted by City Council under the guidelines of Subdivision Ordinance No. 1758, Section 11-02-04, Subsection (6) B. As a part of the final plat application, the Applicant shall submit written verification from Pioneer lrrigation District that all requirements of the District have been met and that the District has no objection with the final plat for each phase being submitted. 7.6 7.7 ln accordance with the requirements of section 11-02-04, Subsection 7, Subdivision Ordinance No. 1758, the developer has the option to file an application for flnal plat approval prior to commencing construction of improvements; or the developer may commence construction of improvements prior to requesting final plat approval. No construction shall be commenced without the written approval of the City Engineer. 7.8 All requirements placed on the preliminary plat by agencies having approval authority shall be met prior to submitting a request for final plat approval, or a financial guarantee for completion of work shall be approved by the City Engineer. As a part of final plat application, the applicant shall submit written verification to the Community Development Director, from the City Engineer, that this requirement for final plat submittal has been met. 7.9 Final plat application submittal shall be in compliance with Section 11-02-06, Subdivision Ordinance No. 1758. 7.10 The Development Agreement for the proposed commercial lots shall be approved by the City Council at the time of preliminary plat approval and shall be executed as a part of final plat approval.
