Greetings,
The above referenced project is adjacent to the Moses Drain.
The Moses Drain is a Federal Bureau of Reclamation facility, which has a 110 foot right of way, which is 55 feet from
centerline of the drain along each side.
Any proposed encroachments within the Moses Drain right of way, must be permitted by the Bureau of
Reclamation. Lupe Rodriguez can be reached at 208-383-2221.

The ldaho Transportation Department (lTD) has reviewed the referenced special use application for
Pioneer Square Subdivision by ECI and Cheri Moore located at 4802 - 4824 Continental Lane, south
of l-84B (Cleveland Blvd.) milepost 53.50. ITD has the following comments:
l. The access to this parcel has been permitted under ITD Permit No. 3-06-376. A copy of
this permit has been attached. Applicant will need to provide cross access agreements and
documentation ofa deeded access easement for the parcels.
2. This development will gain access to the State Highway system to I-84B (Cleveland
Boulevard) from a previously permitted approach. Due to the size ofthe development.
impacts to the State Highwal'system should be anticipated. A Traffic lmpact Study may
be required ifthe new development at fult build out generates 100 or more new trips in the
peak hour or 1000 new trips in a day. The applicant will be responsible to construct any
mitigation identified by the traffic impact study.
3. The applicant does not appear to show any work within the State highway right-of-way.
A permit must be approved before any work *'ithin the State right-of-way may begin. The
applicant can contact Tyson McCoy at (208)334-8335 for an application.
4. tdaho Code 40- 1910( I ) states no advertising display shall be placed or maintained within
the right-of-*'ay of any highway.
5. IDAPA 39.03.60 govems advertising along the State highway system. The applicant may'
contact Justin Pond, Program Manager for ITD's Headquarters Right-of-Way Section at
334-8832 for more information.
6. ITD does not object to the construction of8 four-plexes this parcel provided all access
concerns have been addressed.
