WHEREAS, Bill No. 17, Ordinance No. 3411, was originally approved by the Caldwell City Council on March 21, 2022, following all required public notice and hearing procedures; WHEREAS, said Ordinance was recorded on March 23, 2022, in the office of the Canyon County Recorder, Canyon County, Idaho, as Instrument No. 2022-015605; WHEREAS, it was thereafter discovered that said Ordinance incorrectly referenced 14351 Moss Street as Instrument No. 3271301200 and 0 Moss Street as Instrument No. 23713012AO when, in fact, those numbers represent the parcel numbers; WHEREAS, Ordinance No. 3411, which was published in the Idaho Press Tribune on March 29, 2022, contained the same, above -described errors; WHEREAS, the City wishes to correct said ordinance, re-record it, and re -publish it to correct these errors and to effect the intended vacation. NOW, THEREFORE, BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1: That the City of Caldwell, an Idaho municipal corporation, is authorized by Idaho Code Chapter 18, Title 50 to establish a city irrigation district in the whole or any part of the City by ordinance establish the exterior boundaries of said district which boundaries may, from time to time, be contracted, extended or enlarged by ordinance. CORRECTED ORDINANCE No. 3411- PAGE 1 Section 2: That the following described real property, and all thereof, be, and the same is, hereby annexed and made a part of the CMID of the City of Caldwell, Idaho. That the following real property is hereby annexed, which property is legally described, as following: 14351 Moss Street (Instrument No. 2022-012805) 0 Moss Street (Instrument No. 2017-020238) Section 3: That the City Engineer of said City if hereby directed to record this Ordinance, to forward a copy of said Ordinance to Pioneer Irrigation District, and to adjust the boundaries and map of CMID in accordance with this Ordinance. Section 4: That said City declares its intent to pool water rights incident to the above described property for delivery purposes that said City directs the City Engineer to furnish Pioneer Irrigation District with a certified list or map showing all lands for which water rights have been pooled, all in accordance with Idaho Code 50-1805A. Section 5: Each lot and parcel of land shall be separately assessed for said debt or cost and expense by a front foot and/or square foot method of measurement in proportion to the benefits derived to such property by said improvements or utility services which are optional with each landowner and shall be assessed in proportion to the cost of providing said improvements, sufficient to cover the total cost and expense of the work. The cost and expense to be assessed as herein provided shall include the contract price of the improvements, engineering, legal fees and clerical services, advertising, cost of inspection, cost of collecting assessments, and interest upon warrants, if issued. Section 6: That this Ordinance shall be effective upon its passage, approval, and publication according to law. PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this 16th day of May, 2022.
