BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON22-000001 (Scannell Properties) at a public hearing held, May 2, 2022. Section 2. The property is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to M=1 (LIGHT INDUSTRIAL) zone: A parcel of land located in the NW '/4 SW '/< of Section 36, Township 4 North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows: COMMENCING at the W '/< Corner of Section 36; thence S89046'22"E, 1317.09 feet along the north boundary of the NW '/4 SW '/4 to the N 1/161h Corner of Said Section 36; thence S00028'35"W, 921.59 feet; thence N89031'25"W, 246.15 feet to the northwesterly right-of-way line of South 451h Avenue, the POINT OF BEGINNING; thence S43'49'06"W, 300.40 feet along said northwesterly right-of-way line; thence N46'10'54"W, 974.38 feet to the southeasterly right-of-way line of South 43rd Avenue; thence N43043'50"E, 300.40 feet along said southeasterly right-of-way line; thence S46'10'54"E, 974.84 feet to the POINT OF BEGINNING. Contains 6.72 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as M-1 (LIGHT INDUSTRIAL). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3400 REGARDING ZONE DESIGNATION OF CERTAIN PROPERTY This ordinance provides for the rezone of a parcel of land, in the City of Caldwell as M-1 (LIGHT INDUSTRIAL). A.parcel of land located in the NW'/ SW'% of Section 36, Township 4 North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows: COMMENCING at the W '/ Corner of Section 36; thence S89°46'22"E, 1317.09 feet along the north boundary of the NW '/< SW '/< to the N 1/16th Corner of Said Section 36; thence S00°28'35"W, 921.59 feet; thence N89°31'25"W, 246.15 feet to the northwesterly right-of-way line of South 45th Avenue, the POINT OF BEGINNING; thence S43°49'06"W, 300.40 feet along said northwesterly right-of-way line; thence N46°10'54"W, 974.38 feet to the southeasterly right-of-way line of South 43rd Avenue; thence N43°43'50"E, 300.40 feet along said southeasterly right-of-way line; thence S46°10'54"E, 974.84 feet to the POINT OF BEGINNING. Contains 6.72 acres, more or less. The Ordinance includes a provision to amend the official maps of the City by designating the above - described property as M=1 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 10th day of May, 2022. Ordinance No. 3400 Was passed by the Council and approved by the Mayor on the 2nd day of May, 2022.
